Code 54954.2, the agenda for this meeting was properly posted on May 6, 2001) DATE: May 9, 2002 TIME: 8:30 a.m. PLACE: Heritage Orchard, Saratoga California SUBJECT: Deposition of Various Trees located in the Heritage Orchard Please meet at the Warner Hutton House located on Fruitvale Avenue next to City Hall. 1 SARATOGA CITY COUNCIL MEETING DATE: May 1, 2002 AGENDA ITEM: ORIGINATING DEPT: Community Development CITY MANAGER: PREPARED BY: John F. Livingstone DEPT HEAD: SUBJECT: The City Council has requested reconsideration of their previous action regarding the disposition of the existing non - orchard trees in the Heritage Orchard. RECOMMENDED ACTION: Provide direction to staff concerning the removal and transplanting of Oak trees in the Heritage Orchard. REPORT SUMMARY: At the City Council meeting of April 3, Councilman Bogosian requested that the City Council reconsider its prior approval of bids to remove or transplant non - orchard trees from the Heritage Orchard. The Mayor subsequently placed this on the May 1, 2002 agenda for Council reconsideration. The non - orchard trees inhibit the growth of the orchard trees. Staff investigated options to have the Oak trees moved or sold. A tree mover met with staff and explained that most of the trees are too large to move and have structural problems, which prohibit moving them. One tree close to Fruitvale Avenue could be moved at a cost of approximately $20K. Staff is recommending that this tree be transplanted to the entrance of the City as part of the Gateway Project. In light of the recommendation by the tree moving company, the Heritage Preservation Commission recommended to the City Council that the remaining trees be removed. DISCUSSION: The lowest bid for the tree removal project, which including grinding the stumps instead of complete removal was submitted by Ian Geddes Tree Care Inc. for $3,450. Staff is recommending awarding the contract to Ian Geddes Tree Care Inc. The following is a list of the companies who submitted bids for the project: Ian Geddes Tree Care Inc. ---------------- - - - - -- $3,450 Arbor Care ---------------------------------- - - - - -- $5,540 Tree Master --------------------------------- - - - - -- $6,950 Bill's Tree Care and Landscaping Inc.---- - - - - -- $7,700 Norhausen Inc.. ------------------------------ - - - - -- $8,680 Anderson's Tree Care ---------------------- - - - - -- $9,030 Novakovich Orchards --------------------- - - - - -- $12,000 1 The bid for moving and replanting the five small Oak trees is $500 a tree. This size of Oak is ideal for transplanting. Staff is recommending the tree transplanting due to previous success transplanting trees by the same tree moving company. Staff is recommending awarding the contract to Tree Movers. HISTORY: At the March 20, 2002 City Council meeting staff prepared a report requesting direction on- the disposition of the non - orchard trees in the Heritage Orchard. At the meeting, Council directed staff to amend the Phase II Orchard Restoration CIP Project budget and the Heritage Orchard Master Plan to remove the trees. On April 3, 2002 staff prepared a report on the non - orchard trees which included two resolutions of approval, one to amend the Heritage Orchard Master Plan and the other to appropriate funds for the removal and transplant of the non - orchard trees. Removal of the Orange tree was discussed and ultimately decided to be retained. Both resolutions where approved. FISCAL IMPACT: Removal of six Oaks and two Firs trees-------------------------------------------- - - - - -- $3,450 Transplant the five small Oak trees along Saratoga Avenue to the median on Fruitvale Avenue-------------------------------------------------------- - - - - -- $2,500 Recommended contingency------------------------------------------------------------ - - - - -- $450 TOTAL $6,400 If all of the above requests are funded the total amount would equal $6,400. This money would be taken from the Council Contingency fund. CONSEQUENCES OF NOT FOLLOWING ACTION: If -the Oak trees are not removed, it may cause orchard trees near the Oak trees to deteriorate If' the small Oaks trees along Saratoga Avenue are not transplanted to the median on Fruitvale Avenue, the trees will eventually mature and cause the view of the orchard alon`.; Saratoua Avenue to be obscured, and inhibit the growth of nearby orchard trees. ALTERNATIVE ACTIONS: 1. Grant a portion of the requested funding for select items. 2. Prune the Oak trees to prevent further deterioration of the orchard trees. 3. Budget the tree replacement and removal in 2003/2004 in conjunction with the tree replacement plan for the library project. 