HomeMy WebLinkAbout1978 Parks and Recreation Reports Pathways/TrailsREPORT TO MAYOR AND CITY COUNCIL DATE: 10/24/78 COUNCIL MEETING: 10/24/78 SUBJECT Background Information:Re: Trails and Pathways ---------------------------------------------------------------------------- The purpose of this memorandum is to summarize a number of items for the benefit of the Council concerning the Trails and Path- ways Program. Basically, there is a trails..and pathways element of the circulation element of the General.Plan. This was recently updated after a number of public.hearings. Also-on-record, are a number of "Offers of Dedication" which have in most cases not been accepted by the City but are encumbrances on those particular parcels. In most cases these offers have been recorded. Furthermore, we are in the process of'conditioning some Tentative Maps for actual construction and development of trails and pathways particularly in the hill area, one being the Parker.Ranch, with-some others being contemplated in the western hill portion of Saratoga. This will necessitate a commitment on the part of the City to ultimately.maintairi these trails if they are developed as we do with streets once they are accepted,as public trails and /or pathways. In April, the-City Council met with the Parks and Recreation Commission and discussed this issue. As a follow-up to that meeting, the.'Council formally adopted a - directive to the Commission asking that they develop a demonstration section for Trails and Pathways Program for consideration and review. In August, the City Council received this report from the Parks and Recreation Commission. This was entitled "Demonstration Trails Recommendation". At that time the Commission asked the Council to review it and discuss it with the intention that the. Commission would then finalize the cost estimates for development and maintenance and then hold some public hearings on that demonstration section thereafter. To date, the City Council.has not specifically acted on this report. Trails and Pathwr October 24, 1978 Page 2 I think that the basic issue the City Council must come to grips with is whether or not the City wants to get into the trails and pathways business. Once this is done I think it will not be too difficult to establish an orderly process for getting on with the direction of implementation, if in fact that is what the City wants to do. Therefore, I believe that if we are not to continue to spin our wheels concerning this subject, that the Council needs to make a basic decision relevant to the issue of funding and long term maintenance. REPORT TO MAYOR AND CITY COUNCIL DATE: 7/20/78 COUNCIL MEETING: Z /,$ SUBJECT: Demonstration Trail Recommendation The Parks and Recreation Commission has completed review of potential areas for a demonstration trail and the attached report prepared by Commissioner John Terry explains the procedure which was used in the determination. The Commission discussed each potential area in relation to information prepared by the subcommittee and established the following priority for consideration of actual development of a demonstration trail: That the Fruitvale Avenue to Sobey Road to Quito Road be used as the demonstration trail, that the issues and easements concerning the Fruitvale to Saratoga -Los Gatos Road trail and the Saratoga - Los Gatos Road to Montalvo trail be determined. The Commission felt that the recommended consideration for the Mt. Eden Road trail and.for the Saratoga Avenue to Cox and Congress Springs trail be considered in the priorities that the previous mentioned 3 areas should have first consideration. It is recommended that consideration be given for a Study Session regarding this issue with the City Council and the Parks and Recreation Commission. Following the input from City Council the Parks and Recreation Commission will begin plans for a development program for the area which is selected. This plan would then be returned to City Council for final approval prior to any actual development taking place. It is felt that any public hearings should be scheduled once a specific area has been selected and after the Parks and Recreation Commission has been able to prepare the preliminary plan for development. You will find attached to this memo the history of the demonstration path- way as prep ed by John Terry, Parks and Recreation Commissioner and the . .criteria ets d construction sheets for the proposed routes. Barbara Sampson Director of Community Services i June, 1978 HISTORY OF THE DEMONSTRATION PATHWAY At the May 1, 1978 meeting of the Parks and Recreation Commission a sub- committee was appointed to select and return to the Commission a number of "typical" path routes from which the Commission could select a demon- stration pathway development. The subcommittee reviewed the Trails and Pathways Task Force Report and rejected a number of routes, like Parker Ranch, because they involved major sections of yet to be developed parcels. A Criteria Sheet was developed that contained the major elements of "typical pathways ". After a field trip, 5 routes were selected that scored high on the Criteria Sheet. A Detail Construction Sheet was completed on each section outlining the construction elements required. These 5 routes were presented to the Parks and Recreation Commission on May 15, 1978. No action was taken at this time. Further discussion was held at the June 5, 1978 meeting of the Commission and a specific demonstration route was selected and approved. This proposal is being forwarded to the City Council for comment and suggestions. The Parks and Recreation Commission plans,.after receiving comments and suggestions from Council, to develop costs for the route by: 1) Completing a more detailed construction plan for the route. 2) Meeting with community groups that have indicated interest in participating with construction and obtaining commitments on individual elements of the construction plan. 3) Submit the remaining elements of the construction plan to staff for pricing and the plan to the Planning Commission for comments. 4) Review of the plan and schedule by the Parks and Recreation Commission. The plan will then be submitted to the City Council for tentative approval prior to public hearings. The 5 routes considered were: 1) Montalvo to Saratoga -Los Gatos Road via Wildcat Road, Piedmont, Mendelsohn. 2) Saratoga -Los Gatos Road to Fruitvale Avenue via Carnelian Glen, Douglas. 