PLACE: Crisp Conference Room, 13777 Fruitvale Avenue, Saratoga, California TYPE: Hearing before Acting Planning Director relative to Ordinance NS-32C-73 (Two -Story Conversions), Continued from February 27, 1974. I. ROUTINE ORGANIZATION The hearing was called to order by Acting Planning Director at 4:00 P.M. A. ROLL CALL Present: Charles R. Rowe, Acting Planning Director; Donald R. Burt, Planner I; Nancy Marek, Recording Secretary. II. PUBLIC HEARINGS A. UP -231 - Michael L. Stepovich, Arden Court - Request to Permit a Two -Story Conversion Secretary asked Planner if specifics of Code (as to height, coverage and setbacks) had been met. Planner replied "yes ", that they had been met at the last public hearing on February 27, 1974, but this matter was extended one week. There had been no more communication opposing this application. Secretary granted the Use Permit granting the Two -Story Conversion, as per Staff Report dated February 27, 1974, and Exhibit "A ". B. UP -233 - Paul J. Friedl, Via Blanc - Request to Permit a Two -Story Conversion Secretary acknowledged receipt of letter from Paul_ J. Friedl, requesting reconsider- ation of the Staff Report dated February 27, 1974. Planner read Staff Report relative to this matter, dated February 27, 1974, stating that UP -233 exceeded the 20% coverage established in the Two -Story Ordinance, and that the north side yard setback is insufficient for a two -story structure. John Endaverry, architect in this matter, was present and Secretary told him that he must draw new plans (Exhibit "B ") that conform to the Code. There was no further correspondence opposing UP -233. Secretary explained that upon receipt of revised plans (Exhibit "B ")that conform to the Code and there is no further correspondence opposing this two -story conver- sion, a Use Permit in all probability will be granted. Secretary continued the Hearing on UP-233 to Wednesday, March 13, 1974 in the Crisp Conference Room at 4:00. C. UP -234 - Marianne Montgomery, Lomita Avenue - Request to Permit a Two -Story Conversion Secretary asked Planner if there had been new plans submitted. Planner replied "yes ". There had been no further correspondence opposing UP -234. Secretary explained that although this was a legal non - conforming lot, the sideyard setbacks must be adjusted to conform with the Code. Mr. Robert Rasmussen, 20611 Lomita Avenue:, objected to the two -story conversion on the grounds that the deck was too close to his house, objecting more to the deck than the two -story garage, and also to the possibility of plumbing. Architect in this matter, Cliff_Petersen', replied there was no plumbing in the conversion, and that the deck was so large because beneath it is a turn - around for Mrs. Montgomery's car. Secretary asked if it was possible to alter plans regarding the deck to move it back and in from the sideyard to minimize the impact, or to put plantings on. the side, or to put a redwood physical screen on the sideyard. Architect and David Montgomery replied that there were already trees on the sideyard and they would put more plantings in, that a physical screen was possible, and he would alter the plans regarding the sideyard setback, to possibly minimize the impact of the decking. Secretary explained that upon receipt of revised plans that conform to the Code as to sideyard setbacks, minimizing the impact of the decking and no further correspondence opposing this Use Permit is received, a Use Permit will in all probability be granted. Secretary continued the Hearing on UP -234 to Wednesday, March 13, 1974 in the Crisp Conference Room,at 4:00 P.M. D. UP -235 - William Paul Walter, Foothill Lane -- Request to Permit a Two -Story Construction Secretary asked Planner if there had been any more correspondence opposing UP -235. Planner replied "no ". Secretary told Mr. Walter that he was in an R -1- 20,000 lot, not $ -1- 40,000. New plans had been submitted (Exhibit "B "), that were in conformance with the Code. Secretary granted the Use Permit requesting a Two -Story Construction,_ as per Staff Report dated February 27, 1974 and Exhibit "B". D. UP -236 - Donald Lorenzen, DeSanka Avenue - Request to Permit a Two -Story Conversion Secretary stated that correspondence had been received from Mr. Lorenzen, requesting continuance of UP -236. Secretary continued UP -236 to Wednesday,, March 13, 1974, in the Crisp Conference Room at 4:00 P,M. III. ADJOURNMENT The Hearing was closed at 5:15 P.M., with UP -233, UP -234 and UP -236 being continued to Wednesday, March 13, 1974 in the Crisp Conference Room at 4:00 P.M. Charles R.
