Call to Order The meeting was called to order at 7:32 p.m. 2. Approval of Minutes of Meeting: Motion by Commissioner Angela Frazier, Seconded by Commissioner Vita Bruno, to approve the January 5, 2004 Action Minutes with corrections as noted. Staff and Council Reports Council Liaison Kathleen King, Public Works Director John Cherbone and Recreation Director Joan Pisani were in attendance at another meeting and were not present to give their reports. Staff Liaison Bloomquist gave brief update regarding reforming the Park Fee Task Force. 7. Oral and Written Communication. None. 8. Old Business: 1) Master Plan Review: City Planner Ann Welsh presented updates and progress on the trails master plan revisions since the January 2004 PRC meeting. 2) Odd Fellows Update Discussion regarding Commissioner Sanquini and Staff's January 20, 2004 property tour and January 24, 2004 Odd Fellows Board Presentation: Commissioner Sanquini gave a brief overview of the property tour indicating it went well and generated some possible alternate trail alignment opportunities. Commissioner Sanquini went on to state the January 24 Odd Fellows Board presentation went very well, with interested expressed from the board to possibly partner with the city in developing a trail at some point within the next couple years. 3) Update about the Dog Park Feasibility Task Force Public Meeting postponement: Commissioner Frazier gave a brief explanation explaining the reason for the postponement of the meeting and her concerns regarding the content of the presentation given to City Council regarding the Dog Park. 9. New Business: 1. Park User Agreements Discussion and Actions: No updates given - agreements not ready for review. 2. DeAnza Trail Funding Agreements Discussion: Feedback given from Commission regarding naming rights issue pertaining to trail acknowledgement of Anonymous Donor. 3. Trails Volunteer program briefly discussed, not action taken. 4. Wildwood Park Discussion: Demolition of the existing play equipment, including the metal slide, scheduled beginning of March 2004. Wildwood Park Task force planning an awareness /celebration event Saturday, February 28, time to be determined. 5. PRC 2002 Community Survey Review Discussion: Staff to present to Council a report giving background on this survey and its results at their regular meeting on March 3, 2004. 6. Wish List Creation: Not discussed due to time constraints. 7. C1P review: Not discussed due to time constraints 10. Commission Reports: Due to time constraints and the late hour of the meeting, reports deferred. Commissioner Angela Frazier announced her resignation from the Parks and Recreation Commission effective immediately. However, she did express her willingness to provide support until a new Commissioner is appointed by Council. 11. Suggestions about future agenda items: 1. Santa Clara Valley Water District Grant Process for trails. 12. Adjournment Commissioner Frazier made a motion to adjourn the meeting. Commissioner Deimler seconded the motion. I am writing to you about the issue of dogs running off leash in city parks. It seems that every time I go to Azule Park and Kevin Moran Park there is at least one dog running loose. I was biten by a dog who was not on a leash when I was five, so now I really don't like dogs and it really bothers me when they are loose. I don't even bother to use the parks anymore because everytime I go there is at least one dog off leash. Since it is a law that dogs be on leash, I would like to request that the police or code 2/24/04 enforcement officers make evey effort to enforce it. The City respects your rights to enjoy our public parks, and takes your complaints seriously. I presented a copy of your email to our Code Enforcement Supervisor who will discuss this issue with our Code Enforcement officer early next week. I will also present a copy of your email to our Parks and Recreation Commission at their next meeting on Monday, March 1, 2004. As you know, it is against Saratoga City Code to allow a Dog to run off leash at a City Park. Azule and Kevin Moran Park (and all of our City Parks) have clearly posted signs indicating no dogs off leash. Our Code Enforcement Officer will respond to calls received while he is on duty. For further information regarding Code Enforcement, please call 868 -1214. When our Code Enforcement Officer is not on duty, the Sheriffs Department will respond. They can be reached at 299- 3233. In an ongoing effort to mitigate such problems, we will request extra patrols for these parks, which will hopefully deter owners from letting their dogs run off leash. As you know, even when rules exist, some people do not follow them. When this occurs, please utilize the reporting system described above and let us know how things are going. John Page 1 of 1 2/25/04 7- 20.040 Animals running at large. Page 1 of 1 Chapter 7 HEALTH AND SANITATION Article 7 -20 ANIMALS AND FOWL* 7 20.040 Animals