AN ORDIblANCE OF THE CITY OF SARATOGA AMENDING
ORDINAb]CE NS=60, THE SUBDIVISION ORDINANCE OF
THE CITY OF SARATOGA, BY PROVIDING FOR NOTICE
AND PUBLIC HEARINGS ON APPROVAL OF TENTATIVE
SUBDIVISION MAPS
The City CouBcifof the City of Saratoga does hereby
ordain as follows:

One of Ordinance NS-60 of the City of Saratoga said section
to be Captioned and to read as follows:

Prior to tentative map approval by the Advisory
Agency under either Article Two 'or Article~zTh~of this
Ordinance, the Advisory Agency shall hold a public hearing
on the application for tentative map approval. Notice
of the public hearing shall be given not less than five
(5) days nor more than thirty (.30) days prior .to the
date of the hearing, by mailing, postage prepaid~ a
notice of the time and place of the hearing to all
persons whose names appear on the latest adopted tax
roll of Santa Clara County as owning property within
500 ft. of the boundaries of the proposed subdivision.
Each application for subdivision map approval
shall be accompanied by an accurate scale drawing of
· the surrounding area for a distance of at least 500 ft. ~
from each boundary of the proposed subdivision, showing '~
the names and last known addresses of the recorded
legal owners of all properties shown within such
500 fto radius, as shown and delineated and as such
names appear on the latest adopted tax roll of Santa
Clara County.
In the event of any appeal of the action of
the Advisory Agency under Section 9 hereof, in addition
to the notice requirements therein set. forth, said
notice shall also be given by mail to all persons
noticed in accord with this section, and in the manner
required by this section.
Unless a public hearing in accord with then-
applicable notice procedures has already been held on
appeal from the Advisory Agency, in the event that on the
effective date of this section there are any subdivisions
for which tentative map approval has been given by the
Advisory Agency, but for which final map approval has not
yet been obtained, then and in that event a public hearing
shall be held at the time of the hearing on the application
for final map approval, with notice of such public hearing
being given in accord with this section.
Sectfo~ 2:~ if any section, subsection, sentence,
clause or phrase of this ordinance is for any reason held by
a court of competent jurisdiction :to be invalid, such decision
shall not affect the validity of the remaining portions of this
ordinance. The City Council of.the City of Saratoga hereby
declares that it would have passed this ordinance and each
section, subsection, sentence, clause and phrase ~hereof,
irrespective of the fact that any one or more sections, substations,
sentences, clauses or phrases be held invalid or unconstitut~
Section 3: This ordinance shall take effect and be in
full force and effect thirty (30) days after its passage and
adoption.
This ordinance was regularly introduced a~ after
the waiting time required by law was thereafter passed and
adopted at a regular meeting of the City Council held on
the 3rd day of October 1979, by the following'~ote:~