3) Fruitvale Avenue to Quito Road via San Marcos Road, Chester Avenue, Ten Acres, Sobey Road. 4) Saratoga Avenue to Cox Avenue via transportation corridor, Congress Springs park site. 5) Mt. Eden Road. The Criteria Sheets and Construction Sheets are attached for these routes. During the Parks and Recreation Commission deliberation of route selection, the following concepts played an important part of selection and rejection. Section 1: The 2 easements required (Wildcat Road, corner of Piedmont and Mendelsohn) and negotiations with Montalvo for corridor access to the County trails would appear to jeopardize rapid develop- ment. With the exception of Wildcat Road the path is in limited use and does not appear to be in jeopardy. This section does include "typical" backyard sections and creek crossings. Nego- tiations for the easements should start soon. Use would increase rapidly as this would provide a non - vehicle access to Montalvo and the only access to the County trail system on this side of the City. Section 2: Is in the greatest jeopardy and has the largest number of front lawns and landscaped shrubs over path easements. It does require approximately 100 foot easement over a small creek that appears to be difficult to obtain. This section has a significant back- yard section along the side of the creek. It would require several thousand feet of Type II path (Neary.Fines). Section 3: This section has had the longest history of indicated community support. The only right -of -way requirements are an agreement with Oddfellows for San Marcos Road and a small clearance at Quito and Sobey Roads. It appears to be easily obtainable. There are only 3 established landscaped front lawns. It generates the largest mileage for the least money. This section has the highest present usage. Sobey Meadows Court: During the discussion of the need to include this link in Section 3, the following points were made: This is the only loop in any of the 5 Sections. This link has the only stream crossing in Section 3. This link has the only backyard path in Section 3. How can you have a "typical" path without a loop, stream crossing, or backyard section? This link is an emotional issue - let's not jeopardize getting some paths developed by including this section. How can we convey the fact.that it is vitally needed if we don't include it in Section 3. Since we still have the easement, later development,is a possibility. Section 4: This section involves obtaining easements for the entire length from Pacific Gas and Electric, Southern Pacific, Congress Springs School, Santa Clara Valley Water District, and the State of California. The time required to obtain these easements would preclude rapid development. The route is in limited use today and does not appear to be in jeopardy. A 65 foot span bridge is required at Saratoga Creek and this might be costly. A significant increased use is expected when Congress Springs Park is completed and this appears to be the time to develop this section, but easement negotiations should start sooner. Section 5: This section is short but is associated with 2 nearby developing parcels that would provide improved linkage and use. It is in limited use now and does not appear to be in immediate jeopardy. The route should be charted to the southwest side of the road which is the opposite side from shown in the Trails and Pathways Task Force Report. This section is an excellent candidate for path development after the nearby land development is committed. The item was referred to the Commission by the City Council to ascertain whether the proposed abandonment is consistent with the General Plan. The Commission unanimously voted to maintain the trail and found that abandonment would be inconsistent with the Circulation Element of the General. Plan. They also discussed the entire trail system within Saratoga, and felt that abandon- ment of this particular easement would be establishing a precedent for all individuals that backed up to any sort of trails and pathway easement. The ease- ment has been designated as a segment of a trail within the 'faster Trails and Pathways Plan of the Circulation Elanent of the General Plan. According to the Government Code, Section 50435, the abandonment of a trail or pathway which is included in an adopted master plan must be preceded by 'n Planning Cornission review and reconnnendation to the City Cot cil. Planning Commission action is advisory only and a public hearing is not required. The City Council 111s completed its public hearing-on the matter, and during the course of its D4ay 3rd meeting, after almost three hours of public testimony, referred the issue to the Planning Canmission. The City appreciates the work done by the PPC Trails and Pathways Subcommittee, and we'do have several comments regarding the plan. The proposed plan was compared to Saratoga's Plan which was completed in August, 1976, and there are some differences which must be clarified. In order for the Commission and City Council to be able to relate to the specific areas, sections were referenced A -1, B -2, etc. I will refer to sections in this manner and I have enclosed a map with references marked. A. Inside Saratoga City Limits - Recommended Changes in County Plan 1. Saratoga recommends the County Plan be amended to show the extension of trail from the south end of Painless Parker Ranch to Mt. Eden Road, with the primary route and 1 alternate route to be shown. The City's Plan shows a trail from Parker down through Garrod and Cocciardi to Mt. Eden Road. The alternate is recommended to go through the Cocciardi property to Mt. Eden Road. 2. Saratoga recommends that the County Plan be amended by deleting that portion of trail from the corner of Big Basin Way and Saratoga - Sunnyvale Road through Verde Vista and Sarahills to Pierce Road. This area is approximately 90% developed and trail easements would be very difficult to obtain. This was in Saratoga's early plan but has been dropped. 3. Saratoga recommends that the County Plan be amended to show the portion of trail on Saratoga -Los Gatos Road between Big Basin Way and Carnelian Glen be restricted to pedestrian only because only hard surface is available- 6. The Saratoga Creek trail from Congress Springs Park to the .City limits at Prospect, as recommended in the County Plan is very questionable. The City recommends deletion of this portion due to the high level of development and the improbability of a trail in the creek. There are 2 additional areas within the City limits where the plans differ and Saratoga will have to add to their current plan in order to have the plans conform. Further review of these areas will be necessary before a commitment can be made. The areas are: `f Trails & Pathways Subcommittee April 25, 1978 Page 2 4. The pedestrian and equestrian trail on Saratoga -Los Gatos Road from Carnelian Glen to the City limits (near Quito).which the current Saratoga Plan does not provide. 5. The portion of trail which follows the transportation corridor from Saratoga Avenue to the City limits at Prospect. That this portion of trail be pedestrian only until such time as the entire length is developed, then it can become pedestrian and equestrian. B. Saratoga Sphere of Influence - Recommended Changes in County Plan 8. Saratoga recommends that the County delete the upper cross portion of the Winery trail which is on Mt. Eden Road and add the City's access from the Winery trail to Mt. Eden Road across the PG &E access road. The portion of trail on Mt. Eden Road which goes from Garrod's past Cocciardi and to Pierce Road should be retained. Although a majority of this trail is in Cupertino's sphere of influence, it is a major link for Saratoga's trails to reach Stevens Creek Park. 9. Saratoga has no objection to the Lyndon trail which goes down the San Andreas Fault from Lexington to Sanborn Park and into Saratoga. This was not included in Saratoga's Plan because of the inability to walk the area due to San Jose Water Works personnel. 