It was moved and seconded to waive the reading of the minutes of
January 15, 1981 and approve as distributed. The motion was
carried unanimously.
II. SINGLE SITE APPROVAL
A. SDR -1481 - Wesley and Barbara Behel, Peach Hill, Tentative Build -
in,c� Site Approval - 1 Lot
The applicant's engineer, Richard Lane, was present for this
discussion. The Staff explained that the applicant was requesting
Building Site Approval for a lot of record on Peach Hill Road.
Significant acacia, eucalyptus and oak trees exist on the site,
several of which are proposed for removal with the construction of
the driveway and the residence. The major concern with the develop-
ment of the site is the lack of the required amount of water for
fire protection, with only a water flow of 749 gpm, according to
San Jose Water Works. The site had been conditioned in the Staff
Report for the required 1,000 gpm for two hours. Achieving this
condition may require substantial monies be spent for improvements
to the water system. Addditionally, Staff noted that the flat pad
shown on the preliminary maps around the proposed residence had
been removed on the tentative map.
Mr. Robinson questioned the need for a circular driveway, with the
applicant's engineer responding that, while it was not necessary,
such driveways were common in the area. It was then noted that
the site was conditioned for design review, and thus the driveway
could be considered at that time. The applicant's engineer
expressed a desire to protest the 1,000 gpm for two hours condition,
as well as the conditions for road improvements. It was then
explained that such an appeal would have to be taken up with the
City Council. The LDC reviewed the drainage for the driveway and
the street improvements. Staff stated that all recent site
approvals on Peach Hill., of which there have not been a significant
number, have been conditioned to do similar street improvements.
They involve widening with a V ditch for the drainage with no
formal curbing.
Mr. Robinson requested that the Staff Report be amended to state
under Comments, A. "Tree removal prohibited unless in accord with
applicable City ordinances. No trees are to be removed until
Final Building Site Approval is obtained." Additionally, the
Planning Department condition was to be modified to read: "Design
Review Approval required on project prior to issuance of permits.
Driveway to be reviewed and approved at that time."

It was moved and seconded to approve the Negative Declaration for
SDR -1481. The motion was carried unanimously. A motion was made
and seconded to grant approval to SDR -1481, per the amended Staff
Report. Mr. Shook stated to the applicant's engineer that if he
wished to appeal of these conditions, he needed to do so within
15 days with the City Clerk's office.

ing Site Approval - 2 Lots, Request for a Second One -
Year Extension
Commissioner Laden questioned whether the cleaning of the yard
could be tied to this extension. Mr. Shook stated that recent
court cases did not allow them to be so tied. It was also noted
that advisory agencies are not allowed to add conditions at the
time of an extension. However, it could be brought before the
Planning Commission to be set for a public hearing, in order to
revoke the use permit. The LDC then noted that the time for request
for an extension had expired, but was concerned about acting on
this item at the meeting because of the condemnation agreement on
Gerald. Zapelli Court. Staff was directed to check with 1�aber
Johnston to see if the settlement did affect the site approval
expiration before any action be taken. It was directed that this
item be continued to the meeting on February 19, 1981.
C. SDR -1426 - Parnas Corp., Pierce Road, Tentative Building Site
Approval, 4 Lots, Request for a One -Year Extension
The LDC reviewed the request for an extension with Mr. Borello
present. It was moved and seconded to approve the one -year exten
sion for SDR -1426. The motion was carried unanimously.
IV. ADJOURNMENT
It was moved and seconded to adjourn the meeting. The motion was
carried unanimously.
