HomeMy WebLinkAbout10-15-1980 City Council staff reportREPORT s 0 TO MAYOR AND CITY COUNCIL AT DATE: 10/8/80 COUNCIL MEETING: 10/15/80 SUBJECT' PROPOSED PROGRAM FOR EXPENDITURE OF RINA FANTINO FUNDS SUMMARY: In 1974, the City Council established a fund to accept monies willed to the Community Center by Mrs. Rina Fantino. Her will outlined that these monies were to "benefit the youth of Saratoga." An initial payment from the estate was made in 1974, monthly payments were made over a seven year period, and the final payment of the estate was made in January, 1980. The Rina Fantino Fund currently has a balance of $17,975. When the City Council established the fund to accept these donations, they adopted a policy requesting program approval prior to expenditure of the funds. The staff have developed a proposed program for expenditure of these funds, and a copy is attached. RECOMMENDATION: It is recommended that the City Council approve the goals and objectives of the program and the concept of the individual programs as outlined in the .report. Plans for specific program are to be completed within the next three to four months, and implementation to occur in the spring of 1981. BODY OF REPORT: The goals and objectives outlined in the proposed program indicate a wide variety of activities may be considered by staff for financial support from the Fantino Fund. Some of these programs will be self - support or partially self- support, and some are direct expenditures. All will involve the youth of the community, and be directly related to them. The areas recommended are varied in the areas of recreation, education, social and physical aspects of youth. 0 Rina Fantino Funds October 8, 1980 Page two C Several previous expenditures have been approved from the Fund, including sports leagues, film rentals, and improvements for the Community Center, but an entire program concept has not yet been approved. If this concept is approved, staff will proceed to make specific plans within the guidelines established by the proposed program. Objectives: A. To involve the youth in planning activities for the expenditure of the Fund; to involve families, parents, and school staff in programs. B. To plan activities on a "whole" program basis, i.e., varied programs for recreational, educational, social, intellectual, physical and mental growth. C. To use the Funds over an extended period of years. D. To plan activities that are self- supporting, and /or Fund - supported, minimal in expenditure of dollars as well as in full -time staff time. E. To plan activities that will reimburse the Fund. F. To purchase materials and equipment that are non - expendable for extended years use. G. To purchase materials and equipment that are expendable for special programs on 1 y . H. To maintain building and equipment used by teens in support of programs. I. To develop volunteers and paid part -time staff for activities requiring coordination beyond current staff capabilities. It is the intent of staff to develop programs and policies within three to four months, and initiate programs in the spring of 1981. • RINA FANTINO FUNDS Concepts for Programs A. Youth Volunteer Project Grants The Fantino Fund would become an incentive for youth volunteers to participate in community projects that the youth chose,.. planned, and initiated from start to finish. Criteria would be developed by Community Center staff, i.e., (a) number.of grants per year, (b) maximum grant amount, (c) age limits and group number, (d) time lines for application and completion, (e) accounting of success. Application: Three to six Saratoga youths apply for a $50 grant from the Fantino Fund. Their application would state the project in detail, the group who would benefit from the project,and completion date, the members of the project group, the objective of the project, the estimated cost of the project, and the approval signature of the project adult supervisor. Project Example A: The German Band of Redwood School was eliminated in the current school budget. The project would be to continue the Band on a volunteer basis to prepare for a performance for Redwood School and the community on a given date. The grant monies would defray the cost of sheet music purchase, advertisement, printing and planning of the event. Project Example B: The project volunteers wish to bring the San Jose State Male and Female Foil, Fencing, and Sabre competition team to the Community Center for a demonstration at the noon drop -in for teens. The grant monies would provide the transportation for the team and its equipment to and from the Com- munity Center, and pay for the advertisement flyers to insure an excellent turn out. B. Youth Theatre for Children: The Fantino Fund would become an incentive for youth to participate in theatre productions given for children's audiences while associating with existing adult drama groups of the greater Saratoga area. Example: A theatrical group