PLACE: Crisp Conference Room - 13777 Fruitvale Avenue, Saratoga, California TYPE: Hearing Before Planning Director Relative to Ordinance NS- 3,ZC -73 (Two - Story Conversion) I. ROUTINE ORGANIZATION The meeting was called to order by Planning Director at 3:00 P.M. A. ROLL CALL Present: Marty VanDuyn, Planning Director; Don Burt, Planner I; Nancy Marek, Recording Secretary. Mr. VanDuyn reviewed the intent and purpose of the.Two- Story Ordinance NS= 3.ZC -73 and mentioned that No.ti'ces of:Hearing were duly sent.to the Saratoga News and surrounding neighbors,. II. PUBLIC HEARINGS A. UP -246 - Kosich Construction Company,..Verde Court (Tract 5328,'Lot 3) - Request for Two -Story Use'Permit to Allow'`the Construction'of Two- �Stbry Home Planning Director stated there were five (5) letters received opposing the construction of a two -story house on Verde Court. The letters were. as follows: Mr. Owen D. Jacobsen 20631 Woodward Court Mr. George Paul Buchanan 13796 Tamworth Avenue Mr. and-Mrs. John B. Erixon 20668. Seaton Mr. and Mrs. William Lawson 13818 Tamworth Avenue- Mrs. Betty J.' Bunoski 20600 Verde Vista Lane Director stated that this application was continued from July 24, 1974, for the builders, Kosich Construction Company, to ask the lot owners.if they would consider a one -story home-, for which the.lot is suitable.. Mr. Kosich :stated the owners wanted to continue the Use Permit Public Hearing for a two -story home. A member of the audience said Mr. _Mauri, 20552 Verde Court, had changed his mind about this application; that he was now against a.2 -story home.. Mr. Kosich stated that Mr. Mauri had said nothing to him about changing his mind. There was no letter received from Mr. Mauri stating he had changed his mind. Director asked Planner if the basics of the'Code (as to Height, coverage, rear and sideyard.setbacks) had been met. Planner replied "yes ". Secretary asked Planner if there were any other 20story houses contiguous. Planner replied "no ". - Planner read Staff Report dated August 14,' 1974, recommending denial of this application for the reasons that "there'are.no. existing two -story structures adjacent or contiguous to this lot" and "invasion of privacy ". Director explained that a one -story house could be built on the site, that he was not denying the use of the site. Director explained that the denial of this application could be appealed to the City Council within ten days. Mr. Kosich stated that he would do so. Director closed hearing at 3:30 P.M. B. UP -247 - Marilyn Uzzardo, McCoy Avenue - Request for Use Permit for Two -Story Conversion of Existing Residence Director asked Planner if the basics of the Code (as to height, coverage rear and sideyard setbacks) had been met. Planner replied "yes ". Secretary asked Planner if there were any other 2''story houses contiguous. Planner replied "no ". There was no correspondence in this matter. Planner read Staff Report dated August 14, 1974, relative to UP -247, recommending approval of this matter, with the changes as shown on Exhibit "A ". Hearing was closed at 3:45 P.M. III. ADJOURNMENT The meeting was adjourned at 3:45 P.M. Marty VanDuyn, Secretary
