HomeMy WebLinkAboutNS-3.7 ORDNANCE NS-3.7 AN ORDINANCE AMENDING ORDINANCE NS-3, T[~ ZONING ORDINANCE OF ~|E CITY OF SAPJkTOGA~ BY AMENDING SECTION 3.7 RELATING TO ACCESSORY STRUCTURES IN REAR YARDS, AMENDING SECTION 10.5 RELATING TO SIGNS IN COFtMERCIAL DISTRICTS, AND ADDING SECTION 13.3-1 TO ARTICLE 13 RELATING TO STANDARDS ON DESIGN REVIEW FOR RESIDENTIAL DISTRICTS. The City CounCil of the City of Saratoga does hereby ordain as follows: Section 1: Section 13.3=1 is hereby added to Article 13 of Ordinance NS-3 of the City of Saratoga, which section shall read as follows: Section ]3.3=1: DESIGN STANDARDS FOR RESIDENTIAL DISTRICTS. The following standards are hereby adopted as design standards for subdivision development of lands in any residential zoning district in the City of Saratoga, which development or dis- trict is otherwise required to obtain design review under the terms of this article or under the terms of any other articles or provisions of this ordinance. These standards shall be construed as minimum stand~rds~ and are adopted to achieve the purposes heretnabove set ~orth in Section 13.1 of this article: a. CURVED DRIVEWAYS AND ~ARAGE FACINGS i, A minimum o~ 25% of the.driVewayS shall be Curved with garages facing to the sfde~ 2. All driveways directly opposite the end of a l street shall be curved and the garage opening shall face the side. ~'~, b. ROOFS 1. No more than 10% of the homes shall h~ve flat roofS. 2. All roofing materials shall be wood shingles, wood shakes, or other materials such as tile and composition as approved by the City Plan- ning Commission. 3.Colors of roofing materials shall blend with the natural landscape and be non-reflective. c. SETBACKS 1.On a straight street every other home shall have a varied staggered front setback. 2.If fencing ironring the street between houses is part of the subdivisions it shall be staggered. d. ELEVATIONS Identical basic straet elevations shall not be located opposite or adjacent to each other and no closer than one lot removed from the opposite lot. B im e. MATERIALS AND COLORS A schedule of materials and colors shall be required for general approval~ f. MODIFICATIONS With the specific approval of the Planning Commission, modifications of the above design standards or alter- native standards maybe applied, if such modifications or alternatives are ~ubstanttally equivalent in effect to the above standards and equally or better adapted to achieve the purposes stated in Section 13.1. Section 2: The second to the last paragraph of Section 3.7 of Article 3 of Ordinance NS-3, which article relates to R-1 one-family residential districts, is hereby amended to read as follows: AcceSsory structures not attached in any way to the main structure, and not exceeding 14 feet'in height, may be located in the required rear yard provided that no more than 500 square feet or 10% of the area of the required rear ~ard, whichever is the greater, shall be covered by such StruCtures, and provided further thaton a reversed corner lot no suck detached acceSsory structure shall be located closer to th~ rear property line. than the required side yard on the hdjoihing key 10t. Sec.tio~ 3: There is hereby added to Section 10.5 of Article 10 of Ordinance NS-3, which article relates to signs, the following subsection (e), to read as follows: (e) Wherever the rear of the structure housing the mercial use in question opens onto a public parking lot, or a private parking lot for the use of the customers of the structure in question, then an additional identification sign or signs pertaining to the use conducted in the structure in question shall be permitted, facing such rear parking area, the aggregate area of such sign or signs in total not to exceed 50% of the square footage of sign area other- wise permitted under the provisions of Subsection (a) above set forth. Section 4: If any section, subsection, sentences clauses phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, snch decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this ordinance and each section~ subsection, sentence, clause and phrase thereof, respective of the fact that any one or more sections, subsections, sentences, clauses er phrases be held invalid or unconstitutional. -2- Section 5: This ordinance shall be. operative and take effect on and after thirty (30) days from the date of its passage.