2 of 3 FOLLOW UP ACTIONS: Staff will prepare a contract with the tree removal and tree moving companies. The large Oak closest to Fruitvale Avenue will be maintained in the event that it may meet the final specifications for the Gateway Project. I am an avid fan of both Saratoga's Heritage Orchard, and of the oak trees that grow in Saratoga, but they don't nix well in the Heritage Orchard. There are-two reasons, oaks are more powerful than the surrounding fruit trees, so surrounding fruit trees lose the competition for water and light, AND the oaks left in this Orchard represent one more project that takes precedence over the Heritage Orchard; politically this project paves the way for someone else's future project in the Orchard. Let's deal with the last argument first. Saratogans fall into tbree groups as they evaluate the Heritage Orchard. The Srst group does not cam about it. It is just a piece of land waiting to be developed The second group likes the Orchard as long as it does not impede their own special project. - (This is a rather worrisome group of "supporters ".) The third group wants to save and nurture the Orchard above all other "projects ". (This third group thinks that all other city projects need to go elsewhere.) During the past several years, despite a city council that has taken the position of saving the orchard, the orchard has le Ls bona ground and trees. In addition, the Orchard has bad multiple "near misses". These past events are: I. The Library expansion was a hard fought struggle. In the end, the expansion of the building and parking lot took out 2 redwoods, 4 sycamores, and some forty or more fruit trees (I can't find my old data with exact numbers) 2. The temporary library and its parking lot nearly went in the NW section of the Orchard, near Saratoga Avenue. Only the last minute agreement with the church protected the Heritage Orchard. I Some citizens have lobbied us for a gym and or playfields iri the orchard. Only the . creative design work far the Civic Center remodel plans and active searches for temporary and permanent playfields elsewhere saved the orchard. 4. The Orchard management was moved to the control of the Heritage Commission, after there was a concern about the Parks and Recreation Commission's views on maintainizig the orchard. .I- 0 04/22 "7 08:58 N0.352 03/05 5. And, of course, past City Councils have ignored the orchard so that it is now costing a lot of money to pull it back into shape. With the present public financial problems, mainte m= costs of the orchard will be up for discussion and now may have to be cut. 6. There are continuing discussions of a pump house and educational facility for the water well equipment and the public's information room. How large will that project grow? So along comes the decision of the Heritage Commission and the City Council to remove or move oak trees from the Orchard as part of the reclamation of the Orchard. Why should we do this? There are two general arguments: political and health. POLMCAL Making the Orchard look like a real orchard enhances its defenders' abilities to protect it from development. Also not allowing any project to nibble away at the orchard is essential. HEALTH Taking out non -fruit trees protects the individual surrounding fruit trees from the competition for water and light, making them healthier. The following issues fat] under the two general arguments. l In the future, when the 12 mature oak trees dominate the area by their height and bulk, who is going to see the patches of fruit trees behind them? All we will see is the individual, runty, sad fruit trees nearest the street. Many of us have fivit trees in our yards. We know they are not an orchard. What is an orchard? It is the unbroken rows of the same type of fruiJnut trees marching in line to the horizon. It is the glorious mass of the same type of flowering trees, visually unbroken by other tree shapes. This will not be what we or our children or grandchildren see in 10 -20 years when the mature oaks now dominate the overall view. It is then that some group of citirens wilt have the bright idea of building a ---for the city. "nose new buildings will be great nestled in beside the beautiful oaks. Let's take out those old remaining fruit trees. It is not even an orchard anymore." 2.1 have heard the argument that the City is breaking our own code of "no big oaks/trees can be cut down in Saratoga ". Sar3toga's code simply does not say that. Our code states that tree removal permits are required after a certain circumference size. The following are some of the listed reasons for a permit to be given: disease, danger of falling, proximity to existing or proposed sttvctvres, and for economic reasons or other enjoyment of the property. In addition, trees can be removed because of "the number, species, size and location of existing trees in area and the effect the removal would have upon shade, privacy impact, scenic beauty, property values, and any established standards of the area." And lastly, removal is permitted due to "the number of healthy trees the property is able to support according to good forestry practices." -2- 04/22 T-18:59 N0.352 04/05 3. Some e- mails are insisting that big oaks and other trees do not hurt surrounding fruit trees. I disagree. I ask you to look at the big oaks in our own yards and public areas. Nothing much grows within their drip lines because of the dense shade and lack of water. The powerful oaks get all the water and are very dense shade trees. In addition, specialists tell us not to plant things under oaks that need a lot of water because watering oaks during the dry season can cause root rot for them. They are natives that are designed for long California dry sumocrem Oaks are best not put in yards that are watered year round. 4. An email says we should not take the trees down or move them because raptors sit in thern while hunting gophers. My argument is that while some trees are to be taken down there are many trees left on the creek bordering the orchard, redwoods and oaks near the Library and church, the tall roof of the Library, and telephone poles and wires on Saratoga Ave and Fruitvale Ave. The raptors in my neighborhood use anything tall. If there is a healthy crop of gophers in our Orchard, the raptors will be there. Lets not argue that NIr. Redtail or Mrs. Owl wont hunt on the Heritage Orchard land, if one of his/her trees disappears. 