AN ORDINANCE AMENDING ORDINANCE NS-5, THE
SUBD%VISION ORDINANCE OF THE CITY OF SARATOGA,
RELATING TO CURB AND GUTTER REQUIREMENTS FOR
LOCAL STREETS IN R-i-40,000 ZONING DISTRICTS
The City. Council of the City of Saratoga does hereby
ordain as follows:
Section 1: Table II-A of Ordinance NS-5 is hereby
amended as follows:
Column 6, entitled "Curb andGutter" opposite
the caption "Local Street R-i-40,000" in-Column 1,
is hereby amended by deleting the words "Yes(e)"
and substituting therefor the words "No(e)"..
Subdivision (e) of said table, explanatory
of the above provision now changed, is hereby
amended to read as follows:
(e) Curb and gutter may'be required in R-I-40,000
zoning district, where in the opinion of the
Planning CommissiOn and City Engineer such
curb and gutter are required for adequate
drainage and/or support, or where the street
in question is a cul-de-sac.
Section 2: If any section, subsect/on, sentence, clause
or phrase of this ordinance is for any reason
held by a court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the
remaining portions of this ordinance. The City Council
of the City of Saratoga hereby declares that it would
have passed this' ordinance and each section, subsection,
sentence, clause and phrase thereof, irrespective of the
fact that any one or more sections, subsections, sentences,
clauses or phrases be held invalid or unconstitutional.
Section 3: This ordinance shall be in full force and
effect thirty (30) days after the date of
its passage and adoption.
The above and foregoing ordinance was regularly introduced
and after the waiting time required by law was thereafter passed
and adopted this~day of ~'~_~ , 1966, by the follow-
ing vote:
