Call to Order The meeting was called to order at 7:33 p.m. II. Roll Call Commissioners Present: Vita Bruno, Sandra Dodge, Logan Deimler, Angela Frazier, Greg Gates, Anne Sanquini, Thomas Soukup Commissioners Absent: None Others Present: Council Liaison Ann Waltonsmith, Staff Liaison Cary Bloomquist. Public present: Janis Riccomini of A.Y.S.O. III. Report on Posting of the Agenda: Pursuant to Government Code 54954.2 the agenda was properly posted on October 30, 2003 IV. Approval of Minutes of Meeting: Motion by Commissioner Angela Frazier, Seconded by Commissioner Tom Soukup, to approve the October 3, 2003 Action Minutes with corrections as noted on audiotape. Vote taken, action minutes approved 7 -0. V. Administration: 1) City Council Liaison Ann Waltonsmith mentioned CIP discussion at next Council meeting on November 5, 2003 and encouraged attendance of interested Commissioners. "Wish list" items forwarded to Council from Community Meeting discussed. Also reported Odd Fellows Trail Letter was recently mailed out. Reported DeAnza Trail process is moving forward. Will walk trail with Fredricksburg Drive neighbors sometime in the next few weeks. 2) Staff liaison Cary Bloomquist gave brief report on October 22, 2003 Parks Tour with the new Commissioners. Went very well, covering most of the City Parks. Also gave update on Brookglen, El Quito, and Wildwood Park Projects. Projects proceeding forward. Once Wildwood Park water feature drawings complete, will reactivate task force to final review. VI. Oral and Written Communication. Janis Riccomini of A.Y.S.O. gave field condition report and a demographic breakdown, by city, of participants in the VIP program. Also stated A.Y.S.O. will be attending the City Council CIP meeting to lobby for flat grass at Kevin Moran Park. For next meeting, requested a listing of A.Y.S.O. participants, by City, using Congress Springs Park and a listing of the total number of A.Y.S.O. fields used within the City of Cupertino. VII. Action Items: 1) PRC Trails Sub - Committee update on UPRR/PG &E Easement: Update given during Council Member Ann Waltonsmiths report. VIII. Old Business: None IX. New Business: 1) November PRC Retreat: Chair Gates set possible dates of November 15 or 22 for our PRC Retreat at the North Campus site. Will be four hours in duration, with details to be worked out via email. 2) Holiday Party Details and Planner: December 11, 2003, 6 -10 p.m. at the Warner Hutton House. Need to develop list of attendees. Keep casual, with heavy hors dervs and lots of desert. Either contribute money or bring something. 3) December 1, 2003 PRC Meeting: Parks Rules, CIP, Odd Fellows Trail Update, Dog Park Presentation. XI. Reports 1. Sub Committees: a) Trails: Updates given by Commissioner Logan Deimler. b) Creek Cleanup: Commissioners Dodge and Bruno would like to Add a third site to the Bi- Annual cleanup events. Staff to investigate feasibility. 2. Task Forces: No formal reports given. Commissioner Dodge reported met with fellow Handbook Task Force Member Commissioner Sanquini and have generated a table of contents. Handbook, if it proceeds forward, should be completed by the summer of 2004. Commissioner Frazier reported the Dog Park Task Force held one meeting on how to form the task force with members from the public. 3. Commissioner Reports: • Dodge- Attended HPC Meeting. Proposal to turn Eucalyptus Tree area at Historical Park into an Amphitheater. • Soukup - C.S.P. field #1 soggy. • Sanquini -None • Bruno -None • Frazier -None • Deimler -None • Gates - Working with MIS on City Website improvements. The meeting was adjourned at 9:08 p.m. Prepared By: Cary Bloomquist, Staff Liaison SARATOGA CITY COUNCIL MEETING DATE: December 3, 2003 AGENDA ITEM: ORIGINATING DEPT: Public Works CITY MANAGER: PREPARED BY: Cary Bloomquist DEPT HEAD: SUBJECT: Request Santa Clara County amend their Sanborn Park Trails Master Plan to include an easement across County owned Quarry land for possible trail development RECOMMENDED ACTION(S): Adopt and forward attached resolution to the Santa Clara County Parks and Recreation Department requesting they amend their Sanborn Park Trails Master Plan Document to include options to develop the "Saratoga to the Sea Trail" running across County owned property and transfer said property from the County Roads Department to the County Parks and Recreation Department for this purpose. REPORT SUMMARY: City Council Members and staff attended a meeting held last September at the Santa Clara County Offices on Hedding Street, which discussed the feasibility of developing a hiking trail on County Owned property know as parcel numbers 317 -32 -001 and 503 -48 -014 (commonly known as the "Quarry"), which, when combined with other trail easements and linkages, could connect Saratoga to the coast trail system. Also present at this meeting was a representative