5. Mr. Novakovich brought up a point that he uses the Oaks as shade for his men and the picked front. I can appreciate the need for shade for our orchard caretakers but let's be creative about the solutions. Leaving the oak trees in place has so many down sides that I would suggest putting up temporary shade tents at fruit picking time. Another solution is to make a series of shade areas under the remaining giant oaks along the creek or over by the library. They are only a few rows away. 5. I think the saddest argument that I have had was the conversation with two of our local orchardists. When. I asked if they would allow oaks in their commercial orchards (both here and in the Central Valley), they both said no they would not allow oaks or other trues to grow in their orebards. They would damage the fruit/nut crop yield_ "But Ann, the Heritage Orchard is not a real orchard so it doesn't matter". But it does matter. The only way to preserve this orchard is to make it look as close to a "real" orchard as possible. Conclusion I am asking the group of citizens who want to save the Heritage Orchard to reconsider their stance on the oaks. I am very sad to see the very folks who I perceive as warming to defend the orchard, now unintentially compromising it and making it more vulnerable to someone else's pet projects in the firture. Politically, if the oak trees take precedence over the orchard, it is an easy jump to seeing another project taking precedence. I do not think that is what you want. -3- 04/22 08:59 N0.352 05/05 Please reconsider your argument Yes, oaks are beautiful and majestic but some times they must be art or moved. This is one of those times we have to make the hard choice. This is the only Heritage Orchard we have. Politically, it will only exist as long as we have a strong group of protectors for it. The hard choice is that the non -fruit trees have to be cut or moved to save the orchard. It reminds me of the awfbl choice that the rangers are making in = Bay Wetlands. Too many foxes and feral cats (with no predators of their own) are decimating the waterfowl population. If they are not trapped, we will have no ducks and shorebirds in our wetlands. -It is the same hard argument for the oak trees. We have to choose. SUBJECT: REMOVAL/REPLANTING OF OAK TREES, SARATOGA HERITAGE ORCHARD When the plan for the Heritage Orchard (dated August, 2001)was presented to the Heritage Preservation Commission by David Gates & Associates, the HPC - by consensus - suggested that options be explored for the removal/replanting of some of the non - orchard (oak) trees. Based on information received, the majority of the Commission advised that the statement re: non - orchard trees at the bottom of page three of the plan be amended, removing the section about retaining the oak trees. I voted in the affirmative, based in part on personal experience. When volunteer oaks appeared in our "orchard" (approximately 20 trees) and our "vineyard" (approximately 20 vines), we naively decide to let them coexist. The oaks grew very rapidly. Two nectarines, my favorite Elberta peach and two cherry trees showed signs of slowing growth - and then they died. In addition, about five ofbur vines died. The only proximal trees that survived were two large apricots which had grown very fast prior to the appearance of the oaks and the oaks' canopies didn't seem to bother them. During the past few years, however, 'cot production on the these trees (compared to those on other parts of our property) has slowed and the branches which have been encroached upon by then oak canopies are dying. I would hate to see this happen in the Heritage Orchard that we are trying to revive as a magnificent agricultural example of Saratoga's heritage. If all of the fine people who worked so hard to save the orchard don't want to go the extra mile and ensure the health of this wonderful place, then - by all means - don't remove or replant the oak trees. We can then plan on just having an oak grove. Due to the eventual demise of fruit trees growing anywhere near the oaks (from extreme shade - more and more as the oaks get larger and larger-, loss ofwater and a very acidic condition (ofwhich fruit trees [as opposed to camellias, azaleas and rhodics] are not fond] due to the oak leaves falling around the crop trees), THE OAKS SHALL OVERCOME! In that event, Good -bye, Heritage Orchard! I sincerely hope the City Council won't allow this to happen; according to Gates & Associates, there are already 298 dead or missing trees in the Orchard! Several years ago, a prior City Council shelved carefully prepared plans for a tree ordinance. I would hope that you, as a more enlightened Council, would consider revisiting this proposed ordinance. There is an excellent section re: an off -site tree replacement program. Implementation of this program, as the budget allows, would offer a wonderful alternative to the rescinding of your previous vote re: oak tree removal/replanting. There are several reasons why some of these oak trees should not be removed. We need at least one to three oak trees in the orchard to park the pick up under with the boxes of ripe fruit in the month of July on very hot days. The shade of the oak trees helped the apricot trees to be cooler on very hot days. They are also places for workers to eat their