HomeMy WebLinkAbout09-09-2009 Planning Commission Action Minutes CITY OF SARATOGA PLANNING COMMISSION ACTION MINUTES DATE: Wednesday, September 9, 2009 - 7:00 p.m. PLACE: Council Chambers/Civic Theater, 13777 Fruitvale Avenue, Saratoga, CA TYPE: Regular Meeting ROLL CALL Commissioners Vice-Chair Mary-Lynne Bernald, Manny Cappello, David Reis, Douglas Robertson, Linda Rodgers and Chair Yan Zhao ABSENT Joyce Hlava PLEDGE OF ALLEGIANCE MINUTES Action Minutes from the Regular Planning Commission Meeting of August 26, 2009 (Approved, 6:0) ORAL COMMUNICATION Any member of the Public will be allowed to address the Planning Commission for up to three minutes on matters not on this agenda. The law generally prohibits the Planning Commission from discussing or taking action on such items. However, the Planning Commission may instruct staff accordingly regarding Oral Communications under Planning Commission direction to Staff. ORAL COMMUNICATIONS- PLANNING COMMISSION DIRECTION TO STAFF REPORT OF POSTING AGENDA Pursuant to Government Code 54954.2, the agenda for this meeting was properly posted on September 3, 2009 REPORT OF APPEAL RIGHTS If you wish to appeal any decision on this Agenda, you may file an “Appeal Application” with the City Clerk within fifteen (15) calendar days of the date of the decision, pursuant to Municipal Code 15-90.050 (b). All interested persons may appear and be heard at the above time and place. Applicants/Appellants and their representatives have a total of ten minutes maximum for opening statements. Members of the Public may comment on any item for up to three minutes. Applicant/Appellants and their representatives have a total of five minutes maximum for closing statements. PUBLIC HEARING 1. APPLICATION PDR09-0009 (503-27-052) Lubyanisky, 14340 Paul Avenue - The applicant is requesting Design Review approval for the construction of a new two-story, single-family residence with attached garage located at 14340 Paul Avenue. The total floor area of the proposed residence and garage will be approximately 2877 square feet. One (1) apple tree has been proposed for removal as it is in poor health and in conflict with the design. The net lot size is approximately 7,500 square feet and the site is zoned R-1-10,000. APPLICATION PDR09-0018 (510-06-021) Noble, 19120 Austin Way -The applicant is requesting Design Review approval to demo an existing accessory structure and build a new Secondary Dwelling Unit. The proposed Secondary Dwelling unit will be approximately 791 sq. ft., with an overall total of 6,199 sq. ft. of floor area for all structures located on the property. Per Saratoga Municipal Code Section 15-45.060 (a) (6), Planning Commission Design review approval is required whenever, as a result of proposed construction, reconstruction, or expansion, the floor area of all structures on the site will exceed six thousand square feet. The proposed construction will be located in the rear yard, no taller than 16 feet in height, and consistent in colors and materials with the main structure. The net lot size is 43,647 sq. ft. and the zoning district is R-1-40,000.