from the office of Liz Kniss, County of Santa Clara Board of Supervisors District 5 member, to which Saratoga belongs, representatives from the Santa Clara County Parks and Recreation Department and Road Department, and a representative from the San Jose Water Company. Interest in developing the "Quarry" property was expressed by the office of Supervisor Liz Kniss and by all those in attendance, with the understanding that certain conditions would need to be satisfied prior to development of the "Quarry" property and the trail easement. One of these conditions was ownership of the parcels would need to be transferred from the Santa Clara County Roads Department to the County Parks and Recreation Department. This can be considered by requesting the transfer be placed on the Parks and Recreation Department Acquisition Agenda. If the property transfer occurs, the trail can then be incorporated into the Sanborn County Park Trails Master Plan, which is scheduled for revision sometime within the next 12 months. Once placed on the County Master Plan, pursuit of an easement across the adjacent San Jose Water Company parcel can commence, with the long -term goal of establishing several interconnecting linkages to eventually form the "Saratoga to the Sea Trail ". An additional condition prior to establishment of this trail is to place the parcel directly adjacent to Hakone Gardens (which is currently for sale) under Saratoga's sphere of influence, which will enable the City to place a connecting trail easement. This is presently being pursued by the City, and may come before Council at a regular meeting early next year. At a recent Town Hall meeting this past October, County Supervisor Liz Kniss again expressed support for this trail, and suggested the City forward a resolution (attachment B) to the County requesting the intra County property transfer occur so the next step towards developing this proposed trail can occur FISCAL IMPACTS: None at this time. CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S): Possible trail linkage will not be realized. ALTERNATIVE ACTION(S): None. Sincerely, John Cherbone, Public Works Director RESOLUTION NO. 03- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA EXPRESSING INTEREST IN THE DEVELOPMENT OF QUARRY AS " SARATOGA TO THE SEA TRAIL" WHEREAS, the Santa Clara County property parcel # 317 -32 -001 of 37.5 acres and parcel # 503 -48 -014 of 28.4 acres, also known as the Quarry, has a series of trails /roads not in public use at this time; and WHEREAS, this network could serve as a significant hiking linkage, connecting Saratoga to the ocean; and WHEREAS, the "Saratoga to the Sea Trail" could start at Hakone Park, pass through The Quarry, with an easement continue through water company property, pass up through Sanborn Park and continue through Castle Rock State Park over to the ocean. WHEREAS, this property is owned by the Santa Clara County Road's Department and would have to be purchased by Santa Clara County Parks and Recreation Department at a fair market value before it could be considered as part of the County parks system; and WHEREAS, the potential benefit to Santa Clara County residents and Saratoga citizens is great; and WHEREAS, District 5's Supervisor, Liz Kniss believes adding this property to a master plan for the County's General Parks Plan would benefit the residents of Santa Clara County; and WHEREAS, a trail from the floor of the Santa Clara Valley to the ocean would enhance the overall Santa Clara County Parks system and the Saratoga Trail's plan. NOW, THEREFORE, be it resolved that the City Council of the City of Saratoga hereby wishes to express its interest in this property being developed as a "Saratoga to the Sea Trail" and that the Santa Clara County Parks and Recreation Department and the Saratoga Public Works Department explore options to develop the trail and bring these options back to the Saratoga City Council within the next six months. Chapter 11 PARKS AND RECREATION Article 11 -05 GENERAL PROVISIONS 11 05.010 Definitions. For the purposes of this Chapter, the following words and phrases shall have the meanings respectively ascribed to them in this Section, unless the context or the provision clearly requires otherwise* (a) Amplified sound means speech or music projected or transmitted by electronic equipment including, but not limited to, amplifiers, loudspeakers, microphones, bull horns or similar devices or combinations of devices which are intended to increase the volume, range, distance or intensity of speech, music or other sound and are powered by electricity or other sources of energy. (b) Park means and includes all real property, including grounds, roadways, parks, playgrounds, open space reservations, recreation centers or any part or area thereof, located within the City and open to the public for either active or