running at large. (a) No person in the City owning or having control or custody of any dog or any other animal shall cause, permit or allow the same to be at large or to stray or wander into any school yard, school building, public park, public highway or street or upon any private place or property without the consent of the owner or person in control thereof. (b) No dog shall be permitted or allowed in any residential or commercial zoning district in the City, except: (1) Within the confines of a building or structure; or (2) Within the confines of a fenced enclosure at least five feet in height which, in the opinion of an Animal Control Officer, is of sufficient strength and design to prevent escape by the particular dog confined therein; or (3) Where such dog at all times is held and led by a leash of not more than six feet in length, securely attached to a harness or collar on the dog and held by a person capable of exercising complete control over such-dog. (c) The provisions of this Section shall not apply to dogs assisting peace officers engaged in law enforcement activity, or dogs being trained by peace officers, or their agents, for law enforcement activity. (d) An Animal Control Officer shall not seize or impound a dog for running at large in violation of this Section when the dog has not strayed from and is upon private property owned by the dog owner or the person who has a right to control the dog, or upon private property to which the dog owner or person who has a right to control the dog has a right of possession. (e) A dog that has strayed away from but then returned to the private property of its owner or the person who has a right to control the dog shall not be seized or impounded merely for violation of this Section, but in such a case a citation for such violation may be issued; provided, however, that if in such situation the owner or the person who has a right to control the dog is not home, the dog may be impounded, but the officer shall post a notice of such impoundment on the front door of the living unit of the owner or person who has a right to control the dog. Such notice shall state the following: that the dog has been impounded; where the dog is being held; the name, address and telephone number of the agency or person to be contacted regarding release of the dog; and an indication of the ultimate disposition of the dog if no action to regain it is taken within a specified period of time by its owner or by the person who has a right to control the dog. (f) Nothing contained in subsection (d) or (e) of this Section shall affect the authority of an Animal Control Officer to seize or impound a dog or issue citations for violation of any other Section of this Article. Page 1 of 2 Chapter 11 PARKS AND RECREATION Article 11 -05 GENERAL PROVISIONS 11 05.030 Acts prohibited in parks generally. No person shall do any of the following acts within the limits of any park in the City: (a) Cut, carve, paint, mark, deface, disfigure, tamper with, displace or remove any building or structure or any real or personal property, including, without limitation, any bridge, table, bench, fireplace, barbecue, fence, railing, monument, apparatus, facility, paving, water or other public utility lines, or utilities or parts or appurtenances thereof, nor cut, carve, paint, mark, paste, nail, staple or fasten in any fashion any mark, writing, bill, advertisement, sign, card, or display, on any tree, fence, wall, building, monument or other structure. (b) Dig, remove, destroy, injure, mutilate or cut any tree, plant, shrub, bloom or flower, or any portion thereof, nor pick any flowers, foliage, berries or fruit of any such tree, shrub or plant. (c) Excavate, dig up or remove any grass, turf, dirt, earth, sand, gravel, stone, rock, mineral or other substance or substances of which the property is composed or contains; or otherwise engage in any excavation or quarrying, nor remove nor carry away any timber of felled trees, or wood or other materials located within or upon the ground not otherwise specifically enumerated herein. (d) Erect or construct or move into a park any building or structure of any kind, whether temporary or permanent in character, including without limitation tents or other temporary shelters for the purpose of overnight camping, house trailer, camp trailer, pickup camper, or other movable structure or vehicle used or to be used for any such purpose, except as may otherwise be provided in this Chapter. (e) Climb any tree or walk, stand or sit upon any monument, vase, fountain, railing, fence or other structure not designated or customarily used for such purpose. (f) Go upon any lawn or grass plot, where legible signs prohibiting the same are posted in a conspicuous location on or near such plot of lawn or grass. (g) Use, carry or possess any firearm of any description, or air rifle, spring gun, bow and arrow, sling shot, sling or other form of weapon potentially dangerous to wildlife or to human safety, nor hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or throw missiles at any animal, bird or reptile, with the exception of snakes known to be deadly poisonous such as rattlesnakes, which may be killed upon sight; nor shall any person remove or have in his possession the young of any wild animal, or the eggs or nest of any young of any reptile or bird. (h) Use or attempt to use or interfere with the use of any fireplace, barbecue, table, space or facility which at the time is reserved for any other person or group of persons which has received a permit from the Director therefor in accord with Article 11 -10. (i) Be under the influence of intoxicating beverage or any drug so as to be a threat to the safety of himself or any other person or property in such park. (j) Have in his possession, or set off, or otherwise cause to explode or burn any firecrackers, torpedoes, rockets or other fireworks or explosives of inflammable material, or discharge them or throw them into any park area from land or any other property or highway adjacent thereto. (k) Permit or allow any dog owned by such person, or under the custody or control of such person, to enter or remain in the park or any part thereof unless securely held and led by a leash of not more than six feet in length, securely attached to a harness or collar on such dog. Should any dog defecate on any park premises or property, the person who owns said dog, or has custody or control of said dog, shall immediately remove any and all excrement from the park. (I) Use or occupy any area or facility in any manner contrary to any posted notice, including without limitation the entering of any area posted as being closed to the public. Page 2 of 2 body of water in or adjacent to any park, any substance, matter or thing, solid or liquid, which would cause or result in the contamination or pollution of such waters, or which would in any way clog or jam or interfere with the drainage, recycling, filtering or flow of such body of water. (n) Place, dump, deposit or leave any garbage, refuse, rubbish or other trash, including without limitation any bottles, broken glass, ashes, paper boxes, cans and similar items in any of the buildings or grounds of any park, except in proper receptacles or containers as are provided for the purpose of such disposal. (o) Ride or propel a skateboard upon any driveway, roadway, parking area or tennis court within such park, except within a skate park established by the City in accordance with Section 11- 05.080. (p) Throw, kick, or hit any ball, rock, or other object into any public driveway, roadway, highway, parking area, sidewalk, bicycle path, or trail inside or outside the park in such a manner that the ball, rock, or other object could cause injury to any person or cause damage to any vehicle or other property. (q) Any act which is in violation of any other provision of this Code or other ordinance of the City, or in violation of any County or State law. The above prohibitions shall not be applicable to any officer or employee of the City acting in the course and scope of his employment. Page 1 of 1 Chapter 7 HEALTH AND SANITATION Article 7 -20 ANIMALS AND FOWL* 7 20.020 Authority of City Manager and Animal Control Officer. The City Manager and Animal Control Officer shall have the following power and authority: (a) To enforce the provisions of this Article and state laws relating to the care, treatment, impounding and destruction of animals. (b) To arrest any person who violates any provision of this Chapter in the manner provided by Section 836.5 of the Penal Code. (c) To issue citations pursuant to Section 607g of the Civil Code (Animal Control Officer only). (d) To act as a public officer pursuant to Food and Agricultural Code Section 7. (e) The City Manager may formulate rules and regulations in conformity with and for the purpose of carrying out the intent of this Article. Such rules and regulations shall have the same force and effect as this Article when adopted by the City Council and any violation shall be deemed an infraction. (f) Pursuant to Civil Code Section 607g, the City Manager may deputize as an Animal Control Officer any humane officer of the Humane Society of Santa Clara Valley. For this year, Commissions should put together a work plan based on their goals and provide a copy to Cathleen by April 21. If any portion of the work plan involves funding, a cost estimate should be included. She and I will package them together to take to Council at the May 5 meeting. Commission chairs and staff should plan to attend the meeting. Council will review and approve all or part of the work plans, and any approved budget requests will be incorporated into the budget for 2004 -05. Next year and going forward, Commissions should have their work plans ready by February for presentation to Council at the first meeting in March 2005. This process applies to all Commissions except the Youth Commission. • Chair Elections. Chair and Vice Chair elections can remain on the same schedule as now. (Thanks to everyone for your feedback at the meeting.) • Minutes Format. Minutes become action minutes only effective now. Refer to the sample Cathleen gave you or ask one of us for help if you are uncertain. Email the approved minutes to Council. Please keep in mind that the format may evolve over the next few months. • Commission/Council Relations. Council is working on adding material to the Commissioners' Handbook that clarifies the relationship between them and Commissions, as well as Council expectations about Commission responsibilities. Council Commission liaison assignments will not continue beyond July 1, 2004. In addition, the trend is toward moving Commissions back to their mission as advisory policy bodies and away from sponsoring events, volunteering and fundraising. Right now the handbook is scheduled to go to Council for consideration on May 5 —at the same meeting as the work plans. • Commission Budget. Continue to submit to me a request for funds for Commission training, memberships, conferences, retreat food, business cards, office supplies, etc., for next year as we've done in past years. This Agreement is made with reference to the following facts: A. On November 5, 1996, the voters of Santa Clara County enacted by majority vote the 1996 Measure A Sales Tax program and the 1996 Measure B sales tax. The 1996 Measure B program included $12 million for bicycle projects in Santa Clara County. B. The VTA Board of Directors adopted the Santa Clara Countywide Bicycle Plan on September 10, 2002, which included the Tier 1 priority list of bicycle projects. C. The Tier 1 bicycle projects will be funded out of the Bicycle Expenditure Program that was adopted by the VTA Board of Directors on August 3, 2000. D. The Bicycle Expenditure Program is a ten -year $32 million funding program for the Tier 1 projects in the Santa Clara Countywide Bicycle Plan. E. The Santa Clara County Board of Supervisors approved the Measure B Bicycle Program on August 17, 2000. F. VTA has been designated by the County of Santa Clara as the Program Manager for the 1996 Measure B Bicycle Program, and is responsible for disbursing Measure B Bicycle Program funds. G. This Agreement specifies the conditions under which VTA will disburse Measure B Bicycle Program funds to the Member Agency for the DeAnza / PG &E Trail Phase I Project. Section 1. Project Description The Member Agency will complete a Feasibility Study, Environmental Impact Report, and Right -of -Way Determination Study for a Bicycle/Pedestrian Path between Saratoga - Sunnyvale Road and Saratoga Avenue (referred to herein as "Project "). Section 2. Award of Measure B Bicycle Funds $80,000 in Measure B Bicycle Program funds will be provided to the Member Agency for implementation of the Project. Section 3. Minimum Local Match The Member Agency agrees to provide a local match equal to at least 20% of the total Project cost, as shown in Attachment A. The local match shall not include funds from the following sources: a) Transportation Development Act Article 3 30% set -aside for the Bicycle Expenditure Program b) Transportation Fund for Clean Air Program Manager 50% set -aside for the Bicycle Expenditure Program c) Transportation Equity Act for the 21' Century Enhancements 2 "d Cycle set aside for the Bicycle Expenditure Program d) Any other funds approved by the VTA Board of Directors as being dedicated to the Bicycle Expenditure Program Section 4. Bicycle Technical Guidelines' Standards The Member Agency shall ensure that the Project will comply with the standards in the Bicycle Technical Guidelines adopted by the VTA Board of Directors in September 1999, unless compliance would result in extraordinary cost and/or environmental impacts. Section 5. Review of Plans The Member Agency shall provide two copies of the 35% Plans, Specifications and Estimates (PSE) of the Project to VTA as soon as they are available. Section 6. Administrative Costs The Member Agency's allowable administrative costs for the Project are limited to 1% of the Measure B Bicycle funding. Section 7. Reimbursements Any costs incurred for the Project before full execution of this Agreement are not eligible for reimbursement. The Member Agency shall submit invoices to VTA with documentation of costs incurred during the invoice period, using the form shown in Attachment B. VTA shall pay the Member Agency within thirty days after receipt of each invoice and to continue making such payments until the Project is complete or the Measure B Bicycle fund contribution is fully invoiced; whichever occurs first. Section 8. Monitoring and Status Reports The Member Agency shall submit yearly -basis financial and implementation status reports to VTA by August 1 of each year. Each report shall itemize the obligation