Teleconference/Public Participation Information to Mitigate the Spread of COVID‐19
This meeting will be held entirely by teleconference. All members of the Commission and
staff will only participate via the Zoom platform using the process described below. The
meeting is being conducted pursuant to recent amendments to the teleconference rules
required by the Ralph M. Brown Act allowing teleconferencing during a proclaimed state of
emergency when local official have recommended social distancing. The purpose of the
amendments is to provide the safest environment for the public, elected off icials, and staff
while allowing for continued operation of the government and public participation during
the COVID-19 pandemic.
Members of the public can view and participate in the meeting by:

The public will not be able to participate in the meeting in person.

These emails will be provided to the members of the Commission and will become part of
the official record of the meeting.
ROLL CALL
ORAL COMMUNICATIONS ON NON-AGENDIZED ITEMS
Any member of the public may address the Public Art Commission for up to three (3) minutes
on matters not on the Agenda. The law generally prohibits the Commission from discussing
or taking action on such items. However, the Comission may schedule the item for discussion
at a future meeting.

Recommended Action:
The Public Art Commission is currently scheduled to hold regular meetings on the 3rd
Monday of odd-numbered months at 6:30 p.m. The Commission may adjust its
regular meeting schedule, so long as it does not conflict with the schedules of other
Commissions or the City Council. If the Commission decides to maintain the current
schedule, the Commission should consider whether to reschedule or cancel the
January 17, 2022 meeting as it falls on a City holiday.
6. Commission 2022 Work Plan
Recommended Action:
Receive information about the City of Saratoga’s Commission Work Plan process and
preparation of the Public Art Commission 2022 Work Plan.
7. Selection of Chair and Vice Chair
Recommended Action:
Select one member of the Commission to serve as Chair and one member to serve as
Vice Chair.

Subject: Overview of Public Art Commission Responsibilities
In June 2021, the City Council agreed to replace the Public Art Committee with a 5-
member Public Art Commission comprised of Saratoga residents. The Public Art
Commission serves at the pleasure of the City Council, providing counsel and
recommendations on matters related to public art. Under the Public Art Policy, the
Commission is responsible for providing a recommendation on placement of public
art or exhibits on City property to the City Council. The Commission may also
recommend public art programs and activities, which require majority vote of the
Council before implementation. All City public art placements and programs require
City Council authorization and approval.
Per the Public Art Policy, art on City property may not impede normal uses of the site
where art is proposed to be located; it must be appropriate in scale, media, and
context for the display location; art may not contain political statements or symbols,
religious references or symbols, profane or offensive content, graffiti-like artwork,
copyrighted or trademarked material, or corporate references, branding, or symbols;
art must be suitable for a diverse audience, including children; there should be some
evidence of community support for art; outdoor art must be able to withstand the
elements; and, art cannot pose a threat to public safety.

RESOLUTION NO.21-047
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
ESTABLISHING A PUBLIC ART COMMISSION
WHEREAS, the City Council established the City Council Public Art Committee in 2016
and wishes to replace the Public Art Committee with a Public Art Commission comprised of
Saratoga residents; and
WHEREAS, the new Public Art Commission will serve in an advisory capacity to the City
Council on matters related to art and is charged with considering and recommending opportunities
for public art in Saratoga and on City property to the City Council; and
WHEREAS, the Public Art Commission will be comprised of five members in accordance
with requirements outlined in City Code Article 2-12 City Commissions; and
WHEREAS, the Public Art Commission shall be subject to all City policies and State laws
that apply to the operation and administration of City Commissions, including the City of Saratoga
Conflict of Interest Code; and
WHEREAS, the Public Art Commission shall hold regular meetings every other month at
a regular date and time to be determined by the Commission and schedule special meetings as
needed.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saratoga hereby
establishes a new Public Art Commission to function in accordance with the provisions of the
attached statement of Responsibilities and Duties and directs staff to conduct recruitment for the
Commission for one position with a term of one year, one position with a term of two years, one
position with a term of three years, and two positions with a term of four years.
The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga
City Council held on the 16t" day of June 2021 by the following vote:

RESPONSIBILITIES AND DUTIES
Adopted June 16, 2021 via Resolution No. 21-047
STRUCTURE
A. Membership. The Public Art Commission of the City of Saratoga shall consist of five
members appointed bythe City Council. Members are required to meet qualifications
identified in City Code Section 2-12.020. The first five Commissioners appointed will
be exempted from City Code Section 2-12.020(a)(3).
B. Term of Office. Vacancies and Removal, Officers. The term of office, vacancies and
removals, and officers of members of the Commission shall be as set forth in the City
Code Section 2-12.020 except that the terms of four Commissioners initially
appointed to the Commission shall be partial terms of one, two, and three years to
ensure that the Commission terms are staggered in accordance with City Code 2-
12.030(c) .
II. ADMINISTRATION
A. Meetings. The Public Art Commission shall hold regular meetings every other month.
The date and time of these meetings shall be approved by vote of the Commission.
B. Rules of Procedure. The Commission shall in all respects comply with the
requirements for City Commissions as set forth in the City Code and City Council
policies.
C. Compensation. Members of the Commission shall serve without compensation.
When in accord with current City policy and when arranged in advance with the City
Manager, actual and necessary expenses incurred by Commission members acting in
their official capacity shall be reimbursed by the City.
D. Records. The staff liaison of the Commission shall keep a record of all proceedings,
deliberations, findings, determinations, and recommendations of the Commission.
These records shall be available to the public, and copies shall be filed with the City
Clerk.
E. Staff Support. Staff support required by the Commission shall be provided consistent
with City budget authorizations.
III. RESPONSIBILITIES & DUTIES

A. The Commission shall provide counsel and recommendations on public art policies,
budgets, plans, and procedures to the Saratoga City Council.
B. As directed by the City Council, evaluate and assess public art projects or programs
and perform such other activities as may be directed by the Saratoga City Council.
C. The Commission shall maintain communications with the City Council and City staff
on public art -related matters.
D. Provide support and/or advice on events or programs related to City public art.
E. Maintain awareness and knowledge of public art trends and principles.

RESOLUTION NO. 21-048
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARA TOGA
CREATING A NEW PUBLIC ART POLICY
WHEREAS, the City Council of the City of Saratoga adopted Resolution 21-010
establishing the current Public Art Policy; and
WHEREAS , the City Council has established a Public Art Commission and wishes to
create a new Public Art Policy that reflects creation of this Commission and the City Council's
expectations for City of Saratoga public art efforts.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saratoga hereby
replaces the Public Art Policy adopted by Resolution 21-010 with the attached Public Art Policy
and declares that this resolution shall replace and supersede all prior resolutions , policies, and
understandings relating to the Public Art Policy.
The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga
City Council held on the 16 111 day of June 2021 by the following vote :

CITY OF SARATOGA PUBLIC ART POLICY
Adopted June 16, 2021 via Resolution 21-048
The City Council of the City of Saratoga has approved this policy concerning the placement of
public art or exhibits on City property.
1. Placement of public art or exhibits on City property shall be reviewed by the Public Art
Commission and the recommendation of the Commission shall be presented to the City
Council prior to Council consideration of placement of public art or exhibits on City
property. Placement of public art or exhibits on City property must be approved by a
majority vote of the City Council.
2. The Public Art Commission may recommend City of Saratoga public art programs and
activities for consideration and approval by a majority vote of the City Council.
3. The Public Art Commission shall recommend art on City property and City public art
programs/activities only if they meet the following criteria:
a) Artwork/exhibits do not impede typical uses of the site where they are proposed to be
installed
b) Artwork/exhibits are appropriate in scale, media, and context with the intended display
location
c) Artwork/exhibits do not contain political statements or symbols, religious reference or
symbols, profane or offensive content, graffiti-like style artwork, copyrighted or
trademarked material, or corporate or organizational references, branding, or symbols
d) Artwork/exhibits are suitable for display to a diverse audience, including children, and
should help create a sense of place and community
e) There is evidence of community support for the artwork/exhibit
f) Artwork/exhibits installed outdoors are able to withstand an outdoor environment through
the public display period
g) Artwork/exhibits do not pose a threat to public safety

Subject: City of Saratoga Public Art Efforts
While the Public Art Commission is new, the City has had an active public art program
since 2016 under the guidance of the Public Art Committee. The Public Art Committee
was formed in 2016 to consider and make recommendations on opportunities for
public art in Saratoga. It originally was comprised of 2 City Council Members and was
expanded in 2020 to add 3 non-voting, advisory members. This memo describes the
City’s public art activities since the formation of the Public Art Committee in 2016.
PLACE Bench
PLACE is a steel five letter bench created by the artist Steven Simon in 2008. The City
entered into a lease with Montalvo Arts Center in 2016 and the bench as placed
outside of the Saratoga Library. In 2021, Montalvo Arts Center donated the bench to
the City.
Count Your Blessings Bench
On the “Count Your Blessings” bench, you will find life-sized bronzes of Willys and
Betty Peck. These two Saratoga residents were a critical part in the development of
Saratoga’s character and community. The bench was inspired by Willys and Betty’s
practice of sitting together every day to count their blessings. Community members
worked with the artist Jerry Smith to create the bench and conducted all the
fundraising needed to create the artwork. This bench was created and installed in
2017 in Blaney Plaza.