lunch in the shade. b'j I know that some of the trees were in the way of the apricot rows. The ones that areAin line with the apricot trees were fine to remove. Our family has been taking care of the orchard for over twenty years and we love to see the trees and the open space. We hope you will reconsider and leave at least three of the big oak trees in the middle and each end of the orchard. VVe are working every year to make the orchard look good. We know all the decisions have been made, but you have the power to change them, too. We hope you will work with us for everyone's benefit. Also, we think we should have been notified before these decisions are made about *the Heritage Orchard. At night, the owl looks down from the silk trees to catch gophers that come out at night. My defense of keeping the oaks was based on the invalid premise that some along the creek were being removed. It would have been sensible of me to have researched the facts first instead of jumping the gun by assuming that the report in the Saratoga News was accurate. I have no issues with the oaks being removed from the body of the orchard, as they are volunteers which should have been disced over or otherwise removed when they first appeared. Being amongst the orchard trees means they get watered during the summer so these oaks are at risk from root fungus or other diseases which will kill them eventually anyway. Taking the time and effort (and funds) to relocate six of the oaks into the Fruitvale center strip and the Gateway are to be applauded. When the subject comes up on the agenda on May 1, you can list me as supporting the plan put forward by the Heritage Committee. Eden Road Saratoga, CA 95070 4081867 -3373 April 20, 2002 City Council Saratoga, CA 95070 Dear Council Members, APR 2 5 2UO2 &6 "EZeven coast oaks wD ZZ be removed from the City Orchard" When I read that ominous headline on page 11 of the Saratoga News 6f-April 10 I assumed it was yet another casualty list being added to the ever increasing score of the Sudden Oak Death epidemic, But now, after reading on, I learn the trees in Saratoga's Heritage Orchard have been condemned not because they are diseased; which they are not, but rather simply because they have been deemed to be in the wrong place. In othEr words, they are to be treated as lowly weeds, a ' "weed " being defined as any plant in the wrong place. This all came about when the Decision Makers decided shade trees detract from the orchard's "professional" look, rendering it less than authentic. Well, I can remember when I was a very small boy earning my own "spending money" working in these same orchards, and it is not the sticky -sweet of the prune trees I remember so fondly, but rather it is the relative coolnes of the shade trees that made my job bearable. Those orchards were professional orchards, too, believe me; world -wide pro- fessional orchards, and nobody thought otherwise of them because a'few of the trees provided cool, refreshing shade instead of just hot fruit. And it's obvious those great trees, or their ancestors, were natives here long before cherry, apricot, or prune trees appeared on the scene. 7b sacrifice any one of then now in favor of the latter is akin to a slap in the face of the history and heritage of this valley. Nay, let the shade trees stay, I say; they are, indeed, authentic. However, Saratoga's City Staff and Officials developed strict tree removal codes in order to discourage residents from arbitrarily removing mature trees from their own private property. In support of those codes as well as preservation of the Heritage Orchard, I urge you to seriously consider re- locating as many of the mature trees as possible. Simply removing the oak and fir trees is not only counter - productive, it suggests that while homeowners must comply with Saratoga Tree Removal Codes, City Officials are exempt. Therefore, I request that you remove only those trees which actually threaten the viability of the Heritage Orchard; once removed, all viable oak and fir trees should be re- located throughout our City. One last suggestion: It is likely that many residents (who have not followed the discussions regarding the tree removal) will be outraged .vhen they discover that mature trees are to be removed from the orchard. In order to stem a possible onslaught of protests, I suggest that an explanatory letter be written for for publication in the upcoming issue of the SARATOGA NEWS. We did not even send it to the Saratoga News. Be assured we have not "called out the troops," so to speak. Having said that, we now reiterate what we wrote in our e -mail to you at CC last weekaE "i.e., we consider the removal of the oaks a fait accompli. Our real concern is the _issue of a barn that would require removal of still more trees. You did not address that issue, nor has Councilman Streit responded. As stated previously, the new library is our educational facility. We strongly oppose anything larger than a small shed. A large additional buildingaE "once it's thereaE "might very well be turned into something else if someone contends it's not used enough. As for having an educational venue, please remember that we personally addressed CC long ago, pointing out that many people who voted on the City's survey to support (and we quote) "the Heritage Orchard's use as an active educational orchard /garden ?" did so because the choice was that, or the next question, ".....public recreational facility for organized sports ?" We are happy to be among the "strong group of protectors for it" (orchard) as you stated, but we are very busy with other matters and would have preferred not to get into this again. People do believe they have a right to know that the Historical Resolution means what it says, in perpetuity, not subject to "political" machinations. 