HomeMy WebLinkAboutCity Council Resolution 02-036RESOLUTION NO. 02-036 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA DECLARING BRUSH GROWING ON CERTIAN DESCRIBED PROPERTY TO BE A PUBLIC NUISANCE AND SETTING A PUBLIC HEARING WHEREAS, brush is growing in the City of Saratoga upon certain streets, sidewalks, highway, roads and private property; and WHEREAS, brush attain such growth as to become a fire menace or are otherwise noxious or dangerous; and WHEREAS, brush constitutes a public nuisance. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Saratoga, as follows: 1. That brush does now constitute a public nuisance; 2. That said nuisance exists upon all the streets, sidewalks, highways, roads and private property, more particularly described by common name or by reference to the tract, block, lot, code area and parcel number on the report prepared by and on file in the office of the County Fire Marshal; 3. That it is ordered that Wednesday, the 17~' day of July, 2002, at public hearing during a regular meeting which will begin at 7:30 p.m. in the Saratoga Civic Theater, 13777 Fruitvale Avenue, is hereby fixed as the time and place where objections to the proposed destruction and removal of said brush shall be heard and given due consideration; 4. That the County Fire Marshal is hereby designated as the person to cause notice to be given in the manner and form provided in Article 15, Chapter 7 of the Saratoga Municipal Code, and as the person to herea8er cause abatement of such seasonal and recurring nuisance. The above and foregoing resolution was passed and adopted by the Saratoga City Council at a regular adjourned meeting held on the 5th day of June 2002, by the following vote: AYES: Councilmembers Stan Bogosian, Ann Waltonsmith, Vice Mayor Evan Baker, Mayor Nick Streit NOES: None ABSTAIN: None ABSENT: Councilmember John Mehaffey Nick Streit, Mayor