would be solicited and contracted by the Community Center staff to recruit Saratoga youth residents for participation in a children's production. The theatrical group would be given a grant of $500.00 for produc- tion costs. The production would be "on the road" and be presented at the Community Center and other chosen locations. A minimal fee would be charged at some or all locations to defray the production costs. Revenue would return to the Fantino Fund. Non - expendable purchases would be negotiated in the contract to become City property for future productions or kept by the theatrical group as incentive for production, labor, and involvement. A production director's .salary may or may not be inclused in the total grant monies. -2- • e C. Outdoor Education and Recreation The Fantino Fund would offer an incentive for youth to learn and enjoy the world of outdoor creatures and environment. Examples: (a) Contract with the Mid- Peninsula Regional Open Space District to offer youth the opportunity to have three day hiking /overnight trips from Saratoga metro area to ocean, visit working farms of area, and participate in camping and nature appreciation programs of the District. (b) Contract with local survival programs to offer a mini survival program to interested youth. (c) Contract with Junior Museums to bring live animals to Community Center, and plan youth programs for excursions and volunteer training. D. Youth Awareness of Handicapped Throught the Fantino Fund, the youth of Saratoga would be exposed to "Mainstreaming" and skills of the handicapped. The programs to be initiated would be presented by handicapped youth and could include a wide variety, i.e., archery, weight lifting, wheelchair basketball, etc. "Mainstreaming" has a double meaning here; to get the handicapped into the mainstream.of life of the able - bodied, and to get the able- bodied into the world of the disabled. Handicapped clubs like the Western Wheelers or Golden Spokes, or even the Santa Clara Valley Medical Center Recreation Therpist could coordinated the program presentations to the noon drop -in youth participants. Grant monies would defray transportation costs of handicapped and equipment to and from the Community Center. E. Sports Leagues for Boys and Girls - 7th and 8th grades The Fantino Fund would become an- 'incentive for youth to participate in a sports program if they have no interest in the more highly competitive inter- scholastic school leagues and Recreation Department sports program. Example: Co -ed, father - son - mother - daughter, father - daughter- mother -son, boys girls, volleyball and basketball leagues and lead -up games - leagues, would be organized for the interested youth who do not participate in the school inter- scholastic program. Funds would be spent for officials and minor trophies or awards. The program would operate at the noon and afternoon drop -in time slots, with finals possibly held evenings or Saturdays to encourage parent participation. Double elimination with consolation bracket is recommended. -3- F.• Other Program Suggestions 1) Ham radio club - activities coordinated with Redwood School Club, Civil Defense, and local Adult Amateur Radio Club. 2) Camping - trips planned around youth and family participation via bicycle, rented vans /jeeps /trucks /or private-car; canoe, river raft, horseback, hiking, etc. 3) Bicycle trips - planned and coordinated by existing local adult clubs. 4) Fencing, foil, sabre club and tournaments; hold regular tournaments for local peninsula fencers. A revenue maker! 5) Cultural activities excursions, small groups participation in programs,at Flint Center, San Francisco theatres, San Jose Performing Arts, dress rehearsals for local drama groups. 6) Dry land skiing sessions coordinated with use of West Valley's down hill slope. 7) Exhibitions at noon drop -in: a. San Mateo College gymnastic and tumbling team b. Frisbee, Flippy Flyer, billiards, yoyo, houla hoop, skate champions c. Unicycle, motorcross, skateboard, hot air balloon, juggling society d. Clown clubs, bagpipes, German band, senior citizen bands 8) Award and recognition dessert party - to recognize the accomplishment of youth at the end of the school year. 9) Sponsoring youth to run in jogging races held throughout the Bay Area: Bridge to bridge in San Francisco, Pier to Pier in Santa Cruz, Bay to breakers in San. Francisco, Los Gatos to Saratoga, etc. 10) Guest speaker series on topics asked for by youth. 11) Swim nights or afternoons for teens co- sponsored by West Valley College. 12) Skate board clinics and demonstrations. 13) Battle of the bands, disco dance, discjockey dances. 