0= herwise it's just a meaningless piece of paper. As for the 3 groups of Saratogans you describe, we suggest there is a 4th - people who love the orchard, who approved wholeheartedly of the library expansion, but who want to be assured they don't have to keep fighting to keep the fruit trees from being "nibbled away" (by future projects). Staff is recommending awarding the contract to Ian Geddes Tree Care Inc. The next closest bids were from Arbor Care for $5,540 and The Tree Master for $6,950. The bid for moving and replanting the five small Oak trees is $500 a tree. This size of Oak is ideal for transplanting. Staff is recommending the tree transplanting due to previous success transplanting trees by the same tree moving company. Staff is recommending awarding the contract to Tree Movers. I wasn't sure if the Heritage Orchard was included in with the "parks ", or not. I would like to recommend that the Heritage Orchard be removed from the jurisdiction of the Parks and Recreation Commission. Since it was the Heritage Preservation Commission that designated it a heritage resource I would like to suggest that the Heritage Orchard be put under their jurisdiction. I think they are the ones who know the most about it. I was a charter member of the Heritage Preservation Commission, and along with my husband Kurt, was instrumental in helping Saratoga set up a Heritage Commission. That is why I have a special interest in the orchard. Another item I would like to address is the eventual signage that will be installed for our beautiful new library. Staff investigated options to have the Oak trees moved or sold. A tree mover met with staff and explained that most of the trees are too large to move and have structural problems, which prohibit moving them. One tree close to Fruitvale Avenue could be moved. Staff is recommending that this tree be saved to allow the possible transplanting of the tree to the entrance of the City as part of the Gateway Project. The map attached to the staff report shows the removal of the six Oak trees, and two fir trees and the transplanting of five Oak trees from the Heritage Orchard to the median on Fruitvale. The one large Oak tree closest to Fruitvale Avenue is also being saved for the possibility of it being transplanted to the Gateway project. RECOMMENDED ACTION: Provide direction to staff concerning the removal and transplanting of non - orchard trees in the Heritage Orchard. REPORT SUMMARY: At the May 1, 2002 City Council meeting the Mayor requested a site visit to the Orchard to review the non - orchard trees. The site visit was placed on an agenda for May 9, 2002. After the site visit the Mayor requested that the item be brought back to the Council for discussion at the .tune 5, 2002 City Council meeting. HISTORY: At the March 20, 2002 City Council meeting staff prepared a report requesting direction on the disposition of the non - orchard trees in the Heritage Orchard. At the meeting, Council directed staff to amend the Phase II Orchard Restoration CEP Project budget and the Heritage Orchard -Master Plan to remove the trees. - On April 3. 2002 staff prepared a report on the non - orchard trees which included two resolutions ol' approval, one to amend the Heritage Orchard Master Plan and the other to appropriate funds for the removal and transplant of the non - orchard trees. Removal of the Orange tree was discussed and ultimately decided to be retained. Both resolutions where approved. At the City Council meeting of April 17, Council Member Bogosian requested that the City Council reconsider its prior approval to remove or transplant non - orchard trees from the Heritage Orchard. . The Mayor subsequently placed this on the May 1, 2002 agenda for Council reconsideration. On May 1, 2002 the City Council reviewed the proposal to remove non - orchard trees from the Heritage Orchard. At the meeting a site visit was recommended to further evaluate the issues. A site visit was subsequently scheduled for May 9, 2002. SUMMARY OF SITE VISIT: On May 9, 2002 a site visit was conducted to review the trees in the Heritage Orchard. The City provided two ecological consultants to assist with biology questions concerning insects, birds, and general wildlife associated with the trees. The City also provided two arborists from the Town of Los- Gatos staff. All of the Council - members where present for the site visit as well as members from the Planning Commission, Heritage Preservation Commission, Park and Recreation Commission, and the Public Safety Commission. The Novackovich's, who maintain the orchard, were also present along with several members of the community. Arborist comments The Arborist did not see any immediate signs that the Oaks trees were in poor health and felt that some moderate pruning could be allowed on some of the Oak trees without damaging the trees. One issued raised by the Arborist was that if an Oak tree is removed the stump should be removed and as much of the roots as possible to prevent Oak Root Fungus. The Oak Root Fungus becomes very aggressive once the host tree is removed and may attack nearby orchard