SUBJECT: Commission Terms Proposal for Consolidating Expiration Dates Recommended Motion: Direct staff to proceed with recruitment according to proposed transition process. Report Summary: When the six adult commissions were formed at various times over the years, no consideration was given to consistency in expiration dates of the terms. As a result, the terms expire in a haphazard manner, which results in an uneven work flow and inefficient administration. In the four -year cycle during which all commission terms expire, there are sixteen different expiration dates occurring in January, February, April, August and December. Advertising for the January and August expirations must be done during the summer months and during the winter holiday periods, when people are likely to be out of town. Some commissions have terms expiring every year and others only every two years. One commission has three -year terms; the other five have four years. The eight -month period starting last month illustrates the resulting problem. A total of 12 seats on five different commissions expire over five different months. After that, no terms expire for eight months. The staff recommends that the Council make the expiration dates more consistent. This would be accomplished by a one -time adjustment of term lengths for each of the forty commissioners as their terms expire. After the adjustment, all terms would be four years long. Some terms would expire every six months, on April 30 and October 31 of every year. Recruitment would be reduced from sixteen irregular periods to eight evenly- spaced ones. All terms would be four years, and each commission would have half its terms expire every two years. On the Planning Commission, for instance, four terms would expire in October 1994 and three in October 1996. This would allow the three Councilmembers elected in June of 1994 to vote on four commissioners and the two Councilmembers elected in June of 1996 to vote on three commissioners. The attached Exhibit A shows how many seats would expire on each commission during a representative four -year period. Staff recommends that the change be phased in as terms expire for each commission. For instance, the two Finance Committee seats expiring in December 1992 would ordinarily expire in three years. Instead, the commissioners would be appointed to short terms, expiring in October 1993. The transition period would require careful monitoring by staff, O but the problem would be solved permanently by August of 1996. The attached Exhibit B shows the complete transition process. Of course, the Council could arbitrarily lengthen or shorten terms effective immediately because all commissioners serve at the pleasure of the Council. However, staff believes that a gradual approach would be preferable. In this way applicants would know when applying for appointment or reappointment what length of term is involved. APPROVA ORIGINATING DEPT: CITY SAGER SUBJECT: Special Event Permit Request for October 25, 1992, Village Halloween Costume Walk Recommended Motion: Conditionally approve the Costume Waik on Sunday, October 25, 1992, authorizing the Assistant to the City Manager to issue a Special Event Permit once the conditions of the City's Special Event Ordinance have been satisfied. Report Summary:. The Saratoga Village Association will be sponsoring the sixth annual Halloween Costume Waik on Sunday, October 25, 1992, between 10:00 a.m. and 1:30 p.m. in the Village. As in the past years, most of the event activity will be confined to sidewalks with the exception of the parking lot at Corinthian Corners Antiques. Approximately 250 persons will be parading, in costume, around the Village, mainly on Big Basin Way. Many of the Downtown Merchants will be participating by handing out treats to the children as they pass their places of business. SEP241992 This event is being sponsored by the Saratoga Village Association, who in turn will be handling the filing fees, refundable cleanup deposit, liability insurance and indemnity agreement. Since the walk will be on the sidewalks there will not be any need to reroute traffic. Parking will occur as it normally does, on the streets and in the parking district areas. Emergency vehicle traffic will not be effected. A Hot Dog stand will be selling food in the Corinthian Corner parking lot during the walk. A small P.A. system will be used during the registration period from 10:00 AM. to 1:OOPM. Discussion: The attached resolution, if adopted, would accept the various outstanding Offers of Dedication of Trail and Pedestrian and Equestrian Easements in the Teerlink Ranch Subdivision, Tract. No. 6781. Since public interest in the use and improvement of these easements has grown, staff believes it would be appropriate to accept the easements at this time. APPROVA ORIGINATING DEPT: Engineering Q SUBJECT: Acceptance of Offer of Dedication of Pedestrian and Equestrian easement at Saratoga Country Club Recommended Action: Adopt resolution accepting Offer of Dedication. Discussion: As a condition of their recently approved expansion, the Saratoga Country Club was required to dedicate and improve a pedestrian and equestrian trail easement across the southerly portion of their property. The trail alignment was approved in the field by representatives from the Parks and Recreation Commission and the trail has since been built to the City's requirements. Attached is the resolution which, if adopted, would accept the Offer of Dedication for the easement and satisfy the condition of the project. Fiscal Impacts: There will be a marginal impact to the City's trail maintenance budget as maintenance responsibilities for the trail would be assumed by the City. ,Attachments: 1. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA ACCEPTING OFFER OF DEDICATION WHEREAS, an offer of dedication of a Pedestrian and Equestrian Easement has been made pertaining to certain real property situated in the City of Saratoga, County of Santa Clara, State of California, and WHEREAS, such offer of dedication, together with the legal description of such property, is attached as exhibit "A" hereto and made a part hereof, and WHEREAS, the offer of dedication pertaining to said easement has never been accepted by either the County of Santa Clara or the City of Saratoga, and WHEREAS, the City Council has determined that acceptance of the offer of dedication pertaining to said easement would be in the public interest. NOW, THEREFORE, the City Council of the City of Saratoga hereby accepts the offer of dedication with respect to the easement hereinabove described and shown on Exhibit A attached hereto. The City Clerk is hereby authorized and directed to record a certified copy of this resolution in the Office of the Recorder for Santa Clara County, California.