14) Tours to choose a profession by: a. radio stations b. TV stations c. Ford assembly plant d. Moffett Field e. Del Monte Canning Co. f. Shaws candy factory g. Humane Society h. Santa. Clara University Law Library i. California Young World, Marshall Lane, Argonaut School, Foothill School, Saratoga School, University Pre - School, Valley Christian School, Outland Multihandicapped Program Center, Challenge Pre - School and Kindergarten, Harker Academy, Montessori Pre - School, Notre Dame, Saratoga Parent Nursery School PPNS, University Pre - School, Village Pre - School. A minimal fee would be charged at some or all locations to defray the production costs. Revenue would return to the Fantino Fund. Non - expendable purchases would be negotiated in the contract to become city property for future productions-or kept by VITA as incentive for production labor and involvement. Bak -O -Donut Machine #5023 (9 at a time) $ 189.50 6.5% Tax 12.32 Total $ 201.82 RESOLUTION NO. 940 A RESOLUTION COMMENDING RINA FANTINO WHEREAS, Rina Fantino was born in 1887 near Torino, Italy, and in 1901 she came to the United States; and WHEREAS, Rina, with her husband Mario, moved to Saratoga in the 1930's and operated a vegetable business; and WHEREAS, the Fantinos, in approximately 1940, built Mario's Delicatessen, a grocery and delicatessen, on Big Basin Way; and WHEREAS, Rina, after her husband died, ran Mario's by herself for over thirty years; and WHEREAS, through the store Rina had contact with many children and was very interested in activities for children and youth; and WHEREAS, Rina Fantino died in 1973 and made the Saratoga Youth Center one of the beneficiaries of her will; and WHEREAS, during the last seven years the estate of Rina Fantino has donated over $20,000 to the Saratoga Youth Center for youth activities; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Saratoga acknowledges the gift from the estate of Rina Fantino and extends thanks on behalf of the community for the generosity shown with the donation to the Saratoga Community (Youth) Center. The above and foregoing resolution was adopted by the City Council of the City of Saratoga at a regular meeting held on the 6th day of February, 1980, by the following vote: AYES: NOES: ABSENT: Councilmen Kraus, Corr- Matteoni and Callon None None MAYOR, Saratogatis gift helps c�ilc�r When Rina Fantino died in a Saratoga convalescent home nearly seven years ago, she left no children. But children rated high with the Italian -born proprietor of Mario's Deli in downtown Saratoga, and to Sarato- ga's children she left a legacy of $21,252. Since Mrs. Fantino's death in June 1973 — at the age of 86 — the Saratoga Community Center has received monthly payments of $116, some of which has helped to maintain the city's youth- oriented programs. But the lion's share of the allotments has been draw- ing interest and will be added to the final check of $7,119 which was presented to the city of Saratoga at its recent City Council meeting by Mrs. Fantino's attorney, Doug Adams. Born in Italy, Mrs. Fantino arrived in New York at age 14 and began caring for the chil- drep of a baker. Moving to Chicago, she met her husband, Mario, and together they head- ed for San Francisco. The couple later came to Sunnyvale where for a number of years Mrs. Fantino worked in the cannery while her husband became a familiar figure selling, vegetables from his delivery truck. In 1940, the Fantinos built " Mario's Deli" on Saratoga's Big Basin Way where Rina made all her own salads until her husband died in 1942 at the age of 59. Rina Fantino operated the establishment as a grocery store until selling it shortly before her death. She had lived in a small apartment behind the store, which, for a time, was the only place in town you could get groceries on Sunday and where "if you bought candy you always got an extra amount" — if you were a kid. The store is now the Handyman Shop. It seems to me these recommendations are not in concert with the objectives set for use of the funds when we set them several years ago. I believe the monies should be used for actual programming for youth activities rather than for capital outlay items for the office. I would be happy to discuss this further with you, if necessary. Because of dollar limitations acquisitions of needed equipment and furnishings were not considered in the 1978 -79 budget. As a result Staff feels it is appropriate to recommend the requested items be approved for purchase from the Rina Fantino Fund. The Fund balance, description of items and justification for each is given in the attached memo from the Community Center Director. I request that this recommendation be approved by you and if necessary submitted to City Council for approval. I would appreciate a response to this request by February 16 so that we might be able to accomplish the necessary installation between class sessions when the building has a lower rate of use. The City Council also adopted a policy requesting program approval, prior to the expenditure of funds. The Community Center receives approximately $1,400 per year. During 1974 -75, monies were approved and spent for youth leagues, film rental, and building im- provements of new carpet and linoleum, totaling $3,000. The fund balance as of January 30, 1979, is $7,741. The following items are requested to be approved for expenditure from the Rina Fantino fund for the Community Center. The monies requested total $2,675. These items are listed in priority order. 