trees. The fungus is native to the soil and the majority of trees would more than likely have it. The Arborist also recommended that no disking be done under the Oak trees, which would help extend the life of the Oak trees. Orchardist comments Matt Novakovich recommended that tree #4 and #6 be removed and that some trimming be done on the other trees (see attached map). He did not feel strongly one way or another about the small Oaks along Saratoga Avenue because they are to close to the street and pathway to be replaced with orchard trees. Ecological Consultant comments The Ecologist said the Oak trees do not support Raptors, but did provide nesting for some other t%l)es of birds. The Silk Oaks were the likely place for Raptors, but the trees could be replaced with perch poles throughout the orchard. In order to control rodents he recommended building birdhouses for owls, which are aggressive predators of rodents. The Ecologist also advised staff that the bird - nesting season is from March through July. FISCAL IMPACT: Staff will come back with a contract after direction is provided by the City Council. ALTERNATIVE ACTIONS: Keep all of the oak trees and prune them to prevent further deterioration of the orchard trees. 2 of 3 i' FOLLOW UP ACTIONS: Staff will prepare a contract with the tree removal and tree moving companies. Coate Consulting Arborist August 30, 2002 Job #08 -02 -172 6 V o- a "l --c® -:;c�Ro Co RECOMMENDATIONS FOR PRUNING IN THE SARATOGA COMMUNITY ORCHARD Assignment I was asked to meet Mr. Novakovich in the apricot/cherry orchard north of City Hall on August 30 to look at several of the coast live oak (Quercus agrifolia) trees and the two silk oak (Grevillea robusta) trees in the orchard and to determine what potential for pruning there is in those trees to get them out of the way of the orchard activity. Summary In my opinion, it would be easy to remove the lowest hanging branchlets, to reduce the endweights on the longest limbs and where necessary remove up to 4 inch diameter branches in the several coast live oak trees that are in the orchard to get them above the 8 foot minimum height necessary to clear the discing equipment and to reduce the diameter of the canopy sufficiently to remove the oaks from competition with adjacent fruit trees. The silk oaks are terrible specimens, which were badly damaged by frost in the 1990 freeze and as a result have canopies composed of almost entirely of watersprouts which are always candidates for breaking out of the canopy of any tree but when the species is as naturally brittle as silk oak the hazard is even greater. Removal of one -third of the canopy of each of the silk oaks is advised. Discussion On August 30, Mr. Novakovich and I inspected several of the coast live oak (Quercus agrifolia) trees and the two silk oak trees (Grevillea robusta) in the orchard. Silk Oak I was told that the tallest limbs on the silk oak trees are a favorite roost site for various raptor species and for that reason they would prefer not to remove entire trees but on the other hand are concerned about the safety of the structure of these rather hazardous specimens. The enclosed pictures show the locations of recommended cuts to remove the most hazardous portions of the canopies, of these trees. It should be understood that hazard is a relative term, primarily related to the presence and importance of the target. Since the area beneath the canopy of these silk oaks is currently seldom used, the hazard level created by these trees is minimal. If on the other hand use of the land is to change to the point where there will be frequent use of the area beneath the canopies or if children will be playing beneath the canopies I strongly recommend that these trees be entirely removed since no matter what pruning is done they cannot be made truly safe. Coast Live Oaks Several coast live oaks in the orchard are in excellent health and are some of the best specimens in Saratoga. PREPARED BY: BARRIE D. COAT E, CONSULTING ARBORIST AUGUST 30, 2002 RECOMMENDATIONS FOR PRUNING IN THE SARATOGA COMMUNITY ORCHARD 2 They are however, due to their excellent health, growing into the adjacent orchard trees and down into the path of orchard maintenance equipment, and for that reason really should be pruned. This pruning should not include excessive interior thinning which will merely push new growth to the ends of long limbs and accentuate the existing problem, not solve it. Recommendations 1. 1 suggest that all of the oak trees in the orchard be pruned in the following manner, a. All 4 -inch diameter or smaller limbs or branches which are growing from 10 feet or lower in the canopy in a more or less downward direction and as a result create understory canopy could be removed. Branches 4- inches in diameter or larger should not be removed in this process. b. All twigs and branchlets which grow down into the area used by orchard maintenance equipment or at heights of less than 8 feet above ground could be removed-except for branches larger than 4- inches in diameter. c. The ends of the longest limbs should be reduced by at least 6 feet or up to 15 feet by drop - crotch pruning procedures to reduce the diameter of the oak canopy by up to 30 feet and height by up to 6 feet. The most important area of concern are the sides of the canopy but it will be necessary to do the top of the canopy as well if the trees are to be kept in reasonably balanced proportions. This style of pruning does not require a large number of cuts but it does require that each cut that is made is very carefully thought out so that it reduces the diameter or the height of the tree without removing unnecessary canopy portions. The finished product should look precisely as the tree does now only in a much smaller diameter. To repeat, this does not involve excessive thinning of the interior of the tree canopy. d. The deadwood in the interior of the oak canopies should be removed and small twigs of diameter or less should be removed but larger branches should not be removed in this process. 