Seconded by Commissioner Logan Deimler, to approve May 6, 2002 Action
minutes. Vote taken, action minutes approved 4-1-0 (Commissioner Nick
Seroff abstained, Commissioners Fronczak and Gates arrived after vote
taken).
V. Administration
Chair Clabeaux reported basketball court at Brookglen Park will be completed
in the near future. Also reported Azule Park project is on schedule.
Recreation Supervisor Kim Saxton-Heinrichs gave update on "Art in the
Park" event hosted by the Arts Commission on Saturday, September 28. Also
reported summer camps are well attended and running smoothly. Skatepark
continues to have challenges, and attendance has been relatively low.

3) Community Survey Update: Resident Jean Barrick expressed concerns
over timing of distribution of survey. Also concerned about intent of survey
(hidden meaning or hidden agenda regarding Heritage Orchard). Commission
discussed survey distribution. �hair �flabeaux anade a motion to have staff
send a letter to Saratoga 1�1ews extending the ti�ae pe�iod alloweng

carried 5-1-1 with �ommissioner Sandra ➢Dodge �pposed and
�ommissioner Angela lFrazie� Abstaining. Further Community Survey
discussion ensued, with Commissioner podge providing suggestions for
bringing back survey distribution options at the September meeting.
Commissioner podge will call Chamber of Commerce and see if the
Commission can have a booth at Celebrate Saratoga in an effort to gain more
survey input. Back Qo gte�n 1.
1) Action Item list reviewed. Commissioner Seroff made a suggestion to
have each individual action item listed under old business when its due

Issue of communications to Council discussed. 1V1[otion by

time permits, will take all action iterns and copy all �ommissioners,

Capital Improvement Project recommendations from Commission to
Council briefly discussed. �ommissioner �ates tnade a enotion to send
a letter and give a presentatuon to �ouncil �equesting the setting aside
of funds from the ��P anytiene we consider the development o�-
impr�ovement of a park. Seconded by �omrnissioner Seroff.
Discussion ensued. Vote taken, rnotion carried (7-0).
Remainder of Action Item list and Commission Policy list reviewed. No
motions or official recommendations were made.
2) Union Pacific Rail Road Trail Update given by Staff Liaison Cary
Bloomquist and Commissioners Logan Deimler and Greg Gates.
Direction from Council was to have staff develop a methodology of
gauging public opinion and gathering public input for this project since
there exists a very large opposition group to the project living directly
adjacent to the proposed trail. Non-Advocacy consultant will need to be
retained at some point during the process to perform the work of gauging
public opinion. Extensive discussion ensued. No official action or motion
made.
4) Update given on Wildwood/Brookglen Park Community Input Meeting.
Flyer to be distributed after input from Commissioner podge and Gates.
Meeting time and date will be set after final draft of flyer approved.
5) Update given regarding Parker Ranch Water Tank Trail. Usage of trail by
unauthorized cyclist groups continues, but on a greatly reduced frequency.
V�dI. P1ew �usiness
1) Preparation of Trail Markers for City trails. Discussion of costs, logistics,
naming reviewed. Trails subcommittee directed to investigate in further
detail. Staff directed to provide costs to Trails subcommittee regarding
signage.
�X. �ommissioner and Staff IteporQs
1) Subcommittee update: Commissioner Frazier gave brief update on El
Quito Park Task force meetings. Included in this discussion was a brief
update on the surveys. West Hope Church parking status update given.
Still in the works, with no final decision yet from the church.
Commissioner Deimler reported trails volunteers Bill Brooks and Denise
Goldberg will be joining the trails subcommittee as community
representatives.
Commissioner Fronczak gave feedback regarding city fees. Will be
developing recommendation during the next several months for
presentation to council.
2) Task Force Report: No additional updates given.
3) City Hall Update by Staff Liaison No update given.
4) Commissioner Reports: Chair Clabeaux gave brief report regarding West
Valley Sanitation District Walkway for Kevin Moran Park. Pathway
widened for Sanitation District vehicle access. Large pad for vehicle
turnaround placed near highway 85 pedestrian walkway. Pad is large
enough to place a basketball hoop. lVlotion made by �ommissioner 1Vick
Seroff, seconded by �oananissioner Sandra I)odge, to place a
basketball�o p at this site. �Discussion ensued. �ote taken, motion
�id-a�e�-ca r�3-2-2 with �omrraissioners Gates ancl F'razier opposed