1) The Community Center office is in need of some changes. The wallpaper is in very bad shape. It is old and permanently marred and stained in places. The paper is peeling off the wall in various spots. I would like the wallpaper re- moved from all walls, the walls washed down, three walls painted and one wall papered. $500.00 2) A credenza would fulfill the need of more storage and counter space in the Community Center office. The credenza contains two file cabinets, two drawers and a center section with shelves for storage. The receipt machine is presently sitting on the old safe that is nonfunctional. I would like to get rid of the broken safe and place the receipt machine on the credenza. $425.00 3) The Community Center office needs a coat rack, a message tray, and bulletin boards. $100.00 4) The chairs in the Community Center lounge, lobby, and Director's office, need to be repaired and reupholstered. Presently, a majority of them have holes and stains and the foam is coming out. The price includes labor, material, foam, and frames painted for ten chairs. $1,000.00 5) Curtains are needed for the Snack Bar /Lounge are of the Community Center. The curtains would help to maintain an even temperature in the Center, conserve energy with both the heater and air conditioner and would add to the appearance of the room. Basically, the program will benefit the youth of the community by providing services and activities which are not included in the present budget. The recommendation is to initiate two programs, a sports league and a film series. The sports league would be open to Junior High and High School students who are not participating in interscholastic sports. Leagues would be provided for both boys and girls in various sports, with co -ed leagues where possible. Present staff will be able to organize and conduct the leagues, monies will be needed for officials and additional equipment. The film series would be held during the winter months to provide additional activity for the youth who participate in the.drop -in program and others who wish to attend. It is anticipated that both of these programs will be on a yearly basis, and staff will evaluate their development and success. One major capital improvement of the Center is being recommended for use of the funds. The last two years new carpet for the Center has been requested in the capital budget, and each year it has been deleted due to other priori- ties and a lack of funds. Because it will have � considerable effect in the appearance and therefore the use of the Center, I feel it is justified as a program of expenditure for the Fantino Funds. I recommend the approval of the request of the Center Director for expendi- ture of the Fantino Estate Funds as outlined above. All resources - the laws, money, leadership, facilities, and management - are valuable only insofar as they can be.used to provide and improve opportunities for recreation. If recreation programs and services are to satisfy those who engage in them, they must provide an outlet for persons of varying interests to enjoy, to create and express, to have adventuresome new experiences, and to achieve. Persons, young and old, must find in the recreation program opportunities for sociability and fellowship, for physical and emotional release and development, for beauty and for service. Some phases of the recreation program must also take into consideration the desire for occasional relaxation. With these ideas in mind let me refresh your minds regarding the Rina Fantino Estate. Rina Fantino who died June 22, 1973, left a will wherein she bequeathed the sum of $500.00 to the Saratoga Youth Center. In addition to this bequest, Mrs. Fantino also left 1/3 of the residue of her estate to the Saratoga Youth Center. The bequest mentioned are contained in Article IV (II), Page III, and Article V, Page III, of the will. Please be advised that you, the City Council, at its regualr meeting on February 6, 1974, accepted two checks, one for $500.00, the other for $2,240.00 from the Estate of Mrs. Rina Fantino. The Council at that time established a special account for the receipt of these funds and based on the City Manager's recommendations, approved a policy statement indicating that none of these funds were to be spent until a program had been approved by the City Council for their disbursement. As of September 4, 1974, the balance of the funds is $3,836.00, and at this time I would like to present to the City Manager and the City Council the plan of action that will establish future programs for expenditures regarding the Estate of Rina Fantino. ©s To: Director of Community Services Page (2) September 13, 1974 1. Officials for Flag Football, Volleyball, Basketball, $ 500.00 Softball and Co -ed Leagues. 2. Rental of popular movies to be shown during the rainy months of November - February $ 500.00 3. New carpet and linoleum $29000.00 Item 1. would be a continuous year -round program for the teens of Saratoga. At present there is no such sports program, for those youths who are not fortunate enough to make the high school athletic teams, provided by anyone. With the advent of such a program by the Community Center it would be imperative to be able to provide officials for the different sports as it would be difficult to meet all of the officiating needs with the present'Community Center's staff. The actual amount of money needed for officials would vary depending upon the number of teams per league, but it is anticipated this would not exceed $500.00 per year. Item 2. would be a year -round program, starting in November and ending in February. This program would be of tremendous merit to our present drop -in program of Pool, Ping Pong, Chess, Arts & Crafts, Music, etc. It would allow a diversity to the present program that has been never tried before. Many of the past hit and current hit movies are available for rent for between $50 and $100 per rental. The actual amount for each movie would vary depending on which movie was rented, but it is anticipated the movie rental would not exceed $125 per month or $500 for the four months. With the current prices of films at theatres today and some youths with transportation difficulties this would be a tremendous program especially.during the winter months. Item 3. should be a one -time expense. New carpet and linoleum are needed in the Community Center to replace the badly worn present carpet. The present carpet is held down at nearly every seam by electrical tape. More and more seams are coming up everyday making it very possible a serious injury will occur when a youth, adult, or senior citizen catches his /her heel on the seam and falls. 'I would like to see this situation remedied before a serious injury does occur causing added expense to the city in the form of a lawsuit. The acquisition of new carpet and linoleum would greatly enhance the overall performance of the programs offered by. the Community Center. It has been suggested by many people that to enjoy ones leisure time in the right frame of mind a person needs aesthetically pleasing:surroundings. I feel at present the carpeted area in the Community Center is not an-aesthetic surrounding, due to its severly worn condition. Such appraisal of service to be valid, should be both qualitative and quantitative. Admittedly, the scientific evaluation of the realization of ob- jectives is difficult due to the process involved, the lack of appropriate techniques, and the nature of recreation. We at the Community Center will utilize the tools of evaluation available to us to effectively oversee the effectiveness of the programs goals and objectives and continue to seek to determine the degree to which these goals are being realized. My first priority was to start the Center on a preventative maintenance program. The first item I feel that needs attention is the rug. I have been in the process for the last month of having carpet dealers give me estimates on carpeting all existing areas in the Center except the Coffee House and Arts & Crafts hallway, those areas will be done in linoleum. To this date Mr. Ned Doll of Doll House Interiors has quoted me the fairest price, that being approximately $1300 for carpet and linoleum. I would like to suggest that the money left to the Center by the late Mrs. Fantino be used for this purpose. I have talked to Mr. Doug Adams who is handling the Estate and he has informed me that there was no specific area that Mrs. Fantino wished the money to go towards, other than the benefit of the youth of Saratoga. I feel that this item would enhance the attractiveness of the Center to the point it would be more appealing; the present carpet is worn and shabby and adds little to creating a wholesome atmosphere for youths to enjoy. I would also like to suggest that the Center be allowed to purchase with this money a large sign for outside of the Center with the inscription "Saratoga Community Center" and a permanent plaque attached to it in rememberance of Mrs. Fantino. Next, I would like to ask that some of the money be budgeted to pay for officials for this years coming flag football and basketball seasons. At present we have no such funds nor do we have sufficient personnel to handle the task. Last June I received worst from Mr. Doug Adams, local attorney, that the Youth Center had been included in.the will of the recently deceased Rina Fantino. A fixed amount of $500.00 was willed along with one -third of the residue of her estate which at that time was undetermined. Mr. Adams said he would notify me when her estate had been appraised. Yesterday, Mr. Adams notified me of the following amounts the Center will receive: 1) A fixed amount of $500.00 to be received in one payment. 