HomeMy WebLinkAboutCity Council Resolution 20-051 Termination of local emergencyRESOLUTION NO.20-051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA PROCLAIMING THE TERMINATION OF A LOCAL EMERGENCY WHEREAS, Saratoga City Code Section 6-05.020 defines an emergency as the actual or threatened conditions of disaster and pursuant to California Government Code Sections 8680.9 and 8558(c), a local emergency is a condition of extreme peril to persons or property proclaimed as such by the governing body of the local agency affected by a natural or manmade disaster; and WHEREAS, the purpose of a local emergency proclamation is to provide extraordinary powers to issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency, obtain vital supplies, and require emergency services of employees; and WHEREAS, on March 16, 2020 at 6:45 p.m., the Director of Emergency of the City of Saratoga did proclaim the existence of a local emergency within the City of Saratoga due to the spread of novel coronavirus (named "COVID-19") and at that time the City Council of the City of Saratoga was not in session; and WHEREAS, the Saratoga City Council adopted Resolution 20-010 on March 18, 2020 finding that the conditions were or are likely to be beyond the control of the services, personnel, equipment, and facilities of the City of Saratoga and that these conditions warranted and necessitated the proclamation of the existence of a local emergency in the City on March 16, 2020 and establish that emergency conditions are ongoing; and WHEREAS, the Saratoga City Council adopted Resolutions 20-019 and 20-031 reaffirming the continued existence of a local emergency; and WHEREAS, Saratoga City Code Section 06-05.050 requires the City Council to review the need to continue to the local emergency periodically and proclaim the termination of the local emergency at the earliest possible date warranted by conditions; and WHEREAS, the Santa Clara County Health Officer and the State of California are taking proactive measures to help prevent and contain the spread of COVID-19; and WHEREAS, there has been substantial and continued progress in slowing the spread of COVID- 19, allowing for many activities and services to resume and the reopening of many businesses, and given the ongoing measures implemented by the Santa Clara County Health Officer and the State of California, current conditions are no longer beyond the control of the services, personnel, equipment, and facilities of the City of Saratoga. NOW, THEREFORE BE IT RESOLVED THAT the City Council of the City of Saratoga does hereby acknowledge that current conditions are no longer beyond the control of the services, personnel, equipment, and facilities of the City of Saratoga and proclaims the termination of the local emergency due to the spread of COVID-19. The above and foregoing resolution was passed and adopted at a special meeting of the Saratoga City Council held on the I s' day of July 2020 by the following vote: AYES: Mayor Howard A.