on a future agenda for vote after public notice given.
Commissioner Seroff gave report indicating the need to create an action
item list and to have commission policies.
Commissioner Gates gave report regarding Belgrove Park. Wants more
information regarding park. Staff to come back with information.

No person shall do any of the following acts within the limits of any park in the Ciry:
(a) Cut, carve, paint, mark, deface, disfigure, tamper with, displace or remove any butia becue, aii ng real
or personal property, including, without limitation, any bridge, table, bench, fireplace,

advertisement, sign, card, or display, on any tree, fence, wall, building, monument or other structure.
(b) Dig, remove, destroy, injure, mutilate or cut any tree, plant, shrub, bloom or flower, or any portion thereof, nor
pick any flowers, foliage, berries or fruit of any such tree, shrub or plant.
(c) Excavate, dig up or remove any grass, turf, dirt, earth, sand, gravel, stone, rock, mineral or other substance or
substances of which the property is composed or contains; or otherwise engage in any excavation or quarrying, nor
remove nor carry away any timber of felled trees, or wood or other materials located within or upon the ground not
otherwise specifically enumerated herein. �nrhether temporary or permanent in

adopted a Conflict of Interest Code for the City of Saratoga; and

FOR COMMISSIONER APPOINTED TO CBT COMMISSIONS
On August 7, 2002 the City Council adopted Ordinance 208 establishing staggered
term limits for City commissioners. This ordinance will prevent the various
Commissions left without a quorum with the result of having to cancel monthly
meetings. This is in tum is due to the fact that at some point up to four
commissioners' terms expire.
Please agendize this topic on your next commission meeting just in case your
commissioners have questions.

THE CITY COUNCII. OF T'HE CITY OF SARATOGA DOES ORDAIN AS FOLLOWS:
Section 1. Findings.
A. The City of Saratoga has established a number of commissions to advise the Cit_y
Council in reviewing, establishing, and implementing City policy in a number of
areas. Commissioners provide an invaluable service to the City and their
participation in these civic affairs goes to the very heart of representative
democracy at the local level.
B. The City Council has established common requirements regarding qualifications,
attendance, removal, vacancies, meetings, and rules of procedure for all City
Commissions.
C. Cunently, each Com.mission has new Commissioners appointed to four year terms
every other year. In one year, four Commissioners may leave a Commission and
be replaced by new Commissioners. In the nexi year there are no new
Commissioners and in the following year, three Commissioners may leave and be
replaced by new Commissioners.
D. The City Council wishes to increase the frequency with which interested citizens
may apply for a seat City Commissions and to avoid the loss of significant
expertise at a single time. Therefore, this ordinance amends the Saratoga City
Code to provide that the terms served by the Commissioners on each Commission
shall be evenly staggered. Specifically, on each Commission, the terms of
approximately an equal number of Commissioners shall expire each year, and those
Commission seats will be open to qualified applicants.
E. In order to make the transition from the cunent schedule of dates on which
Commissioner terms expire to the staggered schedule established by this
ordinance, section 2.2 of this ordina.nce authorizes the City Council to appoint
Commissioners to transitional terms of less than four years through 2006.

