HomeMy WebLinkAbout04-05-2017 City Council minutesMINUTES WEDNESDAY, APRIL 5, 2017 SARATOGA CITY COUNCIL REGULAR MEETING At 6:00 p.m., the City Council held a Joint Meeting with the Sheriff's Office in the Administrative Conference Room at 13777 Fruitvale Avenue. At 7:04 p.m., Mayor Lo called the Regular Session to order in the Civic Theater at 13777 Fruitvale Avenue and led the Pledge of Allegiance. ROLL CALL PRESENT: Mayor Emily Lo, Vice Mayor Mary -Lynne Bemald, Council Members Manny Cappello, Rishi Kumar ABSENT: Council Member Howard Miller (excused) ALSO PRESENT: James Lindsay, City Manager Richard Taylor, City Attorney Crystal Bothelio, City Clerk/Asst. to City Manager Mary Furey, Finance & Administrative Services Director Erwin Ordofiez, Community Development Director Michael Taylor, Recreation & Facilities Director Kirk Heinrichs, Special Projects Manager REPORT ON POSTING OF THE AGENDA City Clerk Crystal Bothelio reported that the agenda for this meeting was properly posted on March 31, 2017. REPORT FROM JOINT MEETING Captain Rich Urena provided an overview of the Sheriff's Office Joint Meeting with the City Council. Council Member Kumar requested that the presentation slides from the Joint Meeting be shared with the public on the City's website. ORAL COMMUNICATIONS ON NON-AGENDIZED ITEMS Scott McIntyre announced the 5th annual Hindu Festival. Nancy Kirk raised concerns regarding the Silicon Valley Clean Energy postcard sent in the mail. She found it confusing and noted residents may not be fully informed of the Silicon Valley Clean Energy implementation. Vinnie Gupta shared information about a free college seminar on April 23 at the Joan Pisani Community Center. Jill Hunter announced that America in Bloom judges will be visiting Saratoga May 17 through 20. She invited the City Council to welcome the judges to Saratoga. Saratoga City Council Minutes — Page 1 of 7 ANNOUNCEMENTS Mayor Lo presented the Tree City USA plaque recognizing the City's 10 year anniversary as a Tree City USA. She invited Council Member Cappello to provide additional information. Council Member Cappello announced the City's 2020 by 2020 tree planting challenge to encourage residents to plant trees. Mayor Lo announced State of the City on April 15, 2017 and Arbor Day on May 1, 2017. CEREMONIAL ITEMS Proclamation Declaring April 9-15, 2017 as National Library Week Recommended Action: Present the proclamation to the Saratoga Librarian, Michael Eitner. Mayor Lo and the City Council presented the proclamation declaring April 9-15, 2017 as National Library Week to Saratoga Librarian Michael Eitner and representatives of the Saratoga Library. Appointment of Planning Commissioners & Oath of Office Recommended Action: Approve the attached resolution appointing 2 members to the Planning Commission; and direct the City Clerk to administer the Oath of Office. RESOLUTION NO. 17-015 CAPPELLO/BERNALD MOVED TO APPROVE THE ATTACHED RESOLUTION APPOINTING 2 MEMBERS TO THE PLANNING COMMISSION; AND DIRECT THE CITY CLERK TO ADMINISTER THE OATH OF OFFICE. City Council Meeting Minutes Recommended Action: Approve the City Council minutes for the Regular City Council Meeting on March 15, 2017. Community Development Block Grant Amended Agreement & Budget Adjustment Resolution - Saratoga Senior Center Restroom ADA Upgrades Recommended Action: Authorize the City Manager to execute the amended Community Development Block Grant agreement and adopt the resolution for a budget adjustment amending the Fiscal Year 2016/17 Capital Budget. RESOLUTION NO. 17-016 BERNALD/CAPPELLO MOVED TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE AMENDED COMMUNITY DEVELOPMENT BLOCK GRANT AGREEMENT AND ADOPT THE RESOLUTION FOR A BUDGET ADJUSTMENT AMENDING THE FISCAL YEAR 2016/17 CAPITAL BUDGET. MOTION PASSED. AYES: LO, BERNALD, CAPPELLO, KUMAR. NOES: NONE. ABSTAIN: NONE. ABSENT: MILLER. 