PLACE: City Council Chambers, 13777 Fruitvale Avenue, Saratoga California TYPE: Hearing before Acting Planning Director relative to Ordinance NS- 3.ZC -73 (2 -Story Conversion) I. ROUTINE ORGANIZATION The meeting was called to order by Acting Planning Director at 5:30 P.M. A. ROLL CALL Present: Charles R. Rowe, Acting Planning Director; Donald R. Burt, Planner I; Nancy Marek, Recording Secretary. Mr. Rowe introduced the Staff members present, and reviewed the intent and purpose of the Two -Story Ordinance NS- 3.AZ -73. II. PUBLIC HEARINGS A. UP -231 - Michael L. Stepovich, Arden Court - Request to Permit a Two -Story Conversion The Secretary asked the Planner if the basics of the Code (as to height, coverage rear and sideyard setbacks)had been met. Planner replied "yes ". Secretary asked Planner if there were any other 2- story houses contiguous. Planner replied "yes, to two other 27s:torys ". Secretary asked if an architect had been employed in this matter. Planner replied eyes ". There was no correspondence in this matter:. Secretary stated that the public was invited to review copies of architectual plans submitted to the City in the Office of the Planning Department. Planner read Staff Report dated February 27, 1974, relative to UP -231, which recommended approval for Request to Permit a Two -Story Conversion. Arthur Lund, 1st National Bank Building, San Jose, California, attorney for Michael Stepovich, asked for the matter to have Final Planning Commission Approval, since all the people 500 feet away had been notified and there were no objections from the audience and no correspondence. Secretary explained how Use Permits are heard twice in a public hearing to review plans, to consider impact of Staff Report and give neighbors a chance to respond. Secretary continued UP -231 to Wednesday, March 6, 1974, to the Crisp Conference Room at 4:00 P.M. Hearing closed at 5:40 P.M. B. UP -233 - Paul J. Friedl, Via Blanc - Request to Permit a Two -Story Conversion The Secretary asked the Planner if the basics of the Code had been met. The Planner replied that they had not as to maximum coverage and side yard setback. Secretary asked Planner if there were any other 2 -story houses contiguous. Planner replied there was one two -story house in back of said house. Secretary asked if an architect had been employed. Planner replied "yes ". `February 27, 1974 Minute There was no correspondence relative to this matter. Secretary stated that the public was invited to review copies of architectural plans submitted to the City in the Office of the Planning ^epartment. Planner read Staff Report dated February 27, 1974, relative to UP -233, which recommended denial for Request to Permit a Two -Story Conversion. Terry Ansnis, 13225 Via Grande Ct., who lives in a two -story house, objected to UP -233 on the grounds that his view of the hills is impaired by a 2 -story house. Secretary invited Mr. Ansnis to come into the Planning Department office to view the plans. Mr. Samuel Reisman, 13241 Via Blanc, objected on the grounds that UP -233 will cut out the sky on 2- bedrooms on the eastern portion of his house. Secretary responded by saying to come into the office and view the plans for the house. Secretary explained how Use Permits are heard twice in a public hearing to review plans, to consider impact of Staff Report and give neighbors a chance to respond. Secretary continued UP -233 to Wednesday, March 6, 1974, to the Crisp Conference Room at 4:00 P.M. C. UP -234 - Marianne Montgomery, Lomita Avenue - Request to Permit a Two -Story Conversion Secretary asked the Planner if the basics of the Code had been met. Planner stated that the setbacks were deficient in both rear and side yard. Secretary asked if there were any other 2 -story houses contiguous. Planner replied that there were n_ o two - stories contiguous, h,tt there .,ere some in the neighborhood. Secretary asked if an architect had been employed. Planner replied "yes." Secretary asked if there was any correspondence relative to this matter. Planner replied there was, from Mr. Adolph Lincoln Bliss, 20655 Lomita Avenue, Saratoga, California, with 16 signatures of residents in the area opposing UP -234. Secretary stated that the public was invited to review copies of architectural plans submitted to the City in the Office of the Planning Department. Planner read Staff Report dated February 27, 1974, relative to UP -234, recommending denial for Request to Permit a Two -Story Conversion. Marianne Montgomery, 14231 Juniper Lane, Saratoga, applicant in the Use Permit, responded by saying that from the street one can't