passive recreation, whether owned, leased or maintained by the City. The term shall include all buildings, structures and other facilities located on such real property devoted to such use, and all parks are declared to be sanctuaries for wildlife. (c) Director of Parks, hereinafter in this Chapter referred to as "Director," means that person having authority over all parks within the City, and to whom is delegated the primary authority, responsibility and jurisdiction to administer and enforce the provisions of this Chapter. No person shall do any of the following acts within the limits of any park in the City: (a) Cut, carve, paint, mark, deface, disfigure, tamper with, displace or remove any building or structure or any real or personal property, including, without limitation, any bridge, table, bench, fireplace, barbecue, fence, railing, monument, apparatus, facility, paving, water or other public utility lines, or utilities or parts or appurtenances thereof, nor cut, carve, paint, mark, paste, nail, staple or fasten in any fashion any mark, writing, bill, advertisement, sign, card, or display, on any tree, fence, wall, building, monument or other structure. (b) Dig, remove, destroy, injure, mutilate or cut any tree, plant, shrub, bloom or flower, or any portion thereof, nor pick any flowers, foliage, berries or fruit of any such tree, shrub or plant. (c) Excavate, dig up or remove any grass, turf, dirt, earth, sand, gravel, stone, rock, mineral or other substance or substances of which the property is composed or contains; or otherwise engage in any excavation or quarrying, nor remove nor carry away any timber of felled trees, or wood or other materials located within or upon the ground not otherwise specifically enumerated herein. (d) Erect or construct or move into a park any building or structure of any kind, whether temporary or permanent in character, including without limitation tents or other temporary shelters for the purpose of overnight camping, house trailer, camp trailer, pickup camper, or other movable structure or vehicle used or to be used for any such purpose, except as may otherwise be provided in this Chapter. (e) Climb any tree or walk, stand or sit upon any monument, vase, fountain, railing, fence or other structure not designated or customarily used for such purpose. (f) Go upon any lawn or grass plot, where legible signs prohibiting the same are posted in a conspicuous location on or near such plot of lawn or grass. (g) Use, carry or possess any firearm of any description, or air rifle, spring gun, bow and arrow, sling shot, sling or other form of weapon potentially dangerous to wildlife or to human safety, nor hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or throw missiles at any animal, bird or reptile, with the exception of snakes known to be deadly poisonous such as rattlesnakes, which may be killed upon sight; nor shall any person remove or have in his possession the young of any wild animal, or the eggs or nest of any young of any reptile or bird. (h) Use or attempt to use or interfere with the use of any fireplace, barbecue, table, space or facility which at the time is reserved for any other person or group of persons which has received a permit from the Director therefor in accord with Article 11 -10. (i) Be under the influence of intoxicating beverage or any drug so as to be a threat to the safety of himself or any other person or property in such park. (j) Have in his possession, or set off, or otherwise cause to explode or burn any firecrackers, torpedoes, rockets or other fireworks or explosives of inflammable material, or discharge them or throw them into any park area from land or any other property or highway adjacent thereto. (k) Permit or allow any dog owned by such person, or under the custody or control of such person, to enter or remain in the park or any part thereof unless securely held and led by a leash of not more than six feet in length, securely attached to a harness or collar on such dog. Should any dog defecate on any park premises or property, the person who owns said dog, or has custody or control of said dog, shall immediately remove any and all excrement from the park. (I) Use or occupy any area or facility in any manner contrary to any posted notice, including without limitation the entering of any area posted as being closed to the public. Page 2 of 2 body of water in or adjacent to any park, any substance, matter or thing, solid or liquid, which would cause or result in the contamination or pollution of such waters, or which would in any way clog or jam or interfere with the drainage, recycling, filtering or flow of such body of water (n) Place, dump, deposit or leave any garbage, refuse, rubbish or other trash, including without limitation any bottles, broken glass, ashes, paper boxes, cans and similar items in any of the