10. Saratoga requests the County to add the Sanborn trail from the north- east corner of lower Sanborn Park on the PG &E maintenance road to the corner of Sanborn and 'Congress Springs Roads. Saratoga will have to further review the possibility of amending their Plan to add the area designated B -7, a portion of the Lyndon trail. I realize there are some major differences between the City Plan and the one proposed by the PPC Subcommittee but it is requested that the PPC Plan be amended to conform to Saratoga's, specifically inside the City limits. Following the review of these initial comments, it would be appreciated if you would contact the City if you have further questions. If necessary, members of the staff or the Parks.and Recreation Commission could meet with the Subcommittee to provide further information. September 15 The City Council at its meeting-on this date, accepted the Trails and Pathways Task Force Report and scheduled a Committee of the Whole Meeting with the Parks and Recreation Commission and the Trails and Pathways Task Force to re- view the report in depth. September 21 A City Council Committee of the Whole Meeting. was held with the Trails and Pathways Task Force and the Parks and Recreation Commission to dis- cuss the complete report. The City Manager was asked to report to the City Council at its meeting on October 6th a procedure for further consideration of the Task Force Report and the necessary amendment to the Trails and Pathways circulation element of the General Plan. October 6 The City Council considered a report by the City Manager, outlining the specific actions to be taken for implementation of the Task Force Report an& the amendment to the General Plan. October 6 The report adopted by the Council (Exhibit A) (Cont'd.) outlines basically two steps which should be implemented. The first pertains to a General Plan amendment, which was a generalized de- scription of the modifications to be made on the Trails and Pathways element of the plan. The second step pertains to the specific plan or an action plan adoption. It was further recommended that this portion would be the primary responsibility of the Parks and Recreation Commission, working with the Trails and Pathways Task Force. It was envisioned at that time that once the General Plan amendment had been approved, the Parks and Recreation Commission would then move forth to take steps to implement.specific elements of the plan. This report was approved by the City Council at this meeting. The matter was then referred to the Planning Commission for consideration of the necessary General Plan amendments. 1977 March 16 The Planning Commission held a Committee of the Whole Meeting to discuss the proposed amend- ments to the circulation element of the General Plan, based on the recommendations included in the Trails and Pathways Task Force Report, but in a more general nature. April 27 The Planning Commission held a public hearing concerning the amendment to the trails and pathways element of the circulation plan. There being no public comment at that meeting, the Planning Commission closed.the public hearing and approved the recommendation. The proposed amendment was then forwarded to the City Council for consideration. May 18 The City Council considered the referral from the Planning Commission concerning the amend- ment to the General Plan, and scheduled a public hearing for June 15th. June 15 The City Council heard an introduction of this subject and some testimony, as indicated in the attached minutes (Exhibit C), and continued the public hearing to July 6th, with a Committee of the Whole Meeting on June 21st. 2 - June 21 The Council discussed the difference between the circulation element requirement and the specific recommendations in the Trails and Pathways Task Force Report at this meeting. July 6 The City Council continued the public hearing on the amendment to the Trails and Pathways portion of the circulation element of the General Plan. It was at this meeting that Terrill Barco commented concerning his feeling about the need for public hearings on the Task Force Report itself. He indicated: "I therefore strongly urge you to postpone the public hearing on the Trails Task Force Report, or any portions thereof." Therefore, it is clear that it was his under- standing that the hearings were more on the Trails Task Force Report than on the amend- ment to the circulation element of the General Plan, of which the Trails Task Force Report provided some very basic data. I made it clear at that meeting what the purpose of the General Plan amendment was, and that there was a need for the Council to define some direction and to provide the overall umbrella framework in the General Plan for specific trails and pathways. Once the Council adopted such policy, it would provide some direction for the specific types of trails and where these trails might generally go. It was further pointed out that if the City starts to implement the General Plan, then they would start working with the specifics, using the Trails and Pathways Task Force Report as a basis for any specific action. As pointed out, Councilman Matteoni inquired as to the timing involved with regard to the hearings on the officially adopted specific plan. I replied that based on the discussion when the report was presented to the Council by the Task Force, this would commence with the Parks and Recreation Commission once the Council would take action concerning the circulation element. After hearing further public testimony, the public hearing was closed and Resolution 820.1 (Exhibit E) was approved by the Council. - 3 - July 6 After Council action on the circulation (Cont'd.) element, they then took action concerning the August 1974 letter from a number of property owners in the Sobey Meadows Court area re- questing that the trail and pathway easement be abandoned. The Council had delayed action on this request until after the Task Force Report had been completed and the amendment to the circulation plan approved. This request was formally transmitted to the Parks and Recreation Commission for specific review and recommendation back to the City Council. This was the first specific follow up to the Trails and Pathways Task Force Report. I believe the City has followed up in good faith with -the dis- cussions and directions set by the City Council a couple of years ago. The thing that has delayed progress is the time and effort spent on this one specific request for abandonment. It is contem- plated that this will be the case in many other problem