Action Minutes from the Regular Planning Commission Meeting of September 23, 2009 (Approved with changes,
7:0)
ORAL COMMUNICATION
Any member of the Public will be allowed to address the Planning Commission for up to three minutes on matters not
on this agenda. The law generally prohibits the Planning Commission from discussing or taking action on such items.
However, the Planning Commission may instruct staff accordingly regarding Oral Communications under Planning
Commission direction to Staff.

REPORT OF POSTING AGENDA
Pursuant to Government Code 54954.2, the agenda for this meeting was properly posted on October 8, 2009
REPORT OF APPEAL RIGHTS
If you wish to appeal any decision on this Agenda, you may file an “Appeal Application” with the City Clerk
within fifteen (15) calendar days of the date of the decision, pursuant to Municipal Code 15-90.050 (b).
All interested persons may appear and be heard at the above time and place. Applicants/Appellants and
their representatives have a total of ten minutes maximum for opening statements. Members of the Public
may comment on any item for up to three minutes. Applicant/Appellants and their representatives have a
total of five minutes maximum for closing statements.
PUBLIC HEARING
1. APPLICATION PDR 09-0022 / PSP 09-0003 (389-12-019) Ko Architects, 18770 – 18860 Cox Avenue
- The applicant is requesting Design Review (PDR) approval for remodel and facade improvement of the
Quito Village Shopping Center. The existing buildings will be painted with neutral earth tone colors. The
courtyard area will be updated with new pavers, seating, and a fountain. Two existing buildings will be
updated with new store fronts and wood stain finished doors. The applicant is also requesting a Sign Permit
(PSP) for a master sign program for the shopping center. (Cynthia McCormick) ( Design review approved
with changes to plans, 6:1(Rodgers)) (Sign permit continued to the October 28, 2009 meeting, 7:0)
2. APPLICATION CUP 09-0014 / PDR 09-0015 (386-30-039) Time-Space Investment Development
LLC., 12230 Saratoga-Sunnyvale Road - The applicant is requesting Design Review (PDR) and a
Conditional Use Permit (CUP) for an indoor swimming facility in the Commercial-Visitor (CV) zoning
district. The facility would operate in an existing building that will be reduced in size to accommodate 50
parking spaces. A parking and circulation study and traffic impact analysis was completed for the project to
determine the recommended number of parking spaces for the proposed use. (Cynthia McCormick)

3. APPLICATION CUP 09-0004 (393-02-005) Alex Du Von, 20398 Blauer Drive - The applicant is
requesting a Conditional Use Permit (CUP) for a new daycare center in the Professional Administrative
(PA) zoning district. As proposed, the program would serve a maximum of 4 employees and 56 students at
any one time. The facility would operate in an existing 5,000 square foot building. The property has 14
available parking spaces including one (1) handicap space. (Cynthia McCormick) (Denied with
prejudice, 7:0)