buildings or grounds of any park, except in proper receptacles or containers as are provided for the purpose of such disposal. (o) Ride or propel a skateboard upon any driveway, roadway, parking area or tennis court within such park, except within a skate park established by the City in accordance with Section 11- 05.080. (p) Throw, kick, or hit any ball, rock, or other object into any public driveway, roadway, highway, parking area, sidewalk, bicycle path, or trail inside or outside the park in such a manner that the ball, rock, or other object could cause injury to any person or cause damage to any vehicle or other property. (q) Any act which is in violation of any other provision of this Code or other ordinance of the City, or in violation of any County or State law. The above prohibitions shall not be applicable to any officer or employee of the City acting in the course and scope of his employment. All such fires shall at all times be attended by at least one responsible person, and before leaving the area of such fire, the same shall be completely extinguished. (b) Stop, stand or park any motor vehicle or bicycle in other than a designated parking area, which use shall be in accord with all posted directions, and with instructions of any parking attendant in the employ of the City. (c) Ride on or in, or drive, any motor vehicle in any park area other than a designated parking area, except such area as is specifically signposted to permit such operation, except that, unless otherwise designated, motor vehicles may be operated at a speed of not to exceed fifteen miles per hour on all paved roads in any park area. (d) Operate or ride as a passenger on any bicycle on other than a paved road or bicycle path designated for that purpose. (e) Ride or lead any horse on other than paved roads or equestrian pathways designated for that purpose, or cause, permit or allow any horse or other domestic animal to be untethered or otherwise to be loose or to roam upon any park area. (f) Urinate or defecate other than in the receptacles provided therefor in restrooms provided for such purpose. (g) Practice or play golf, or operate any motor - driven model airplanes, boats or cars, or swim or bathe, or engage in any archery or target practice or fishing, except in such areas as are specifically signposted and designated therefor. (h) Lunch or picnic in any place other than as signposted and designated for such purpose, and in such regard, fireplaces, barbecue facilities, benches and tables shall be used on a first -come, first -serve basis and no person shall use such area or facilities for an unreasonable length of time for such purpose. (i) Day or night camping in other than designated areas. (b) The right to the exclusive use or occupation of any park or area thereof by any person or group of persons, regardless of number. (c) Amplified sound exceeding twenty -five watts of total output from all channels of equipment and used therefor in any park or area thereof. (d) Hawking, vending, peddling, selling, soliciting the sale of or offering for sale any food, drink, goods, wares, merchandise or services of any kind, or advertisement of the same, in any park or area thereof. (a) No person shall consume, drink, exhibit or possess any alcoholic beverage within Wildwood Park at any time between 12:01 A.M. Monday and 8:00 A.M. Saturday of each week, without first having obtained a group use permit, pursuant to Article 11 -10. (b) The activities described in subsection (a) of this Section may only take place within the area of the park so designated by the group use permit. There is also a structure where you can take pictures of you and /or your dog - it has 2 dogs on the front with holes cut out where their faces are - to put you and /or your dogs head in to take a picture. Under construction. To be opened in 2004 Local Dog Parks • San Jose 1) Two acres of Hellyer County Park in south San Jose have been set aside as an off -leash area for dogs. The clog prk is situated at the northeast end of Hellyer Park, near the Shadowbluff group area. A six -foot fence encloses the two -acre area. Fenced, benches, shade trees, a lawn, poopbags, and a drinking fountain are available. Use of the area is free, but a vehicle entrance fee is collected. Open daily except Wednesday from 8am until one half hour before sunset. To maintain the dog park lawn, the area is closed every Wednesday. 2) Miyuki Dog Park Located on Miyuki Drive, off Santa Theresa Blvd, a few blocks east of the Santa Theresa Community Hospital at Cottle Road. Fenced, poopbag dispenser, benches, double -gated entry. • Fremont 1/ Mission Peak east end of Stanford Avenue, off Mission Blvd. Open daily 5 am to 10 pm, fenced, trees, parking, restrooms, water, trashcans; comments: wide open spaces, park is 2,999 acres, terrain is hills giong up to a 2517 foot peak.