areas, and it is recommended that the next step for the Parks and Recreation Commission will be to review other priority areas and take steps to consider those specific elements, as pointed out in the Trails and Pathways Task Force Report: I do not think it is worth the time and effort to have a public hearing on the whole plan, inasmuch as the potential problem areas.are already known, and there should be a schedule developed by the Parks and Recreation Commission for resolving those issues. Three major issues of the Report strike me at the present time: (1) Amendment the 1974 General Plan, specifically the Trails & Pathways portions of the Circulation Element, (2) a Specific Plan Element needs to be adopted in order to act as an "Action Plan" for implementation of the detail Trails & Pathways recom- mendations, and (3) assessment of the environmental impacts in implementa- tion of this Specific Plan. It is suggested that the Study be forwarded in' two major phases: (a) adoption of General Plan Element, and (b) adoption of Specific Action Plan. Action on (a) should not prove to be a major problem in time for processing and adoption. Adopting a Specific Plan for implementation (b) will necessitate considerable review and substantial effort (see below), as well as anticipated public response to specific pathway and related land use activity details. It is my recommendation that the following procedure be used in enact- ment of the Trails & Pathways Report: , . A. General Plan Amendment 1. The 1974 General Plan Trails F, Pathways Element should be amended to reflect the broad recommendations of the suggested Report re- visions. Attached is a copy of the existing Element, and it is suggested that the basic Objectives, Policies and Action Programs be amended accordingly. It is also suggested that a generalized map description of the proposed overall trail routes be included in these amendments. This could take on the same context of sche- matic diagrams referenced on each trail area in the Task Force Study as shown on pages 39, 64, 88 and the Sphere of Influence page 106, superimposed on an existing General Plan Map. This information, �s RE: Trails and Path-,­�tys General Plan Aj dr •t including any other revisions or information up- dating the 1974 Element as it exists, should prove sufficient in processing an appropriate amendment to this portion of the General Plan Circu- lation Element. It is suggested that this material be drafted and submitted for public hearing as a General Plan Amendment for Planning Commission review and subsequent transmittal for Council hearing and resolu- tion adoption. It would also be recommended that such a draft be heard in joint public session with the Parks $ Recreation_ Commis- sion. A special General Plan Amendment hearing can be scheduled to accomplish this. The assistance of the Trails Task Force in this subject would be advised and necessary; therefore, I suggest the Council request the Task Force's continued involvement throughout the process. B. Specific Plan (Action Plan) Adoption 1. Review of the environmental impacts of the specific elements in implementing the Amendment will be required. It is suggested that the detailed elements of the proposed Study be reviewed as a Specific or Action Plan for Trails $ Pathways. boy analysis of the Trails & Pathways Report indicates that specific trail desig- nations, policies and land use impacts demonstrate a significant environmental effect as defined by the California Environmental Quality Act'. Review of this "Specific Plan" as discussed in #3 below should then be accomplished in company with an Environmental Impact Report. Funding for such a study has not been budgeted nor programmed for FY 76 -77. 2. A Specific Plan should be adopted to substantiate the implementa- tion recommendations of the Trails & Pathways Report.' Specific plans can take on the detail recommendations on site specific re- quirements as suggested in the Trails & Pathways Report. However, the adoption of this Plan should be made in the same manner as a General Plan. It is recommended that review of this specific plan and any associated environmental impacts begin at the Parks & Recreation Commission level. Working with the Trails $ Pathways Task Force, the Parks $ Recreation Commission should be able to carry out the major public hearings and review of this specific plan. Plan Circulation Element has established among its object- ives: 1) the preparation of a trails and pathways plan to supersede the old 1971 plan, and 2) the development of a vehicular circulation plan for the undeveloped area of the City. The California Government Code, Section 65400, requires that the Planning Commission investigate and report on the objectives setforth in the general plan relative to implementation of said plan. There- for, and in compliance with the above the following reports, as pertains to objectives 1 and 2 above, are presented: A) The Northwest Saratoga Circulation Master Plan - Exhibit "A" represents an initial study prepared by the Planning Department for the Northwest Saratoga Circulation Master Plan.- The plan itself was derived from a study prepared by De Leuw, Cather and Company in which numerous circulation alternatives were developed and the impacts there from analyzed. The City, with preferential recommendations by De Leuw, Cather and Company, selected the Surrey- extended -to- Prospect Plan. It is this specific plan which has come to be known as the Northwest Circulation Master Plan. Selection of the Surrey plan was based on findings that the over- all cumulative impacts of that plan were least disruptive of both the physical and cultural environment, yet provided for a compre- hensive and efficient circulation system. The ciruclation plan contains three (3) basic elements: 1) the Surrey extension to Prospect, which will serve as the major collector street system, 2) the Comer Drive temporary service extension which shall be abandoned upon completion of the southern portion of the Surrey system, and 3) The emergency access connection between the Old Oak Way extension and the Surrey to. Old Oak Way extension. It should be noted that the circulation plan is only conceptual and will be subject to to site specific review upon submittal of land development projects by the private sector. Tile circulation plan as adopted serves only to guide and assure development of an efficient and comprehensive circulation system. B) Trails and Pathways Master Plan - Exhibit. "B" represnets the new trails and pathways plan which as per the 1974 General Plan is to supersede the old trails and pathways plan. The purpose of the new plan is to provide fora more comprehensive and realistic trails pathways and bike route system as setforth in the Trails and Pathways Task Force Report dated August 1976. T'he new plan was developed using three (3) categories of trail types: 1) Single arterial routes with connection to trails systems outside of the City limits, 2) Collector and feeder trails