tell it is a 2- story, there are no windows on the 2nd story to see the neighbors, and they plan on an over- all landscaping plan for the property. Cliff Petersen, architect in this matter explained that he will make the adjust- ments in the rear and side yard setbacks. He said they drew the plans this way in order to get parking off the street. Secretary explained that these two were only technical objections, and a Variance may have to be obtained. Robert Rassmussen, 20611 Lomita Avenue, objected by saying that the property is rental. property, there is constant on- street parking, even in front of his home, the yard is in constant disarray, and he wants to see it not used as a rental. Cliff Peterson, architect, said that he will make the adjustments in the setbacks and bring them into the Office of the Planning Department. Secretary continued UP -234 to Wednesday, March 6, 1974, to the Crisp Conference room at 4:00 P.M. Hearing closed at 6:04 P.M. -2- .February 27, 1974 Minute D, UP --235 - William Paul Walter, Foothill Lane - Request to Permit a Two -Story Construction Secretary asked Planner if the basics of the Code had been complied(as to height, coverage rear and side yard setbacks). Planner replied "yes ". Secretary asked Planner if there were any other 2 -story houses contiguous. Planner replied there was one -two story house adjacent. Secretary asked Planner if an architect had been employed in this Use Permit application. Planner replied "yes ". Secretary asked if there was any correspondence relative.to this matter. Planner replied "yes ", from Dr. Walter W. Silberman, 12821 Foothill Lane, and Mr. Charles Oveland, 12901 Foothill Lane, both opposing UP -235. Secretary stated that the public was invited to review copies of architectural plans submitted--to the City in the Office of the Planning Department. Planner read Staff Report dated February 27, 1974, . relative to UP -235, which recommended approval of UP -235. Dr. Walter Silberman, 12821 Foothill Lane, objected to the granting of UP -235, on the grounds that he has a completely enclosed pool and was skeptical of a 2 -story home looking down upon him. He also objected.because he didn't want eucalyptus trees cut down. He wanted to know if Foothill Lane would have to be brought up to County standards if William Paul Walter Caere to build there. Secretary directed him to Department of Public Works for the answer to that question. William Paul Walter assured Dr. Silberman that there were no second story windows facing his pool or a tree loss. Pat Bailey, 12861 Foothill Lane talked to Public Works, who said the street would have to be improved to the extent of leaves being sweeped, etc. She said the street did not need to be widened; for it to be widened, you must dedicate it to the City. She also objected to the two - story construction on the grounds that she didn't want to set a precedent, it was not in keeping with the street, since there were largely single -story homes there. Secretary directed a letter regarding the widening of Foothill Lane to Dr. Silberman. Secretary explained how Use Permits are heard twice in a public hearing to review plans, to consider impact of Staff Report and give neighbors a chance to respond. Secretary continued UP-235, to Wednesday, March 6, 1974, to the Crisp Conference Room at 4:00 P.M. Hearing closed at 6:26 P.M. E. UP -236 - Donald Lorenzen, DeSanka Avenue - Request to Permit a Two -Story Conversion Secretary asked Planner if the basics of the Code (as to height, coverage, rear and side yard setbacks) had been met. Planner replied that it met the setbacks, but exceeded the maximum coverage allowed to two -story structures. Secretary asked Planner if there were any other two -story contiguous. Planner replied that there were no other 2 -story houses contiguous. Secretary asked if an architect had been employed in this Use Permit application. Planner replied "no ". Secretary asked if there was any correspondence relative to this matter. Planner replied "yes ", from Mrs. Vicki Wilson, 20190 Cherry Lane,,.opposing UP -236. Secretary explained that the public was invited to review copies of architectural plans submitted to the City in the Office of the Planning Department. M--M February 27, 1974 Minute- Planner read Staff Report dated February 27, 1974, relative to UP -236, which recommended denial of UP -236. Mr. Lorenzen stated that he went to all the neighbors with the plans for his two -story conversion and none objected to them. Secretary explained that Mr. Lorenzen must make adjustments as to the technical objection of exceeding the maximum coverage.