2. The two silk oak trees should be pruned to reduce the number of major upright canopy portions and to make the trees as safe as possible. 1n this case, the only concern of the tree pruner should be to leave the tallest branches in each tree for raptor roosts, but since the rest of the canopies are of such terrible structure no concern should be had for reconstruction of a pleasing form but only reduction of the mass to make the trees as safe as possible. Mr. Novakovich tells me that beehive is beneficial to the orchard and for that reason it should not be damaged or destroyed. it will be very important to get a tree company that understands drop - crotch pruning of endweights to do the oak work since most tree pruning companies do that work very poorly. There are several reasons why some of these oak trees should not be removed. We need at least one to three oak trees in the orchard to park the pick up under with the boxes of ripe fruit in the month of July on very hot days. The shade of the oak trees helped the apricot trees to be cooler on very hot days. They are also places for workers to eat their lunch in the shade. &t I know that some of the trees were in the way of the apricot rows. The ones that arelin line with the apricot trees were fine to remove. Our family has been taking care of the orchard for over twenty years and we love to see the trees and the open space. We hope you will reconsider and leave at least three of the big oak trees in the middle and each end of the orchard. We are working every year to make the orchard look good. We know all the decisions have been made, but you have the power to change them, too. We hope you will work with us for everyone's benefit. Also, we think we should have been notified before these decisions are made about the Heritage Orchard. You should tell the neighbors and people of Saratoga what you are going to do before you do it. After completion, the report was forwarded to the City Council for consideration. The City Council adopted the master plan and authorized a Capital Improvement Program to invest in the Heritage Orchard after many years of neglect at a price of over $250,000. The Orchard Restoration Project involves installing a well, installing a permanent irrigation system and replanting several hundred dead, diseased or damaged trees. Future plans call for developing a modest theme oriented building on the site that could be used for educational purposes for introducing school children and others to our agricultural heritage. This year, the Heritage Preservation Commission undertook a study of whether the oaks in the middle of the orchard were appropriate in the context of orchard restoration. They decided to treat the orchard more like a production orchard, and were concerned that the oaks were crowding out the fruit trees. Additionally, they reviewed the status of the Oaks planted along Saratoga Avenue and realized that they would start to screen out views of the orchard along that street in the near future. All in all, the commission recommended to the City Council that they remove a total of six oak trees too large to move, two fir trees and one orange tree. They recommended transplanting the five small oak trees along Saratoga Avenue to the median on Fruitvale Avenue, and leaving an additional large oak which is suitable for transplanting for an entry statement on the new Gateway project along Saratoga Sunnyvale road, near Prospect Ave. This was noticed and brought to the City Council on March 20th. At that time the Council directed that the staff go back and obtain more bids for the work. Staff noticed the item again for the Council meeting of April 3rd, and at that time, the City Council approved the removal of all trees noted above but for the orange tree, and authorized the transplanting of the 5 oaks along Saratoga Avenue to Fruitvale. The larger oak tree suitable for transplanting will be made part of the Gateway project when that project goes out to bid. The City will obtain all necessary permits to remove the trees in the orchard. It is hoped that the transplanted trees will one day grow to replace the trees cut down from the Fruitvale median. I hope it is apparent from the forgoing that the City did not arbitrarily decide to remove the trees without a long process of input from its boards and commissions, and several publicly noticed Council meetings. We are all looking forward to the future restoration of the City's Heritage Orchard, and appreciate your concerns for the oak trees and the City's decision process. I must of missed any notice of a public discussion or even coverage in the Saratoga News paper. Trees like this are frequently found in orchards and farm fields where they offer a respite from the summer heat? I recall all of the outrage of a contractor cutting oak trees, so I am curious about the process the city used for this decision. Was