servicing the arterial routes, and 3) Loop or circulation trails within the Equestrian 'Zones. Each of the above three (3) trail types is represented on Exhibit "B ". Adoption of the new plan is necessary to assure proper implementation of the system. CONSIDERATION OF AMENDMENT OF 1974 GENERAL PLAN'CIRCULATION ELEMENT June 15, 1977 - THROUGH ADOPTION OF: Master Trails and Pathways Plan Northwest Saratoga Circulation Plan Mr. Van Duyn, Planning Director, summarized the elements of this proposed amendment. Ile indicated that the Trails and Pathways Plan is in compliance with the requirements of the Planning Commission. Mr, Burt of the Planning Staff explained that this is a comprehensive park plan required to be developed as a result of the 1974 Circu- lation Element. Further, the previous trails and pathways element was really not comprehensive, and the City required dedication of easements. This map looks at the entire system as a complete system to be used by bicycles, equestrians and pedestrians. The plan was adopted by the Planning Commission on April 21, 1977, and would allow the Planning Commission and Land Development Committee to require dedication of easements for trail purposes. He further pointed out that the old plan did not link up with the County trails system, and the proposed plan would. Mr. Van Duyn explained that once this particular element is adopted by the City Council in concept; it would be referred to the Parks and Recreation Commission, and then more detailed elements would be considered. He advised that the recommended Council action this evening includes: 1) Approval of the environmental determination; and 2) approval to amend the General Plan to include the two pro-: posed plans. The Mayor opened the public hearing at 8:09 P.M. - 3 - Mr. Van Duyn indicated that the report itself is very specific with regard to the use of the trails system -- some of the trails are suggested for equestrian use only; some are indicated for pedes- trian use only, and some are indicated for a combination of uses. However,' the trails are not intended to be used for activities involving motorized vehicles. Mayor Bridges commented that one of the things the Trails and Path- ways Task Force did was co propose a specific design for each kind of trail. With regard to motorbikes, he indicated he could not say the City would be completely successful in keeping them off the trails, but there are things the City could do to minimize their use. Patricia Knapp of Wardell Road stated that she would like to endorse this plan as a general conceptual idea of the pathways. Further, she would like to recommend that the City Council adopt it,.and in so doing, follow up as soon as possible with the implementation. It was moved by Councilman Kraus and seconded by Councilwoman Corr to continue this portion of the public hearing with regard to the Master Trails and Pathways Plan to July 6th, and to further consider the report at the Committee of the Whole Meeting Tuesday evening, June 21st. The motion was carried unanimously. The City Manager then asked Mr. Van Duyn to summarize the proposal for the Northwest Saratoga Circulation Plan. Mr. Van Duyn reported that the City, in response to the.' 1974 °'Gen 1 Plan, contracted for the Northwest Saratoga Circulation. He further indicated that the ,.City Council received several petitions from residents protesting this plan. He e_xpresse.d his opinion that there 5- I Victorian Village that the Council would be willing to remove the parking limitation for 25 spaces along the creek on Fourth Street, as well as 6 spaces at the rear of the lot at Plaza del Robles (near the trash bins), if they agree to bear the cost for'this re- signing. Councilman Kraus asked that the merchants be further informed that the City Council in taking this action, do so with the understanding that this parking arrangement will not be re- considered, if the matter comes back before them in a year. Resolution No. 820, Amending the Circulation Element of the General Plan by Adding Thereto a Northwest Circulation Plan and Master Trails and Pathways Plan The Mayor indicated there was one item of correspondence from Robert B. Chleboun, 14155 Sobey Meadows Court, opposing adoption of Master Trails and Pathways Plan. He then opened the public hearing on the Master Trails and Pathways Plan at 8:29 P.M. Terrill Barco of Camino Barco addressed the Council, and read his letter into the record: "It has been over three years since the Trails Task Force Committee was created, a little over one - and -a -half years since the Committee's report.was written, and one year since it was submitted to the Council. In my minority report, I recommended to the Council, among other things, that a public hearing be held by the Council on the report. At the time of submission, I also recommended verbally that all homeowners groups and associations in the city be notified well in ad- vance, and be given an opportunity to study the report before the hearing. There are numerous other groups and individuals who in the past three years submitted letters and petitions to the city regarding trails.. They received letters in reply - 3 - Master Trails and Pathways Plan (Cont'd.) stating in essence that the matter was under study, and they would be informed. This has not been done. The letter of the law has been met by publication of a public notice in the newspaper, but I am sure all of you will agree that the spirit has not. That definitely calls for a letter to these people informing them the report is finished and is available to them well prior to the public hearing. A sincere desire to see that the public is fully informed calls also for similar letters to the homeowners groups and associations. I therefore strongly urge you to postpone the public hearing on the Trails Task Force Report or any portions thereof, direct the city staff to send out the necessary letters, and then hold a hearing on the entire report." Colonel Barco then commented that at the time of his verbal presentation to the City Council, he had pointed out that there were several crucial areas in the plan itself -- particularly to the map. He further connented that he had agreed with the solution submitted by the Committee; however, he indicated there are still people who are concerned about these critical areas, and there are people who don't know . about this public hearing, and he believes what he has suggested will give those people a fair shake. He added that he, as well as the other members of the Committee, would be glad to help brief the homeowners ahead of time so they don't have to come to the hearing and ask a lot of questio- R. E. Kauffman, 20700 Fourth Street, addressed the Council. He indicated that he is a member of the Trails and Paths Task Force and pointed out that at the initial hearing, as well as at the Committee of the Whole Meeting, he had concurred in this general circulation plan. He indicated, however, that his concern is this: As of today, he had