Section 2. Adoption.
Section 2.1. Staggered Terms.
Article 2-12 of the Saratoga City Code is hereby amended by adding the following
paragraph (c) at the end of section 2-12.12:
"(c) For each Commission, the temis of the Commissioners shall be staggered such that

shall expire. Where a Commission has seven Commissioners, the terms of two
Commissioners shall expire each year except that in the year after the first six Commission
terms have expired, only one term shall expire. The limitations set forth in this paragraph

Article 2-12 of the Saratoga City Code is hereby amended by adding the following
paragraph (d) at the end of section 2-12.12:
"(d) Notwithstanding pazagraph (a) of this section, where the terms of Commissioners on
a Commission do not comply with paragraph (c) of this section, a Commissioner may be
appointed to a term less than four years for the purpose of making the terms of the
Commissioners on the Commission comply with paragraph (c). No term shall be reduced
after a Commissioner is appointed to serve the term, except as otherwise provided by this
Code. For purposes of pazagraph (b) of this section, a term of less than four _years
established pursuant to this paragraph is not a full term. This paragraph shall be of no
further force and effect after December 31, 2006.
Section 3. Publication.
This Ordinance shall be published once in a newspaper of general circulation of the City of
Saratoga within fifteen days after its adoption.

Sealed bids for the Azule Park Project were scheduled to be open on July l Oth. Unfortunately the
City did not receive any bids on the project. Staffmailed bid packages directly to approximately 20
General Landscape Contractors and 10 Bid Exchanges. Staff made post-bid inquires to the most
promising and experienced plan holders. A majority of the plan holders .indicated that they were to
busy with other contract work and that they would not be able to perform the Azule Project in the
timeline specified in the contract. They also indicated that the numerous hardscape elements in the
park were more than they preferred to take on at this time.
Because the City had gone through a formal bid process as specified by the Public Contract Code
and received no bids, staff was able solicit bids informally. Staff decided to solicit bids from
Grading and Paving Contractors instead of Landscape Contractors. Three contractors were
interested in the project and a summary of these bids is as follows:
Duran Venables, Inc.: $797,412
Andreni Bros., Inc.: $995,980
Stevens Creek Quany, Inc.: $1,037,953

I wish to strongly protest the recent placement of gates at the
above-referenced locations. Where was the public notice by the Water
District? I resent their heavy-handed actions. I live in this neighborhood
and walk along the creek as do many other residents on a regular basis,
and have for years. Our actions have been open, in plain sight, and have
established an easement.
I understand that the City does not have jurisdiction over the SCVWD-owned
land, but I do respectfully request that the City communicate displeasure to
the SCVWD at having not been alerted to their planned actions.
Please let me know if there is anything further that I can do that may
result in the removal of these gates.

The City of Saratoga owns a small parcel of land located on the northeast
corner at the intersection of Quito and Pollard roads. While this is designated as
parkland, a park has not yet been developed there.
The PRC is exploring possible uses for this unnamed park, but it's awkward
trying to reference "No Name Park" or'The Unnamed Park" during discussions.
To prevent this, and to give the park an identity within the City, the PRC wants to
propose formally naming this park.
The most commonly used unofficial name by which this park has been known
is "Oak Grove Park." Since this name certainly reflects the dominant feature of
the park, the PRC proposes making this its formal name. The name "Oak Grove
Park" is also in keeping with the concept of developing the park as an
educational facility, one featuring native plants suitable for use as landscaping
within Saratoga.
Therefore, the Parks and Recreation Commission respectFully requests the
Saratoga City Council to adopt "Oak Grove Park" as this park's official name, and
to direct staff appropriately.

Dear Members of the City Council,
I was confused by the recent survey about the parks, that is why I am
writing you. I wasn't sure if the Heritage Orchard was included in with
the "parks", or not. I would like to recommend that the Heritage Orchard
be removed from the jurisdiction of the Parks and Recreation Commission.
Since it was the Heritage Preser-�ation Commission that designated it a
heritage resource I would like to suggest that the Heritage Orchard be
put under their jurisdiction. I think they are the ones who know the
most about it. I was a charter member of the Heritage Preservation
Commission, and along with my husband Kurt, was instrumental in helping
Saratoga set up a Heritage Commission. That is why I have a special
interest in the orchard.
Another item I would like to address is the eventual signage that will be
installed for our beautiful new library. Perhaps it can "Saratoga
Library and Heritage Orchard".
Otherwise, I remain a very happy resident of Saratoga.
