HomeMy WebLinkAboutCity Council Resolution 21-082 Approving Mills Act Contract, 19174 DeHavilland DriveRESOLUTION NO.21-082 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA APPROVING A MILLS ACT CONTRACT FOR THE PROPERTY LOCATED AT 19174 DEHAVILLAND DRIVE (APN 389-05-016) WHEREAS, the City of Saratoga City Council recognizes the importance of preserving historic resources in the community and the need to enhance and maintain the unique character of the historic resources; and WHEREAS, the City of Saratoga City Council has chosen to participate and support the Mills Act Property Tax Abatement Program in accordance with California Constitution, Article XIII, section 8, California Government Code sections 50280-50290, and California Revenue and Taxation Code sections 439-439.4; and WHEREAS, the City of Saratoga City Council finds that entering Mills Act agreements for historic properties is consistent with the City of Saratoga Heritage Preservation Code Chapter 13, and the General Plan Open Space and Conservation Element Goal OSC 14, "through coordination with and implementation of other related General Plan Policies, encourage preservation of the City's heritage by providing for the protection of irreplaceable historic and cultural resources representing significant elements of City and regional history"; and WHEREAS, the City Council has introduced an ordinance designating the residence located at 19174 DeHavilland Drive as a Historic Landmark (the "Ordinance") and therefore the preservation of the property as a historic resource is of utmost importance. NOW, THEREFORE, BE IT RESOLVED by the City Council of City of Saratoga that it authorizes the City Manager, following the effective date of the Ordinance, to enter into a Mills Act agreement for the property located at 19174 DeHavilland Drive designating the property as a Historic Landmark and to take other actions as needed in connection with the property's participation in the Mills Act program. No later than 20 days after the contract has been signed by both parties the City Clerk shall record the contract with the County Recorder.