been over two pieces of property which appear on the detailed maps included in the report, and it turns out that the Committee when they were led over the pathways were misinformed as to where the property lines and easements were, and on two particular properties, it is not possible to nut the paths where the map shows. Mr. Kauffman stated that he is only concerned at this point that we provide a means for correcting a detail after adopting the general circulation plan. The City ?tanager commented that he believes this is the same section Mr. Chleboun talks about in his letter -- section I -d of the specific report. Gary Hart, 14187 Sobey Meadows, commented that on the map he is at the northwest intersection of Sobey Road and Sobey Meadows. He indicated that they petitioned in August, 1974 to have the easement removed, and in a letter from Mr. Beyer dated September, 1974, it is stated: "We will notify you when the matter is scheduled." Mr. Hart stated that he would like to reinforce Colonel Barco's statement in that they depended on being notified other than a very small note in the paper. Mr. }cart advised that the easement which exists on his property is approximately 35 degrees in steepness, and further, there i-, a very beautiful Oak tree that is going to have to go, if the Council takes a path through the easement as it exists. Also, there is anothCr large Oak that is going to have to be buthcred, and it is all to satisfy a loop segment, rather than an arterial .segment for the trails. Master Trails and Pathways Plan (Cont'd.) Councilman Matteoni commented that his understanding is we are looking at a genera?. circulation plan for trails and pathways that is not intended to speak to property lines, and the Council has yet to address the specific plan which would nail dorm which boundary of an individual's property these trails might go. Mr. Hart responded to this, advising that if you don't take the easement as it exists on his property to get down below_ and connect with Chester, you cannot get there -- there are no other easements existing on adjacent properties, and the creek interferes with getting anywhere rear Chester. The City Manager indicated that he is sure there are other sections where the City would be likely to find other elements of the specifics of the work done by the Trails and Pathways Task Force which today might not be relevant because of some type of development. Further, the intent here is to first clean up the Trails and Pathways circulation element that was adopted back in 1972, and have the Council.adopt a policy which would provide for some direction relevant to: 1) the types of trails; and 2) where those might generally go. Then if the City starts to implement that plan, establish the specifics, using the Trails and Pathways Task Force Report as the basis for any specific action that the City might take, either as the report recommends, or modifications due to changes in land use since the report came out in August, 1976.and the time that specific section was implemented. In adopting this plan conceptually, we also know those areas where easements have been acquired in the past, and perhaps abandon those back to the property owners because they do not fit into the general context of the plan that might be approved by the Council. Councilman Matteoni inquired what the timing would be with regard to the hearings on the officially adopted specific plan. The City Manager replied that.based on•the discussion when the report was presented to the Council by the Task Force, this would commence with the Parks and Recreation Commission once the Council had taken action on this portion of the circulation element. Don Norling, 21000 Comer Drive, addressed the Council. He indicated that he owns property where there is a path proposed, and he shares Colonel Barco's concern about the fact that people in general in Saratoga are not aware of where the plans are proposed, and are not being given an opportunity to express their concerns. He indicated that they found out by accident that their property was proposed for a pathway, and their lot is shown specifically by the lot number and a picture in the report, with a statement that a path now exists. Mr. Norling indicated that he went of the Parks and Recreation Department and expressed concern over this, and the statement was: "It is being used in trespass; however, you know we feel that is a good place for a path to go." Ile had then circulated a petition and submitted it to the Parks and Recreation Department opposing a path across this property. lie pointed out.there is no ease- ment here, but rather, it is their nersonal property. He indicated that he would encourage all people in Saratoga to read this report carefully and find out where these paths are proposed. It was his reeling that by the City putting out this report, it encouraged trespassing. - 5 - Master Trails and Pathways Plan (Cont'd.) Mayor. Bridges pointed out that the detailed report has been available for a year - and -a -half, and has been to hearings be- fore the Planning Commission. It is not something that has just come up tonight. Mr. Norling commented that he is not saying this; rather, most people who live in Saratoga probably think it is something re- mote to them. He commented that the basic problem is that the paths are being proposed through developed areas. He further commented that he notes, possibly by coincidence, that none of the pathways cross into the properties of those serving on the Task Force Committee. Mayor Bridges explained that there is a circulation element in the General Plan which speaks to trails and pathways, and presently, it is considerably more extensive than the proposed plan. He indicated that some of these easements are obviously no longer going to be a part of the plan, and what the City is attempting to do now is correct the General Plan through adoption of the new pathways circulation element so there is a basis for conditioning properties as they come in, and to serve as a guide for the Planning Commission. He pointed out that before anything is built, there would have to be hearings before the Parks and Recreation Commission first, and those would ultimately have to come before the Council for funding, through the adoption of a specific plan. -Colonel Barco again addressed the Council, indicated that he would like to set the record straight on a couple.of items: 1) The report has been inexistence for.one year and one month. 