#SaratogaROCKS
One of the City’s early public art projects was #SaratogaROCKS. Through this
program, community members were encouraged to paint rocks, place them in the
City, and post photos of their rocks on social media using the
hastag #SaratogaROCKS. The City offers a free #SaratogaROCKS kit that can be
borrowed by residents. The kit includes rocks, paint, brushes, and markers.
Paint the City
The City of Saratoga started the Paint the City program in 2018 to turn plain utility
boxes into works of art. Saratoga residents age 10 and older are invited to submit
conceptual artwork as part of the program. In past years, the Public Art Committee
selected 3 designs per location. The top 3 selections are then posted online for public
voting where residents can engage in the process by selecting their favorite
conceptual design at each location. The highest ranked designs are presented to the
City Council for acceptance. Selected artists receive a stipend of $600.
Mikrokozmosz
Mikrokozmosz is a mural located in the Joan Pisani Community Center that was
created by artist Pavel Mester. The mural is inspired by Robert Schumann’s Piano
Quartet in E flat Op. 47, interpreted by Tamami Honma. The painting is comprised of
3 pieces that is hung side by side. The artwork of Pavel Mester was a donation to the
City of Saratoga arranged with the assistance of the Cal Arte Music Foundation and
Charles Aznavour. The City accepted the mural in 2018.
Bicycle Racks
In 2019, the Public Art Committee selected decorative bicycle racks that were
installed at Friendship Park, Saratoga Library, Civic Theater, and Blaney Plaza.
Nuts About Saratoga
In Spring 2020, six bronze acorns were installed throughout the City as a fun
scavenger hunt for Saratoga residents and visitors. Clues have been developed to
help participants find the location of each acorn hidden as part of the Nuts About
Saratoga program.
CHALK Full of HeART
Over the summer of 2020, the Public Art Committee hosted a virtual chalk art event.
Residents were invited to share photos on social media of their sidewalk chalk art
using monthly themes for inspiration.

Chalk Hopscotch
At the October 2020 Public Art Committee meeting, the Committee agreed to
proceed with the temporary placement of artistic hopscotch squares at Wildwood,
Azule, and Gardiner Parks using spray chalk. The chalk hopscotch squares were
installed in February 2021.
Silly Walks
In 2020, the Public Art Committee temporarily placed signage in the Village and on
Joe’s Trail encourage the public to be silly, especially during chal lenging times. The
signs invited the public to let loose, get creative, and record themselves doing their
best silly walk and then share the photo or video on social media.
Rainy Day Sidewalk Poetry
In 2020, the Public Art Committee launched the Rainy Day Poetry Program. Poems
were stenciled at several locations throughout the City using paint that can only be
seen while wet. Another set of poems were painted in 2021 with the help of the
Library and Community Engagement Commission, which proposed poem selections
to the Public Art Committee.
Village Wall Mural
The Public Art Committee worked with local artist, Michelle Liu, to add a mural on the
wall of the Mint Leaf Cuisine in Saratoga Village and the property owner to paint a
mural on the outside wall of the restaurant. On November 4, 2020, the City Council
authorized placement of the mural and the mural was completed in early 2021.
Shadow Art in El Quito Park
In 2021, the Public Art Committee developed a shadow art program to paint
whimsical designs on the ground to mimic the shadow of an ordinary object, such as
a water fountain. In October 2021, the City Council authorized placement of designs
created by Prospect High School art students at Quito Park. In exchange for the high
school’s participation in the project, the Council also authorized a grant of $750 to
Prospect High School. The stencils are in the process of being created in preparation
for installation.
City Hall Courtyard Sculpture
In 2020 and 2021, the Public Art Committee was in conversation with a local artist
about the possibility of leasing 3 busts to be placed in the City Hall Courtyard where
there is currently a water fountain that was donated by Saratoga Rotary to the City.
The Committee considered draft lease terms for the sculptures at the May 2021

meeting and continued the agenda item without making a recommendation to the
City Council regarding the lease. When the City Council formed the Public Art
Commission, they directed staff to include the City Hall courtyard sculpture in the
new Commission’s work plan.
Gateway Sculpture
In 2020 and 2021, the Public Art Committee also explored options for placement of
a sculpture at the Gateway at the corner of Saratoga-Sunnyvale Road and Prospect.
The Committee was contemplating a 1-to-3-year lease and started discussions with
an artist about the potential lease of a sculpture to be placed at the Saratoga
Gateway. The City Council directed staff to include any future discussions of a
sculpture at the Gateway location on the Public Art Commission’s work plan.

