Report Summary:
Dr. and Mrs. Robert Lin have requested a refund of the
appeal which they have withdrawn.
Fiscal Impacts:

Costs associated with processing the appeal were $56.40, for mailed
notice to neighbors and about $65.00 for published notice. In
addition, the hour of staff time for preparation of the otices and
the publicity memo to the Council are charged at $32.29, the
productive hourly rate for the Deputy City Clerk. �Iotal costs
would thus be $153.69. If the costs are deducted from the appeal
fee of $450, the refund would amount to $296.31.

Dear Council Members:
When our application for Design Review Approval to construct
a new 6,170 sq. ft. two -story home at above mentioned site
deniled.by Planning Commision, we have told that we only
have 15 days to appeal to City Council. We did so, and paid
$450.00 for appeal fee on November 18, 1993.
After carefully reviewed our plan, we realized that we need
more time to redesign our home than we original planned.
Therefore, we wish to withdraw the appeal at this point.
We believe that City have not done anything to prepare our
case, so we request that City refund our appeal fee either
in full or pro- rated.

SUBJECT: Letter Agreement Extending the Term of Agreement with
Hakone Foundation from December 31, 1993, to March 31,
1993
Recommended Motion: Direct the Mayor and City Clerk to execute the
Agreement on behalf of the City.
Report Summary: The Maintenance Agreement and the Lease Agreement
between the City and Hakone Foundation renew on January 1st for
another year unless cancelled by either party. At its joint
meeting with the Hakone Trustees on November 9th, it was agreed
that the Agreements need rewriting and to allow sufficient time to
do so that the existing Agreements be extended through March 31,
1994. This Letter Agreement implements that decision.
Fiscal Impacts: None
Follow Up Actions: Send Letter Agreement to Hakone Trustees
President, Gladys Armstrong, for execution.
Consequences of Not Acting on the Recommended Motions: The
Maintenance Agreement will expire on December 31, 1993, and the
Lease Agreement can be cancelled on 30 days written notice.

SUBJECT: Leonard Road Assessment District, Capital Project No. 9308
- Acceptance of Street Dedications
Recommended Motion(s): Move to adopt resolution accepting offers of
dedication for street purposes.
Report Summary: Attached is a resolution which, if adopted, will
accept two Offers of Dedication for Street Purposes. on Leonard
Road. In order for the project to proceed, it is necessary for the
City to acquire this right -of -way which will be improved by the
project. Upon completion of the project, Leonard Road will then be
a publicly maintained street improved to City standards.
Fiscal Impacts: None. The offers were obtained at no cost to the
City or the assessment district.
Follow Up Actions:. The resolution with the offers attached will be
recorded.
Consequences of Not Acting on the Recommended Motions: The offers
will not.be accepted and the project will not proceed.

line of which is described as follows:
BEGINNING at a point in the center line of the Saratoga - Sunnyvale Road, formerly
Saratoga Mountain View Road, distant thereon South 0 039' East 230.00 feet
from the Northeasterly corner of that 21.86 acre tract of land described
in the Deed to Peter Donald Ljepava, et ux, recorded July 2, 1946 in
Book 1372 Official Records, page 177 in the office of the Recorder of the
County of Santa Clara, State of California;
THENCE South 89 017' West and parallel with the Northerly line of said 21.86 acre
tract 778.61 feet to the Easterly line of that approximately 9.279 acre
tract of land described in the Deed to Beretta Leonard, et vir, recorded
April 29, 1947 in Book 1468 Official Records, page 81 in the office of the
Recorder of the County of Santa Clara, State of California, being the
terminus of this line.
The undersigned understand that the within offer can only be accepted by
resolution of the City Council of the City of Saratoga pursuant to Streets and
Highways Code Section 1806 of the State of California, and recordation of this
instrument shall not and will not constitute acceptance of the within offer to

