AN ORDINANCE AMENDING ORDINANCE NSi60, THE
SUBDIVISION ORDINANCE OF THE CITY OF SARATOGA,
BY AMENDING SECTION 13.8-1 (b) THEREOF RELATING
TO EXEMPTIONS FROM PARK AND RECREATION FEES.
The City Council of the City of Saratoga does hereby
ordain as follows:
Section 1: Section 13.8-1 of Ordinance NS-60 of
the City of Saratoga, is hereby amended by amending Sub-
section (b) thereof, relating to exemptions from the
requirement to pay park and recreation fees for subdi-
visions of four or less lots, said new Subsection (b)
to read as follows:
(b) Subdivisions of four or less lots and
single lots and parcels not used for residential
purposes, save and except that it shall be a
condition of each parcel map that the requisite
fee in lieu of dedication as hereafter determined
shall be required to be paid by the owner of each
parcel as a condition precedent to the issuance
of any Building Permit for the construction of
a residential structure on any one or more of said
parcels where such permit is issued within four (4)
years from the date of recordation of such parcel
map.
" Section 2: It is the intention of the foregoing
amendment to make the provisions. of the Subdivision
Ordinance of this City consistent with the amendment to
Subsection (h) of Section 66477 of the Government Code
of the State of California.
Section 3: If ~ny section, subsection, sentence,
clause or phrase of this Ordinance is for any reason held
by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council of the
City of Saratoga hereby declares that it would have passed
this Ordinance, and each section, subsection, sentence,
clause and phrase thereof, irrespective of the fact that
any one or more sections, subsections, sentences, clauses
or phrases be held invalid or unconstitutional.
Section 4: This Ordinance shall take effect and
be in full force and effect thirty (30) days from and after
the date of. its passage and adoption.
This Ordinance was regularly introduced and after
the waiting time required by-'law ~as thereafter passed and
adopted at a regular meeting of the City Council of the
City of Saratoga held on the 20th day ofJune , 1979, by
