AN ORDINANCE OF THE CITY OF SARATOGA AMENDING
ORDINANCE NS-60, THE SUBDIVISION ORDINANCE OF
THE CITY OF SARATOGA, BY PROVIDING THAT THE
PLANNING COMMISSION SHALL BE THE ADVISORY AGENCY
UNDER ARTICLE THREE THEREOF UNDER CERTAIN
CIRCUMSTANCES
The City Council of the City of Saratoga does hereby
ordain as follows:
Section 1: Section 22.2 of Ordinance NS-60 of the
Cit~ of Saratoga, contained in Article Three thereof, is
hereby amended by adding thereto the following paragraph:
In the event that the development is one also
requiring Design Review, or a Conditional Use Permit,
or other permit or entitlement requiring a hearing
before the Planning Commission, then the Planning
Commission shall be the designated Advisory Agency
rather than the Land Development Committee under
this Article Three.
Section 2: If any section, subsection, sentence,
clause or phrase of this ordinance is for any reason held
by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remaining
portions of this ordinance. The City Council of the City
of Saratoga hereby declares that it would have passed this
ordinance and each section, subsection, sentence, clause
and phrase thereof, irrespective of the fact that any one
or more sections, subsections, sentences, clauses or phrases
be held invalid or unconstitutional.
Section 3: This ordinance shall take effect and be
in full force and effect thirty (30) days after its passage
and adoption.
This ordinance was regularly introduced and after the
waiting time required by law was thereafter passed and
adopted at a regular meeting of the City Council held on
the 19th day of September , 1979, by the following vote:
AYES: Councilmen Kalb, Callon, Corr and Matteoni
NOES: None