1.5. Saratoga Senior Center Restroom ADA Upgrades — Award of Construction Contract Recommended Action: 1. Award contract for construction of the Senior Center ADA Restroom project to Bp Pac, Inc. Construction in the amount of $141,287 and authorize the City Manager to execute the agreement. 2. Move to authorize staff to execute change orders to the contract for unforeseen circumstances up to $16,248. BERNALD/CAPPELLO MOVED TO: AWARD CONTRACT FOR CONSTRUCTION OF THE SENIOR CENTER ADA RESTROOM PROJECT TO BP PAC, INC. CONSTRUCTION IN THE AMOUNT OF $141,287 AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND AUTHORIZE STAFF TO EXECUTE CHANGE ORDERS TO THE CONTRACT FOR UNFORESEEN CIRCUMSTANCES UP TO $16,248. GENERAL BUSINESS 3.1. 2017 Tree Lighting Date Recommended Action: Consider request from Saratoga Chamber of Commerce to schedule the 2017 Tree Lighting event on the Friday after Thanksgiving. Mayor Lo invited a student in the audience to introduce herself. 3.2. Senior Transportation Recommended Action: Consider senior transportation and request from the Saratoga Area Senior Coordinating Council (SASCC) to allocate $20,000 in the Fiscal Year 2017/18 Budget for senior transportation. Village Policy Update Process — Phase I Recommendations Recommended Action: Review and affirm the Planning Commission recommendations for Phase I of the Village Policy Update Process. BERNALD/CAPPELLO MOVED TO AFFIRM THE PLANNING COMMISSION'S RECOMMENDATIONS FOR PHASE I OF THE VILLAGE VISION POLICY UPDATE WITH REMOVAL OF THE WORD, ECONOMICALLY, FROM THE INTRODUCTORY PARAGRAPH AND CONSIDER POLICY 18.1 AT A FUTURE CITY COUNCIL MEETING. Due to the lack of a second, the motion failed. Council Member Cappello withdrew his permission. Mayor Lo agreed to withdraw the motion. The City Council then voted on the motion made by Vice Mayor Bernald and seconded by Council Member Cappello. BERNALD/CAPPELLO MOVED TO AFFIRM THE PLANNING COMMISSION'S RECOMMENDATIONS FOR PHASE I OF THE VILLAGE VISION POLICY UPDATE WITH REMOVAL OF THE WORD, ECONOMICALLY, FROM THE INTRODUCTORY PARAGRAPH AND CONSIDER POLICY 18.1 AT A FUTURE CITY COUNCIL MEETING. Erwin Ordonez, Community Development Director, presented the staff report. Mayor Lo invited public comment on the item. COUNCIL ASSIGNMENTS Mayor Emily Lo West Valley Mayors and Managers —VTA Executive Director Nuria Fernandez attended the last meeting to provide an update on Next Network. The County's senior transportation pilot proposal was also discussed. Vice Mayor Mary -Lynne Bernald Saratoga Historical Foundation — at the March 16 meeting, the Board discussed the funds raised for the Peck Bronzes and the bench for the artwork. Vice Mayor Bernald shared she attended a League of California Cities Peninsula Division event on Prop 64 and legalization of marijuana. She also attended the Muslim Cultural Day and the Saratoga City Council Minutes — Page 6 of 7 Living Room Conversations event. She shared that she has been working with the County, Michael Taylor, and representatives of Redwood Middle School to place a compost box at Redwood Middle School and conduct training on composting. Council Member Manny Cappello Saratoga Area Senior Coordinating Council (SASCC) — the Board is working with Michael Taylor on the contract between SASCC and the City. The agreement is scheduled to come before the City Council on May 17. Council Member Howard Miller No report Council Member Rishi Kumar Saratoga Chamber of Commerce & Destination Saratoga Saratoga Sister City Organization — the group discussed their upcoming trip. There are only a few spots left. The group also considered additional sister cities in China or Taiwan. The discussion will continue at a future meeting. Additionally, the group is recruiting Board Members. Santa Clara Valley Water District Commission — Council Member Kumar shared his plans to discuss Letter 501 and 506 submitted by the San Jose Water Company to the Public Utilities Commission at the next Commission meeting.