2) There hasn't been one public announcement of the existence of that report until the announcement came out in the paper a couple of weeks ago. 3) lie personally has called the City Offices four or five times in the last year as a member of the committee, and asked what is the status. The answer he always received was: "Well, we're working on it -- it's somewhere in the Planning Commission -- don't worry about it, you will be informed." As late as yesterday, he called a member of the Parks Commission and asked what was the status. The answer he received was: "I don't know." He asked how the public was supposed to know about this, if he, a member of the committee, could not find out about it. Councilman Matteoni commented that what he believes needs to be said about the Trails and Pathways Task Force Report is that it has no legal status at this time - - -.it is a committee proposal to the City Council which has been put in process, and it has provided some assistance to the Council in attempting to clean up the General Plan designation for former trails and pathways that have run into physical problems or have no status, and this is what the Council is about tonight. In terms of getting that moving in order to deal with specifics, the Council can go forward and adopt what has been presented, in terms of a General Plan. Also, it was his feeling there should be a mechanism provided to deal with a specific hardship situation. if in fact reality 6 - Master. Trails and Pathways Plan (Cont'd.) does not allow it to be implemented, so that the individual will not be harmed in improving his property. He indicated he would like to see this expedited so that this owner would not have to wait, if the trail is not tied into the specific plan. Ile indicated he would have no pr.eblem in adopting a resolution adopting this amendment to the General Plan. Councilman Kraus indicated that he would have difficulty with this, in that every general plan the City has been through, there has been allowance for a great deal of public input. He would, therefore, go along with the Trails and Pathways Committee recommendation and allow them to participate in notifying the homeowners of this situation, prior to going ahead with the General Plan. Councilman Brigham commented that at this point, he is in favor of adoption of the plan, simply to clarify the situation of-what he have in the.General Plan now. He felt that there are some areas on the previous plan that now can be abandoned. He felt that if we have the general overall plan, this would expedite getting to Section D -1 and others, where we can have the people notified, and then settle where the boundaries and the trails are going to be. It was his feeling if this was not accomplished, we are going to just be spinning our wheels. Mr Kauffman again addressed the Council, and commented that he would strongly urge that the Council consider adopting the resolution to amend the General Plan circulation portion now for two reasons: 1) The existing plan is riduculous in terms of real life; therefore, the commissions and staff have nothing to work with. 2) Until the revised plan is passed, there is nothing more that can be done. Ile commented that this is simply an arterial plan and a conceptual plan, and commits nobody to anything. The easements on record do not change -- easements not on record can only be had by mutual consent or by eminent domain proceedings, and none of this has anything to do with the adoption of this general plan. Therefore, he would urge that the Council proceed this evening in adopting this resolution. Arnold Pirnie, 20976 Comer Drive, addressed the Council. He stated that the Council calls this a general plan, and no specifics have really been published yet. However, he has seen pictures showing his house and property within an existing in- formal trail that is available for immediate use, and what this has done is brought people and horseback riders down and across this property because they have seen these pictures and this report. Therefore, he felt this plan was quite specific on some property lines. He indicated that he is concerned about . the situation because it is a ridge line that the trail runs down -- the picture shows the trail going.right through the middle between his and the Norling's property -- there is no easement. Further, he has landscaping and sprinklers, and he is afraid because of the steepness, these riders are going to slip and end up in their pool, which is immediately below the hill. lie would then hold the City responsible for this because it is published in their report. Mr. Van Duyn, Planning Director, advised that if this trail is within Mr. Piruie's private property, there is no reason he cannot put up a fence. - 7 - Master Trails and Pathways Plan (Cont'd.) lie pointed out, however, that this may be a deed restriction for this tract. Mr. Pi.enie suggested that the City do something immediately to relieve the homeowners that are having the problem right now. The City Manager commented'that he would'suggest that these homeowners take the following action: 1) Bring the matter to the Parks and Recreation Commission or the Council to get it looked at as a specific section; or 2) Since this is private property, the property owner can control this by fencing. If there is tres- passing, they should call the Sheriff's Department and ask for some enforcement. It was then moved by Councilman Matteoni and seconded by Councilman Brigham the public hearing in relation to the Master Trails and Pathways Plan be closed. The motion was carried; the public hearing was closed at 9:15 P.M. Dear Chairperson and Members of the City Council: The undersigned homeowners, who reside on Sobey Meadows Court in Saratoga, together with John N. Pope, Jr., our attorney, and his wife Patricia, who reside at 14070 Arcadia Palms Drive, Saratoga, hereby support the abandonment by the City of the 1972 offer to dedicate subject trail, and alternatively oppose any acceptance of dedication and subsequent action thereon; for the following reasons: �— 1. The cost of improving, maintaining and policing this 900 -foot section will be prohibitive to both the City of Saratoga and its taxpayers. Development costs originally estimated by the staff in the sum of $89,000 have been reduced to the sum of $30,000.00 by deleting fencing neces- sary to the security of adjacent homeowners, a retaining wall, and reliance upon volunteer labor. Barbara Sampson, Director of Community Services, informed the City Manager by letter of February 23; 1978 that an allocation of $3,000.00 to $4,500.00 of staff time would have to be made, with a rearrangement of established priorities. 2. Robert F. Beyer, City Manager, determined in his report to the Mayor. and City Council, dated February 24, 1978 that a reduction in the Commission's reduced estimate in the sum of $29,500.00 could only be realized by the con- tribution of labor and materials to a low cost to the City of not less than $15,000.00, includ- ing allocation of staff time. The promised donation of labor and materials is not binding, and reliance cannot be placed thereon. City of Saratoga 13777 Fruitvale Avenue Saratoga, CA 95070 Page two Re: Abandonment of Sobey Meadows Court Easement The undersigned therefore accept and concur in the recommendations made by Barbara Sampson, including annual maintenance costs of $5,200.00, and the necessity for condemnation of adjacent landowners' property required to implement an easement. None of the estimated costs include security for the protection of both trail users and homeowners. There are other reasonable alternatives available to the City at a far lower cost. The developer of the Parker Ranch has apparently expressed its intentions to construct an equestrienne trail, properly fenced, at no cost to the City. Moreover, an alternate connection between Sobey and Chester already exists on Ten Acres.Road, without the exorbitant costs entailed in the above mentioned project. 