ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SARATOGA REZONING CERTAIN TERRITORY
WITHIN THE CITY OF SARATOGA FOR PORTIONS OF
TWO PARCELS IDENTIFIED AS APN 517-36-008 AND 517-13-012
ZC-95-002; MILLER, 1500 BOHLMAN RD.
The City Council of the City of Saratoga hereby ordains that portions of
certain real property referred to as APN -517-36-008 and 517-13-012, as shown on
Exhibit "A", attached hereto and incorporated herein by reference, are to be rezoned
from R-I-40,000 to HR and from HR to R-1-40,000.
The reasons for such rezoning are as follows: .:. ~.
1. A lot line adjustment between the two parcels has been conditionally
approved by the Planning Commission.
2. The City Council has approved a General Plan boundary amendment
for the realigned portions of the two parcels.
3. The proposed zoning amendment will provide a Zoning District land
use map consistent with the General Plan map and with the
reconfigured parcel boundaries.
4. The proposed amendment is consistent with the goals, policies and
objectives of the City's General Plan and Area I Plan Guidelines.
5. The proposed zoning amendment is consistent with the existing zoning
districts and development in the vicinity.
If any section, subsection, sentence, clause or phrase of this Ordinance is for
any reason held by a court of competent jurisdiction to be invalid or uncon-
stitutional, such decision shall not affect thg validity of the remaining portions of this
Ordinance. The City Council of the City of Saratoga hereby declares that it would
have passed this Ordinance and each section, subsection, sentence, clause and phrase
thereof, irrespective of the fact that one or more sections, subsections, sentences,
clauses or phrases may be held invalid or unconstitutional.
This Ordinance shall be in full force and effect thirty (30) days after its
passage and adoption.
The above and foregoing Ordinance was regularly introduced and after
the waiting time required by law, was thereafter passed and adopted at a regular
meeting of the City Council of Saratoga held on the--21 day of February , 1996, by
the following vote.
AYES: Councilmembers Burger, Moran, Tucker, Wolfe and Mayor Jacobs
NOES: None
ABSENT: None