Subject: Public Art Commission Regular Meeting Schedule
Meetings are currently scheduled to occur on the 3rd Monday of odd-numbered
months at 6:30 p.m. The Commission may cancel or reschedule a regular meeting
for an alternative date if a conflict arises, such as a holiday. For example, the next
Commission meeting lands on January 17, 2022, which is a City holiday. This meeting
will need to be rescheduled or canceled.
Additionally, the Commission may adjust its regular meeting schedule or schedule
special meetings as needed. Commission meetings should not conflict with the
meetings of other Commissions or the Council. If the Commission would like to
adjust its meeting schedule and keep meetings in the evenings, staff has provided
some alternative options that do not conflict with the other City groups below.
Meetings are currently taking place via Zoom. The City Council is evaluating whether
to continue meetings virtually or resume in-person meetings on a monthly basis.
When meetings resume in person, they will take place in the Linda Callon Conference
Room at Saratoga City Hall. In accordance with the City’s Remote Public Participation
Policy, the public will be provided with the opportunity to participate in those
meetings remotely.

Subject: Commission Work Plan
To ensure that the Commission’s work efforts are in alignment with the desires of
the Council, each Commission prepares a work plan for City Council consideration
and authorization. This typically occurs once a year in February or March. Any public
art programs or installations that the Commission wishes to pursue should be
included in the work plan.
When the Public Art Commission was formed, the City Council directed staff to
include several ongoing and annual public art efforts projects as well as two Public
Art Committee work efforts that had been initiated but not completed. Based on this
direction, staff has prepared a draft 2022 work plan (attached).
Additional items may also be added to the work plan. Staff recommends that
Commissioners email proposed additions to staff 2 weeks prior to the next
Commission meeting to provide staff with time to research implementation needs
and present an assessment of feasibility to the Commission at the next meeting, so
that the Commission my review and finalize the draft work plan at the next meeting
prior to presenting the proposed work plan to Council in February or March. If the
Commission requires more time to develop the recommended work plan, special
meetings may be scheduled prior to City Council consideration of the Public Art
Commission work plan.

DRAFT 2022 WORK PLAN
1. Rainy Day Sidewalk Poetry
Continue the Rainy Day Sidewalk Poetry program in partnership with the Library &
Community Engagement Commission. Through this program, poems are stenciled on
sidewalks at several locations in the City using paint that can only be seen while wet. In 2021,
the Library & Community Engagement Commission supported the Rainy Day Poetry Program
by providing poetry recommendations.
Month Activity
May 2022 Commission selects no more than 5 locations for Rainy Day poetry
then picks up to 2 Commissioners to present Rainy Day Sidewalk
locations to the Library & Community Engagement Commission and
request help with identifying poems for the program.
June 2022 Selected Commissioners attend Library & Community Engagement
Commission meeting to seek input on suggested poems for program.
September 2022 Commission reviews Rainy Day Sidewalk Poetry recommendations
from the Library & Community Engagement Commission and finalizes
recommendation to the City Council.

2. Summer Movie Nights Chalk Art
Collaborate with the Parks and Recreation Commission during the Saratoga’s Summer Movie
Nights at El Quito by hosting an event-themed chalk art activity that the community can
participate in prior to the start of the movie. Every summer, the City holds free movie nights
in El Quito Park on the third Friday of June, July, and August.

3. Paint the City
Continue the Paint the City utility box painting program starting in fall/winter 2022. The City
of Saratoga started the Paint the City program in 2018 to turn plain utility boxes into works
of art. Residents age 10 and older are invited to submit conceptual artwork for utility box
locations. The Public Art Commission would then review conceptual artwork and select up

to 3 options per location. The top 3 selections are posted online for public voting where
residents can engage in the process by selecting their favorite concept ual design per
location. After the close of voting, the Commission would make a recommendation on
artwork to the City Council. Selected artists receive a stipend of $600.