4. Lack of security and privacy to homeowners: The proposed trail passes within five feet of the Brennan barn, 27 feet of the Hart pool, and 35 feet from the Smith pool. It is clear that the close proximity of the trail to the homeowners and others will produce unpleasant odors and flies, reducing the enjoyment which the undersigned citizens of Saratoga and their neighbors have a reasonable right to expect. Development of the trail will increase the danger to school children in the area, as evidenced by Principal Robert Turk's letter on file stating that there have been incidents of child molestation, in- decent exposure and one rape on an open pathway, and that students are discouraged from using such secluded areas. The absence.of a security patrol for the protection of all concerned, and of.regular main- tenance and pick -up of manure would threaten and en- danger the safety and health of the residents in this area, in addition to an unwarranted invasion of pri- vacy. If City of Saratoga Page three Re: Abandonment of Sobey Meadows Court Easement While there are many more grounds available to express our grievances with the proposed trail dedication, and in support of our petition to abandon the easement and return same to the property owners, it is felt in conclusion that the substantial and ongoing costs are wholly unwarranted as a burden to be im- posed upon the City for the marginal benefit to be obtained, particularly since there are viable alternatives at minimal or no cost to the City which would have no adverse environmental impact effect upon those in proximity thereto. It is therefore respectfully requested that the City abandon the easement and take such appropriate action as is necessary to have said offer of dedication removed from the County records. The City has much more important business to conduct, in our opinion, and little will be accomplished by further extensive and time consuming deliberations which could inevitably result in not only the above cited dangers to the undersigned, but the substantial tax detriment to all of the citizens of Saratoga. The stakes .were located closer to the creek than they should have been, giving the impression that there was insufficient area along the top of bank for the proposed trail.. The error involves the curved portion of the easement involving all of Lot 12 and a portion of Lot #11, with the error being zero at the beginning of the curve and ` increasing in width as the easement moves southerly through Lot #11 until it is 12 ft. wide as it 'reaches the angle point where the 20 ft. easement is running east -west along the southerly line of Lot #12. Attached find the March 14th letter from Bill Heiss describing this error and how it came about. Attached also find a sketch showing the discrepancy. This office has quickly reviewed the affect that this correction would have on the costs of the trail construction previously sub -' mitted to you. There is an elimination of the work relocating the creek at the southerly tract boundary which should reduce the costs to approximately $15,000 (estimate attached). There is the addi- tional-potential savings at the second area where the top of bank and easement line were nearly coincident, as defined in the origi- nal survey. Our field crew set 2 by 2 hubs along the Easterly line of the walkway easement through the Sobey Meadows tract. Within lots 11 and 12 of said tract, the Easterly line of the easement is defined by the Easterly line of an exist- ing sanitary sewer easement (Book 8715 of official records page 643). This sanitary sewer easement was created several years before the subdivision of Sobey Meadows. Prior to our field crew establishing the Easterly boundary line of the trail, it was necessary to do a series of office computations to be utilized by the field crew in order to set the necessary points. The Easterly line of said sanitary sewer easement is a continuous curve. An assumption was made by our computer engineer that this curve was tangent to the continuation of the walkway easement within lot 11. His computations were based upon this assumption. Unfortunately this is not the case. After the problem was found yesterday the sewer deed was reviewed and the true ease- ment line computed. On the enclosed tract map I have illustrated the relationship of the true easement line and the easement line as staked. The actual easement line agrees with our stakes at the point where the sewer easement proceeds Westerly and leaves the Sobey Meadows area. As it proceeds Sourtherly however, the true ease- ment line shifts Easterly. The offset distance between the true easement and the three set points labeled 1, 2 and 3 is 4 feet, 62 feet and 12 feet respectively. It was during a review requested by Mr. Ed Gommersoll of the Parks and Recreation Commission that this incorrect assumption was discovered regarding the tangent position. Mr. Gummersoll had a question regarding an apparent "jog" in the easement that occurred where the sanitary sewer easement proceeded Westerly. I indicated that it was probably caused by an additional stake set by our field crew which is shown on the enclosed drawing as 'extra stake'. The owner of lot 11 requested our field crew to set a stake on the opposite side of the easement so it could be observed what was the limit of the sewer easement. Our field March 14, 1978 page two Sobey Meadows (Our #1885) crew did not want to set this point, however at the pleading of the owner they reluctantly set the extra stake noted. I explained to Mr. Gummersoll.that this extra stake may have been the reason for the apparent jog. I provided him with a copy of the map previously given to the City and he went to the site to review the field conditions. In a second meeting he raised a question whether our crew had staked the Easterly or Westerly line of the easement. Based upon his measurement at the common lot line of lots 11 and 12 he felt that perhaps the Westerly line had been staked. I indicated that I would check to make sure. Prior to running this check I reviewed the matter with our field crew and they verified that they had in fact double checked their work in the field previously, and had staked the Easterly line. In order to make absolutely sure I then asked our Computer Engineer to review his computations and it was at that time we discovered the tangent problem. This situation is very embarrassing for our firm. I recognize the many Public Hearings that have taken place and the great amount of dialogue that has resulted because of this trail.