2) An additional undetermined amount to be received in one payment. (Estimate is $2,000.00). 3) Approximatly $100.00 /month for seven years (approximately $8,400.00) from a trust fund. The date of final execution is December 17, 1973. Three problems should be considered before this is taken to the council for acceptance: 1) should this, in fact, be treated the same as a donation; 2) would a special revenue account be necessary for deposits from the estate; 3) should the city, instead of receiv- ing the $100.00 /month over seven years, sell its portion of the promisory note to receive immediate cash. In addressing these three problems I would suggest that the monies be accepted by the council as a donation with a special rev- enue fund account to accumulate the collections and receive interest until spent. This special fund would be necessary to assure monies go to the Center and not to the general fund, to avoid violation of the intent of the will. Upon the advice of Mr. Adams I would strongly advise against selling the promisory note for immediate cash since -I- & doing so would mean taking a considerable loss on the amount to be received and since the Center doesn't drastically need immediate funds. I give and bequeath the sum of Five Hundred Dollars ($500.00) to the GIRL SCOUTS- SANTA CLARA COUNTY COUNCIL, for camperships for needy girls. 9. I give and bequeath the sum of Two Thousand Dollars ($2,000.00) to the SARATOGA HIGH SCHOOL, Saratoga, California, to be used for scholarships for needy students who, in the considered opinion of the appropriate faculty and administrative committee, deserve a scholarship. 10. I give and bequeath the sum.of Two Thousand Dollars ($2,000.00) to MING QUONG CHILDRENS CENTER, Los Gatos, California. 11. I give and bequeath the sum of Five Hundred Dollars ($500.00) to SARATOGA YOUTH CENTER, Saratoga, California. 12. I give and bequeath the sum of Five Hundred Dollars ($500.00) to the ROMAN CATHOLIC ORPHANAGE closest to Rivarolo Canavese, Pro vincia di Torino, Italy, such money to be used to help the children in such orphanage. ARTICLE V _ All the rest, residue and remainder of my estate, both real and personal and wherever situated, I give, devise and bequeath to DOROTHY SAIN, SARATOGA YOUTH, CENTER, Saratoga, California, and MING QUONG CHILDRENS CENTER, Los Gatos, California, in equal shares. ARTICLE VI Should any of the charitable bequests or devises in this Will be held to be in violation of Sections 41 to 43 -3- inclusive of the Probate Code of the State of California, or either or any of them, or of any other provisions of law, regulation, or restriction whatsoever, now or hereafter in force, then, and in such event, I direct that such disposi- tion, to the extent that the saner is valid and legal, shall remain in full force and effect. Any portion of my estate' which shall be held by a court of competent jurisdiction to have been disposed of in violation of any of the laws, regulations or restrictions mentioned in this paragraph, I hereby give, devise and bequeath to the individual who at the time of my death occupies the position of General Director of such corporate charitable beneficiary without intending to create any trust or other charge, condition or limitation enforceable in law or equity. AR'T'ICLE VII All inheritance, estate or other death taxes that may by reason of, my death be payable or due upon or in connection with my probate estate or any portion thereof, together with all inheritance, estate or other death taxes that may by reason of my death be payable or due upon or in connection with any property or transfers thereof outside of my probate estate, shall be paid by my executor out of the residue of my probate estate as described in Article V hereof and shall not be charged against or collected from any devisee, legatee or beneficiary of my probate estate or any transferee or beneficiary of any taxable property outside of my probate estate. ARTICLE VIII I nominate and appoint DOUGLASS M. ADAMS, my attorney, as executor of this Will. -4- W-1 I authorize and empower my executor to sell any property of my estate at public or private sale, with or without noticep to mortgage, hypothecate, or otherwise encumber any property of my estate, with or without notice; and to hold, manage and continue to operate any property and any going business which may constitute a part of my estate at the sole risk of my estate and not at the risk of said executor, the profits or losses therefrom to inure to the benefit of or be chargeable against my estate as a whole. ARTICLE IX It is my desire that I be buried in Madronia.Cemetery, Saratoga, California, next to my husband. ARTICLE X If any provisions of this Will or of any Codicil should be invalid, it is my intention that all of the re- maining provisions thereof shall continue to be fully effective.