4. City Hall Courtyard Sculpture
In 2020 and 2021, the Public Art Committee was in conversation with a local artist about the
possibility of leasing 3 busts to be placed in the City Hall Courtyard where there is currently
a water fountain that was donated by Saratoga Rotary to the City. The Committee considered
draft lease terms for the sculptures at the May 2021 meeting and continued the agenda item
without making a recommendation to the City Council regarding the lease. When the City
Council formed the Public Art Commission, they directed staff to include the City Hall
courtyard sculpture in the new Commission’s work plan.

5. Gateway Sculpture
In 2020 and 2021, the Public Art Committee also explored options for placement of a
sculpture at the Gateway at the corner of Saratoga-Sunnyvale Road and Prospect. The
Committee was contemplating a 1-to-3-year lease and started discussions with an artist
about the potential lease of a sculpture to be placed at the Saratoga Gateway. The City
Council directed staff to include any future discussions of a sculpture at the Gateway location
on the Public Art Commission’s work plan.

6. #SaratogaROCKS

Subject: Selection of Chair and Vice Chair
Each Commission elects a Chair to serve a twelve-month term. No person may serve
as Chair or Vice Chair of the same Commission more than once during a single term
on the Commission. The Chair acts as the presiding officer at all meetings. In the
absence of the Chair, the Vice Chair presides for that meeting. In the absence of both,
the members select a temporary presiding officer for that meeting until the Chair
arrives.
The following is a list of the Chair’s responsibilities:
• Call meeting to order
• Call for the vote, restate all motions submitted for vote, and announce
decision
• Decide questions of order (pursuant to the City of Saratoga’s Rules of
Parliamentary Procedure)
• Lead meeting and preserve order
• Represent the Commission at meetings when authorized by a majority of the
Commission (or when requested by the City Council as long as the Chair notes
that the views expressed are personal)
• Work with staff assigned to the Commission to create meeting agendas
• Determine whether Commissioner absences are excused or unexcused
The Chair and staff should be in contact prior to each regularly scheduled meeting
to review and discuss the agenda. If a personality conflict arises between individual

Commissioners, it is the Chair’s responsibility to try to mediate and resolve the
problem. If the conflict cannot be resolved, the Chair should approach the Director
of the City Department staffing the Commission to discuss possible strategies to
address the issue.
In regards absences, if a Commissioner is absent without permission of the Chair (or
in the case of the Chair, permission from the Mayor) from three regular Commission
meetings within a 12-month period, the Commissioner’s position becomes vacant
and is filled as any other vacancy. A Commissioner removed from their position in
this manner may request that the vacancy be excused by filing a letter with the City
Clerk within 30 days of the effective date of the vacancy. It should be noted in the
minutes if a Commissioner’s absence is excused.

COMMISSION RESPONSIBILITIES & DUTIES (Resolution No. 21-047)
I. STRUCTURE
A. Membership. The Public Art Commission of the City of Saratoga shall consist of five
members appointed by the City Council. Members are required to meet qualifications
identified in City Code Section 2-12.020. The first five Commissioners appointed will
be exempted from City Code Section 2-12.020(a)(3).
B. Term of Office, Vacancies and Removal, Officers. The term of office, vacancies and
removals, and officers of members of the Commission shall be as set forth in the City
Code Section 2-12.020 except that the terms of four Commissioners initially
appointed to the Commission shall be partial terms of one, two, and three years to
ensure that the Commission terms are staggered in accordance with City Code 2 -
12.030(c).
II. ADMINISTRATION
A. Meetings. The Public Art Commission shall hold regular meetings every other month.
The date and time of these meetings shall be approved by vote of the Commission.
B. Rules of Procedure. The Commission shall in all respects comply with the
requirements for City Commissions as set forth in the City Code and City Council
policies.
C. Compensation. Members of the Commission shall serve without compensation.
When in accord with current City policy and when arranged in advance with the City
Manager, actual and necessary expenses incurred by Commission members acting in
their official capacity shall be reimbursed by the City.
D. Records. The staff liaison of the Commission shall keep a record of all proceedings,
deliberations, findings, determinations, and recommendations of the Commission.
These records shall be available to the public, and copies shall be filed with the City
Clerk.
E. Staff Support. Staff support required by the Commission shall be provided consistent
with City budget authorizations.
III. RESPONSIBILITIES & DUTIES
1. The Commission shall provide counsel and recommendations on public art policies,
budgets, plans, and procedures to the Saratoga City Council.
2. As directed by the City Council, evaluate and assess public art projects or programs
and perform such other activities as may be directed by the Saratoga City Council.
3. The Commission shall maintain communications with the City Council and City staff
on public art-related matters.
