WEDNESDAY, MARCH 13, 2019
SARATOGA PLANNING COMMISSION REGULAR MEETING
Chair Hlava called the Planning Commission Regular Meeting to order in the Civic Theater,
Council Chambers at 13777 Fruitvale Avenue in Saratoga at 7:00 p.m. and led the Pledge of
Allegiance.
ROLL CALL
PRESENT: Chair Joyce Hlava, Vice Chair Kookie Fitzsimmons, Commissioners Sunil
Ahuja, Leonard Almalech, Razi Mohiuddin, Lucas Pastuszka, Tina Walia
ABSENT: None
ALSO PRESENT: Debbie Pedro, Community Development Director
Nicole Johnson, Planner II
APPROVAL OF MINUTES
Action Minutes from the Regular Planning Commission Meeting of February 13, 2019.
Recommended Action:
Approve Minutes of February 13, 2019 meeting.
WALIA/FITZSIMMONS MOTIONED TO APPROVE THE MINUTES OF THE
FEBRUARY 13, 2019 MEETING. MOTION PASSED. AYES: HLAVA, FITZSIMMONS,
AHUJA, ALMALECH, MOHIUDDIN, PASTUSZKA, WALIA. NOES: NONE. ABSENT:
NONE. ABSTAIN: NONE.
ORAL COMMUNICATIONS ON NON-AGENDIZED ITEMS
Gayla Johnson spoke in opposition of cell towers and ask the City to pass an urgency ordinance.
The Commission referred the matter to staff.

2. PUBLIC HEARING
2.1 Application MISC19-0013; 13251 Paramount Drive (530-19-130); Lino
Martire/Kier & Wright – Request for a general plan conformity determination for the
vacation of an unused 19-foot wide portion of Saratoga-Sunnyvale Road. Staff Contact:

Recommended Action:
Adopt Resolution No. 19-008 making a general plan conformity determination with
respect to the vacation of an unused portion of Saratoga-Sunnyvale Road.
ALMALECH/PASTUSZKA MOTIONED TO APPROVE A GENERAL PLAN
COMFORMITY DETERMINATION WITH RESPECT TO THE VACATION

OF AN UNUSED PORTION OF SARATOGA-SUNNYVALE ROAD. MOTION
PASSED. AYES: HLAVA, FITZSIMMONS, AHUJA, ALMALECH, MOHIUDDIN,
PASTUSZKA, WALIA. NOES: NONE. ABSENT: NONE. ABSTAIN: NONE.
2.2 Application PDR18-0034; Saratoga-Sunnyvale Road right-of-way near the
intersection of Verde Vista Lane; AT&T Mobility/Joint Pole Association –
Request for Design Review approval to install a microcell site on an existing utility
pole within the public right-of-way. Staff Contact: Christopher Riordan (408) 868-
1235 or criordan@saratoga.ca.us.
Recommended Action:
Adopt Resolution No. 19-003 approving the project subject to conditions of approval
included in Attachment 1.
ALMALECH/HLAVA MOTIONED TO APPROVE WITH CONDITIONS OF
APPROVAL. MOTION PASSED. AYES: HLAVA, FITZSIMMONS, AHUJA,
ALMALECH, MOHIUDDIN, WALIA. NOES: NONE. ABSENT: NONE.
ABSTAIN: PASTUSZKA.
2.3 Application PDR18-0028/ARB18-0043; 13550 La Paz Way (389-22-020); Lands of
Peterson – Request for Design Review approval to construct a 194 square foot single
story addition and a 715 square foot second story addition (maximum height 25.6’).
Five (5) protected trees are requested for removal. The site is zoned R-1-10,000. The
lot size is approximately 11,925 square feet with a General Plan Designation of M-10

Recommended Action:
Adopt Resolution No. 19-007 approving the project subject to conditions of approval
included in Attachment 1.
AHUJA/ALMALECH MOTIONED TO APPROVE WITH CONDITIONS OF
APPROVAL. MOTION PASSED. AYES: HLAVA, FITZSIMMONS, AHUJA,
ALMALECH, MOHIUDDIN, PASTUSZKA, WALIA. NOES: NONE. ABSENT:
NONE. ABSTAIN: NONE.
DIRECTOR ITEMS
Director Pedro announced that Sunil Ahuja was reappointed for another term and Anjali Kausar
was appointed to the Planning Commission.
At their meeting on March 6, 2019, the City Council directed staff to amend the sign ordinance to
prohibit all temporary off-site signs.

COMMISSION ITEMS
Commissioners thanked out-going Commissioner and Chair Joyce Hlava for her service on the
Planning Commission and to the City of Saratoga.
