AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SARATOGA
REZONING CERTAIN TERRITORY WITHIN THE CITY IDENTIFIED AS
ASSESSOR'S PARCEL NUMBER 503-30-047
The City Council of the City of Saratoga hereby ordains as
follows:
SECTION 1: The City Council finds and determines as follows:
(a) An application has been filed by the owner of that
certain real property located at 14684 Pike Road, Saratoga,
California, identified as Assessor's Parcel Number 503-30-047, to
rezone a portion of parcel 503-29-047 from R-i-40,000 to NHR
(Northwestern Hillside Residential) per Exhibit "A".
(b) Following the conduct of a public hearing, on December
11, 1991, the Planning Commission of the City of Saratoga reviewed
Ordinance AZO-91-004 recommending to the City Council that such
zoning change be adopted.
(c) The proposed rezoning is consistent with the City's
General Plan and consistent with the density of development in the
adjacent area.
SECTION 2: That portion of real property located at 14684 Pike
Road, Saratoga, California, identified as Assessor's Parcel Number
503-29-047, is rezoned from R-i-40,000 to NHR.
SECTION 3: If any section, subsection, sentence, clause or
phrase of this Ordinance is for any reason held by a court of
competent jurisdiction to be invalid or unconstitutional, such
decision shall not affect the validity of the remaining portions of
this Ordinance. The City Council of the City of Saratoga hereby
declares that it would have passed this Ordinance and each section,
subsection, sentence, clause and phrase thereof, irrespective of
the fact that one or more sections, subsections, sentences, clauses
or phrases may be held invalid or unconstitutional.
SECTION 4: This Ordinance shall be in full force and effect
thirty (30) days after its passage and adoption.
The above and foregoing Ordinance was regularly introduced and
after the waiting time required by law, was thereafter passed and
adopted at a regular meeting of the City Council of the City of
Saratoga held on the 4%h day of March , 1992, by the following
vote:
AYES: Councilmembers Anderson, Clevenger, Monia, Stutzman and Mayor Kohler