SUBJECT: Cooperative Agreement No. 7 -SAR with the Santa Clara
County Traffic Authority concerning Prospect Road Visual
Barrier
Recommended Motion(s): Move to approve the agreement and authorize
its execution by the City Manager.
Report Summary: Attached is yet another Cooperative Agreement (No.
7 -SAR) with the Santa Clara County Traffic Authority for you to
approve. This agreement covers the design and construction of a
visual barrier along Prospect Road between Route 85 and Plumas
Drive. You may recall that several months ago the owners of the
four properties which back up to Prospect Road complained about a
visual intrusion and petitioned the City and the Traffic Authority
to mitigate the intrusion. Since then, the Traffic Authority has
verified that the intrusion does exist and has agreed to extend
the masonry block soundwall across the four properties at a height
of eight feet.
The attached Cooperative Agreement spells out the terms for this
additional work. Essentially, the Traffic Authority will be paying
for the design and construction of the barrier and the City will be
administering the construction contract. Also, I have agreed to
donate surplus block from the Bonnet Way Soundwall project for this
project to help reduce the overall cost of the visual barrier to
the Traffic Authority. Several coordination meetings have been
held with the affected property owners and they are satisfied with
the proposed barrier height and design.
The City .Attorney has reviewed the agreement and is satisfied with
its content. If the Council approves the agreement,. it will be
forwarded to the Traffic Authority for their approval on January
10. Construction of the wall could then begin sometime in February
and be complete in early April_-,"
Fiscal Impacts: All design and construction costs will be
reimbursed to the City by the Traffic Authority. Construction
administration costs will be a minimal amount and will be absorbed
by Public Works staff in the current budget. The donated block is
worth approximately $3,500, but has already been paid for by the
Bonnet Way Soundwall project, Capital Project No. 9113.

Follow Up Actions: The agreement will be signed and will be
forwarded to the Traffic Authority for their approval. In the
meantime, the plans will be finalized and staff will prepare to
solicit bids for the work.
Consequences of Not Acting on the Recommended Motions: The
agreement will not be approved as presented. The Council can
modify the agreement if desired. If you choose not to approve the
agreement however, the project cannot proceed.

SUBJECT: MUNICIPAL ELECTION 1994: ISSUES TO BE DECIDED BEFORE NOMINATION
PERIOD
Recommended Motion:
Authorize candidate's statements of 200 or 400 words. Direct staff to
prepare resolution requiring that candidates pay costs of printing the
candidate statement in the sample ballot, with advance deposit of $225 if
200 -word limit is set and $450 if 400 -word limit is set.
Report Summary:
The next municipal election is June 7, 1994, and the nomination period
begins in mid - February. Certain decisions must be made biefore the
nomination period. Normally the costs of the candidate statements are
recouped by requiring advance payment of the estimated cots from the
candidates, with any excess payment being refunded. If t e Council
wishes, however, the City may pay for the candidate statements. For the
last several elections, the length of the candidate statement has been 400
words and advance payment has been required for the statement.
On a related subject, the Council may wish to know that the date of the
municipal election is unaffected by the change in California's
presidential primary election. In presidential election years, the County
Registrar of Voters will conduct two primary elections: a presidential
primary in March and one for all other offices in June. Saratoga's
municipal election will remain consolidated with the June primary.
Fiscal Impacts:
Cost of each candidate statement is estimated at $225 to $450.
Follow Up Actions:
The resolution confirming these decisions and the resolution calling the
election will be presented at the Council meeting of January 19.
Consequences of Not Acting on the Recommended Motions:
Staff will assume that no changes are intended to past procedure and will
prepare materials as for most recent election.

SUBJECT:. Renewal of Membership in the National League of Cities
for 1994 at a. Cost of $1,307.00
Recommended Motion: Do not renew membership.
Report Summary:
Last year the City Council agreed to become a member of the NLC for
one year based on a one -half price offer for. 1993. Council agreed
to review the value of this membership at renewal time. The City.
has now been invoiced -for 1994 dues, A total of $10,800 has been
budgeted for City membership in account 7071 -5582.
Through 11/30/93, $6,166 have been expended for membership in ABAG
($3,499) and the Santa Clara County Cities Association ($2,667).
League of California Cities 1994 dues have not been paid yet. 1993
League dues were.$3,953 and 1994 League dues will be increased,by
3% bringing them to $4,072. This will leave a balance in the
account of $562. There are not sufficient funds remaining to cover
NLC membership.
Fiscal Impacts:
It will cost the City $1,307 for the NLC membership. To pay for
this a budget adjustment is needed in the amount of $745.
Follow Up Actions:
Prepare P.O. and pay invoice on January warrant list if approved.
Consequences of Not Acting on the Recommended Motions:
City membership in NLC expires on December 31st.