Page 2 of 5 and expenditure of funds, and the progress to date in the implementation of the Project. Section 9. Audit The Member Agency shall retain all books, documents, papers, accounting records and other evidence pertaining to costs for three years after completion of the Project. The Member Agency shall also allow VTA or an independent auditor selected by VTA to audit all expenditures relating to the Project and to require all recipients of funds allocated under this Agreement to fully cooperate with such audits, within three years of the date of the final payment to the Member Agency. Section 10. Marketing and Public Relations The Member Agency shall use VTA- approved and County of Santa Clara- approved logos and signage for the Project as shown in Attachment C on signs posted at the site of all construction. The logos shall be used on any printed material intended for public dissemination associated with the Project, including but not limited to brochures, handbooks, schedules, maps, and promotional materials. The Member Agency shall credit the VTA as the Program Manager and the County of Santa Clara as the funding source in any related articles, news releases, or other publicity materials that are produced by the Member Agency for the Project. Sections 11. Notices Any notice which may be required under this Agreement shall be in writing, shall be effective when received, and shall be given by personal service, by U.S. Postal Service mail, or by certified mail (return receipt requested), to the addresses set forth below, or to such addresses which may be specified in writing to the parties hereto. REPORT SUMMARY: Introduction: At their February 4, 2004 meeting, City Council provided feedback and directed staff to move forward with the process of developing a pedestrian/cycling trail on PG &E right -of -way lands running parallel to the railroad tracks between Saratoga and Saratoga/Sunnyvale Avenues. Council specifically requested staff generate options for developing an active public process and project development, which will occur over an estimated eight month time frame, and to bring these options back for review by the City Council at a future meeting. In addition, Council expressed interest in retaining the services of a profession meeting facilitator to assist in the public process as directed by Council. If Council so directs, staff will generate a Request for Proposal (RFP) to retain the services of a professional meeting facilitator and bring a contract back to Council for approval at a future meeting. Discussion: Public input: As per Recommended Action No. 1 above, determine type and composition of body to conduct the public input process and project. Listed below are several options for consideration: 1. Public Hearings" (Conducted by City Council in a more formal setting) 2. City Council was informed of the Commissions intention of drafting this survey, and redirected the Commission to draft a Community Wide Survey to establish, on a large scale, the needs of all Saratoga residents and which amenities they would like to see in City Owned Parks. The Community Survey was completed and distributed to all 11,820 Saratoga households early June 2002 (attachment A). Of the 11,820 surveys mailed out, 1, 380 were returned. This yielded an 11.68% return rate, which is exceptional for a survey of this type. The demographic profile of survey participants indicates a well - balanced mix of all age groups responded to the survey. Staff compiled all survey results into useable data and statistics, which are reflected on attachment B. All comments written by survey respondents are recorded on attachment C. Members of the Parks and Recreation Commission used the factual data compiled by staff in attachment B as the basis for the creation of a sorting and ranking system of this data. Two separate survey sorting/ranking "alternates" created by Commission members are shown in attachment D. FISCAL IMPACTS: None. A survey was sent to 11,820 households and enjoyed a 11.68% response, indicating high citizen interest in the topic. • In June 2002, when the survey was done, the PRC was underway on several major Park Improvement projects; the survey was intended as background for future priorities for the commission. • Although the topic of trails and walking paths was not covered, it received the highest amount of unsolicited write -in comments; we also know from previous surveys that trails and paths are a very high priority for citizens. • The PRC took all amenities that 20% of more of the polled citizens indicated as something they or their families would use on a regular basis; each of these areas was explored for current and future action, as described on the following slides. • In addition, from a larger and more strategic perspective, the Commission is working with City Staff on a new Parks, Tails and Open Space Master Plan which will be used for long range planning.
