Review of Accounts Payable Check Register Recommended action: That the City Council review and accept check registers for the following accounts payable payment cycles: January 25, 2012 February 2, 2012 5. 2012 Saratoga Serves Picnic Barbeque at Wildwood Park Recommended action: Review report and approve expenditure of up to $4,000 of Community Events funding for the 2012 Saratoga Serves picnic at Wildwood Park. 6. Motor Vehicle (MV) Resolution Authorizing Installation of a Stop Sign Recommended action: Move to adopt Motor Vehicle Resolution authorizing the installation of a stop sign on Marshall Lane at the intersection of Marilyn Lane. 7. Resolution Adopting City of Saratoga Annex to Santa Clara County Annex to the 2010 ABAG Report "Taming Natural Disasters" as City of Saratoga's Local Hazard Mitigation Plan Recommended action: Approve the resolution adopting the City of Saratoga Annex to the Santa Clara County Annex to the 2010 Association of Bay Area Governments (ABAG) report "Taming Natural Disasters" as the City of Saratoga's Local Hazard Mitigation Plan. Update of Impervious Surface Definition and Site Coverage Exemptions Recommended action: Provide direction to the Planning Commission to make a recommendation to the City Council regarding zoning ordinance changes that would: 1. Update the impervious surface definition to be consistent with the City's Water Efficiency Landscape Ordinance. 2. Provide consistency among site coverage exemptions for driveways and related emergency vehicle turnarounds within the Hillside Residential, Residential Open Space, and Agricultural zoning districts. 9. 2012 City Council Summer Recess Recommended action: Accept report and provide staff with direction regarding the 2012 City Council Summer Recess. 10. Social Media Policy Recommended action: Approve resolution adopting a social media policy for the City of Saratoga. Agenda Item 8: Update on Impervious Surface Definition and Site Coverage Exemptions Crystal Morrow City Clerk - Letter from Ron Hills Honorable Mayor & City Council members, Feb. 15, 2012 Re.. 1- Presentation by Ron Hills to the Saratoga City Council on Jan. 28, 2012, requesting help to resolve his Impervious Coverage vs. Cabana Building Permit issue. 2- Letter from James Lindsay to City Council dated Feb. 15, 2012. Subject: Update of Impervious Surface Definition and Site Coverage Exemptions 3- Building Permit 09 -0344, Ron Hills poolside Cabana. Dear Saratoga City Council, First, I want to express my sincere appreciation for the City Council and Planning Dept. actions regarding my request (ref. -1) of Jan. 12, 2012, which centered on clarifying the definition of Impervious Coverage and the final sign off on the Building permit for my completed Cabana. I especially want to thank James Lindsay and his dept's efforts in helping to resolve this issue. I completely support the recommendations (ref. -2) from Mr. Lindsay, with only one concern, which is on page -2, middle section. The last portion of the potential new words for defining Impervious Coverage contains the words "and disrupts the aesthetic of the landscape ". My understanding is that the General Plan contains similar words and the code must reflect the Plan. The word "aesthetic" means "something you can see" and can require a subjective judgment call for interpretation. Deleting the word "natural" from natural landscaping helps clarify the intent of the code. But I have a concern that new technologies such as Artificial Turf, landscaping gravel, tree bark, recycled rubber (made to look like bark) or other materials that percolate water could still be considered as Impervious Coverage when someone tries to interpret "aesthetic of the landscaping ". The Impervious Coverage section of the Code also doesn't clarify which portions of the property the City wishes to control for landscaping aesthetics. At present the City requires Planning to approve visible yard landscaping but it is not clear under this code section if non - visible areas are to be considered. I believe that the present intent is to make sure the visible areas (usually the front yard) provide an attractive appearance. I believe that material used by a homeowner in his non- visible areas (such as enclosed back or side yards) should not require Planning approval and not be considered Impervious if that material allows water percolation and/or water retention. I believe it would help everyone to clarify what portions of the property the City wishes to control for aesthetics (such as visible vs. non - visible). Therefore I would suggest the City Council clarify these issues by stating the Councils intent: 1- The City is concerned about water percolation into the ground and water runoff. Therefore materials that allow water percolation and/or help retain water on the property, such as Artificial Turf, landscaping gravel, tree bark, recycled rubber (made to look like bark) or other materials that percolate water should not be counted Impervious Coverage. 2- The City is primarily concerned with the appearance of the property as seen by the public and it is not the intent to control the aesthetics of non - visible areas such as rear or side yards. This would give guidance and clarification to present and future Planning Dept. decisions, still meet the intent of the general Plan and allow better decisions on how to meet the Water Efficiency Landscape Ordinance.
