ROUTINE ORGANIZATION A. Roll Call Committee Members Present: B. Minutes R. S. Shook, R. S. Robinson, and Commissioner Zambetti It was moved and seconded to waive the reading of the minutes of October 16, 1980 and approve as distributed. The motion was carried, with Commissioner Zambetti abstaining since he was not present at the meeting. , II. SINGLE SITE APPROVAL A. SDR -1479 - M. $ G.-Anderson, Farwell, Tentative Building Site Approval - 1 Lot (over 50% expansion) Mrs. Anderson and Oscar Sohns were present for the discussion. The LDC reviewed the plans for the expansion and questioned the construction of a guest -house on the site. Mrs. Anderson explained that it was to be a studio, with potential use as a guest -house for out -of -state relatives. No kitchen facilities were proposed. The LDC discussed the guest -house at length and determined that such a use was allowed by the Zoning Ordi- nance. However, they indicated that the minutes should reflect that it was not to be used as a second dwelling unit, and that its prime use was to be as a studio. When questioned, Mr. Wimberly indicated that the grading and drainage plan for the site could be taken care of at the time of building permit. The LDC asked about the sewer easement shown on the map, and Mrs. Anderson responded that it was being worked out. The street improvements were discussed. It was explained that there was an irregularity with the vertical alignment between the George Day subdivision and this site, that would need to be corrected with this approval. Additionally, the lot on the other side of the site had recently entered into a Deferred Improvement Agreement for such improvements. If improvements were required with this site approval, then that Agreement would be called. The LDC decided to require the improvements with this site, since it was adjacent to such improvements (George Day subdivision) and was a standard condition. It was moved and seconded to approve SDR -1479. The motion was carried unanimously. III. PUBLIC HEARINGS A. SDR -1470 - Dick Gabler, Piedmont and Park, Tentative Building Site Approval - 2 Lots - and Negative Declaration; Continued from 10/16/80 Staff explained that a new map had been submitted on this site, showing a side setback greater than the requested 25 ft., but that in order to do this, the proposed house and driveway would remove several significant trees. Additionally, it was noted that the text of the General Plan stated that all new sites in this area, although zoned R -1- 20,000, be at least an acre in size. Having discussed this with the City Attorney, it was suggested that the LDC not approve this application until it was brought into conformance with the General Plan text. - 1 - Lan& Development Committee Page 2 `Minutes - 11/6/80 SDR -1470 (cont.) The public hearing was reopened at 10:45 a.m. Mr. Ed Stelling questioned the finding of consistency with the General Plan that had been made for the subdivision on Mendel- sohn, also in Area I of the'General Plan. He also noted that the statement read that the lots "should be" an acre in size, rather than "shall be ", and he was hoping that this could be taken into consideration. Additionally, he pointed out that the site was used as a lovers lane and that the neighbors would be pleased if it were developed. The LDC discussed the creek that traversed the middle of the proposed site and expressed concern over the creation of a new site at this particular location. Commissioner Zambetti stated that he was not that concerned with the loss of a few trees in the area; however, he could not make the finding that the site would be consistent with the General Plan. He, therefore, recommended that the Planning Department take the General Plan problem before the City Council as soon as possible. Mr. Robinson stated that he was concerned with the retaining wall as proposed, and that the General Plan was not in conformance with the proposal. Mr. Stelling explained that he had checked the site initially and was not given a flat no for the proposed half -acre development. Mr. Robinson then stated that he would process a modification to the General Plan to clarify the. General Plan map with the General Plan text. Commissioner Zambetti re'commended'that the item be continued, with the understanding that Staff would take this item before the City Council to ask their interpretation of the 1974 General Plan. Commissioner Zambetti stated that he did not want to deny the proposal, but he wanted some direction within 60 days from the City Council'. Mr. Robinson stated that he could take it before the Planning Commission on December 2, 1980 and then on to the City Council in February 1981. He then explained that the Mendelsohn Subdivision had been found to be consistent with the General Plan, in that the site was different from that proposed, flat versus a steep sloped area, etc. He also explained that there had been a change in direction of the City with the new City Council elected in April of 1980. With the applicant agreeing, the LDC directed that this item be continued off the calendar until the consistency with the General Plan had been determined. It was moved and seconded to close the public hearing. The motion was carried unani- mously. IV. MISCELLANEOUS A. Mr. and Mrs. Corcoran, 14437 Sobey Road, Modification to a Site Development Plan for a swimming pool The LDC reviewed the plans and noted that the plot plan showed three retaining walls, while the-cross-sections showed two. It was directed that this item be continued in order to look at the site and to clarify whether the proposal was for two or three retaining walls. This item will be agendized for the November 20, 1980 meeting. B. SDR -1475 - Helen Amato, Saratoga Avenue, Reconsideration of Tentative Building Site Approval - 4 Lots Mr. Kirkeby presented a new map showing the cul -de -sac located southwest of the original approved map. The LDC reviewed the number of trees proposed for removal and the net acreages of each site. It was moved and seconded to approve the modifica- tion to SDR -1475, per Exhibit "B -2" dated October 30, 1980.