this done on the recommendation of the city arborist? Are they diseased? Was a permit obtained? Were the neighbors notified with a period to object such as I had to do to remove even a large tree blown over in a windstorm? If no permit has been issued and the contractor selected has to obtain one will there be public input? I know it is difficult to make decisions such as this in a fishbowl of sorts, but in the wake of the West Valley College trustees actions on the stadium issue one begins to see conspiracies at every turn - is this the first step in putting soccer fields in place of the Orchard? We also saw all of the Oaks in the median of Fruitvale between Allendale and Douglass cut down several years ago and never replaced, so there is community concern about the necessity of this action and its propriety. Don't expect 100 letters. There isn't time before your vote. You may, however, get a large response later, if the trees are cut down. I urge you to preserve the trees by the creek and— unless there is definitive information from the HPC, Mr. Novakovich, and one or more arborists that the trees in question must go —to leave most of the trees in. The birds planted an oak tree in our front yard. We cut the small tree down, but it kept coming back. That oak was not in our plan, but our neighbor agreed with us that the tree "wanted to be there" and so we decided to yield to nature. Before it's too late, please know that I and many others strongly oppose removing any more trees for the purpose of installing a "bani" or structure large enough that it could be turned into a sports center. We do not need another building as a gathering place or to house educational materials. Educational efforts should start inside our beautiful new library -to -be and move through the orchard. We had feared that the distruction of the oaks and fir /silk trees had been decided without the public knowing that the matter was still up for decision. There would have been more input had a notice of proposed action been published sooner and more widely. Many of us thought it was a fait accompli. Now that the council has wisely decided to seek all possible relevant material. from the Heritage Preservation Commission, the City Planning Staff, the city arborist, the orchardist and concerned citizens there is reason to believe that a well reasoned decision will be made. Personally, I would like to see the orchard preserved as is. There have already been huge incursions into the size and beauty of the grove. Native oak trees and firs add character to the area. The city is not concerned with having a profitable operation because it probably is not a viable expectation. Most people with whom I have spoken and heard from just want a beautiful, park -like setting to be enjoyed visually and aromatically. Large oaks with their spreading branches would provide a wonderful place for a few chairs or benches where citizens can sit and take in the peaceful, natural sights and smells around them. The most disturbing thing heard last night was mention of turning the ground into sports fields, later, or releasing the ground to developers to build houses on. That certainly is contrary to the council's resolution to "preserve the Heritage Orchard in perpetuity ". To even entertain such notions is odious and would definitely break faith with the majority of the population who have expressed the desire to preserve the orchard. The property belongs to the people of Saratoga and should not, willy nilly, be desecrated for any such purpose, and that includes construction of a "barn" large enough to be converted into a sports venue, with attendant locker rooms, parking lot, bleachers, lighting, etc. at some later date. For educational purposes what better place than the beautiful new library. If there is room for a coffee shop, there certainly is room for an educational nook devoted to materials, pictures and class schedules about the orchard in which the library sits. It appeared in the Letters to the Editor section of the Saratoga News on May I". The city of Saratoga. is at it again! First, they plan to destroy about 2 dozen mature trees that provide a beautiful canopy along Bohlman :1Zoad between Madronia Cemetery and Norton Road. 'Now, they have plans to cut down or transplant 11 live oaks in the Heritage Orchard. Doesn't the term "heritage" imply that these trees are to be protected? When Matt Novakovich, whose has maintained-the orchard. with his family since 1978, explained why these; trees are an important part of the ecosystem of the area, the city blamed him and his family for not speaking up at earlier council meetings. The Novakovichs' priorities are correct. Why does the city need "to restore the professional look of the orchard "? Since when is an orchard supposed to look professional? If smaller fruit trees are damaged by the roots and canopy of the oaks, then so be it. Fruit trees only live about 25 years and are easily replanted. These oaks have been here longer than the City itself and should be preserved! I believe most Saratogans would rather have the Heritage Orchard left as is instead of replaced with an irrigation system, a maintenance storage shed and an educational center. So much of Saratoga's character depends upon its natural beauty and undeveloped areas. Perhaps the members of the City Council and Planning Commission who so cherish development should go work and live in San Jose where they would find greater fulfillment.
