OF SARATOGA BY ADDING SUBSECTIONS 4.4 and 4.5 THERETO.
The City Council of the City of Saratoga does hereby ordain as follows:
SECTION 1: There is hereby added to Section 4 of OrdinP~nce NS-4-1 the
following subsections, which amend certain sections of the
Santa Clara County Ordinance Code therein adopted by referfence:
Section 4.4: Section 11.1.3-4o23 of the primar~ code is amended to read as follows:
11.1.3-4.23:
Subsection (a) of Section 1103 entitled "Building
Sewer Materials" shall read as foliows:
(a) The building (house)sewer, beginning two (2) feet
from any building or structure, shall be of the type
known as "service weight cast iron soil pipe" and the pipe
and fittings shall conform in all respects to the co~nercial
standard C. S. 188.S9 of the United Stales Department of
Commerce; or extra strength vitrified clay pipe, ASTM
Desinnation: C278-60T and S-P-361B~ or ~bestos cement
sewer pipe conforming to UPC-MS-I-S8 o~ C 428-59Tj or
SS-P-331a (19S5): or T~pe L coper; or'bitu~inized fibre
pipe conformin~ to Commercial Standard C~S. 116-54 or
the United States Department of Commerce%
Section 4.S: Subsection 140S of Section 11.1.3-5~'i0 of the primary code
iS amended to read as follows:
11.1.3-S.10: 1045 - Rainwater to Pdblic Gutters
No rainwater from roofs, or other rainwater drainage, of
premises, shall discharge upon 'a public ~dewalk. ]'~en
it is desired to conduct rainwater from h building or '
premises to a public street gutter, the bUtside under-
ground drainage piping shall be vitrifled clay pipe, gal-
vanized wrought iron pipe~ ~alvanized steel pipe, approved
concrete pipe, asbestos cement sewer pipe, bituminized
fibre pipe or cast iron pipe. l'~en vitrified cl~y'pipe,
asbeStOS cememt sewer pipe, bituminized fibre pipe or
approved concrete pipe is used, such pipe shall be two
feet from the buildin~ and one (I) foot below the official'
grade. ~Vater leaders connected to such underground drainage
pipe which are on the outside of a building wall that !.~
abuts shall be constructed of galvanized w~ou~ht iron pipe,
galvanized steel pipe, or cast iron pipe for a distance
of not less than five (5) feet vertically above the
official grade.
SECTION 2: If any section, subsections sentence, clause, phrase or portioB
of this ordinance is for any reason held to be invalid or un-
constitutional by the decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remainin~ portions of this
ordinance. The City Council of the City of Saratoga hereby declares that
it would have passed this ordinance and each section, subsection, sentence~
clause and phrase thereof, irrespective of the fact that any one or more
sections, subsectionsj sentences, clauses or phrases be hold invalid or
unconstitutional.
SECTION 3: This ordinance shail take effect and be in full force and effe~
thirty (30) days after its passage and adoption.
This ordinance was re~ularly introduced, and after the waiting time re-
quired by law was thereafter passed and adopted at a regular meeting of the
City Council of the City of ~aratoga held on the 2lst day of November
1962, by the following vote:
