A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
TERMINATING THE AGREEMENT FOR THE ABATEMENT OF WEEDS
BY THE COUNTY OF SANTA CLARA FOR THE CITY OF SARATOGA
WHEREAS, The City of Saratoga (City) and the County of Santa Clara County (County)
entered into an Agreement for the Abatement of Weeds By County of Santa Clara for the City of
Saratoga ("Agreement") on November 2, 1981, as amended on February 15, 1983; January 14,
1996; August 18, 1998; August 17, 1999; January 12, 2001; March 2, 2010; and April 26, 2012,
and
WHEREAS, beginning September 1, 2022 the City of Saratoga intends to independently
perform the weed abatement activities currently provided by the County pursuant to the
Agreement; and
WHEREAS, Section 13 of the Agreement states the Agreement became effective on the
date of execution and runs until the governing body of the City or the County exercises the right
to terminate this Agreement as of the first day of September of any year, by giving notice to the
other party not less than ten (10) days prior to the date of the termination.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saratoga
does hereby (1) exercise its right to terminate the Agreement effective September 1, 2022 and (2)
direct the City Manager or his designee to notify the County of this termination.
The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga
City Council held on the 61h day of April 2022 by the following vote:

FITZSIMMONS, MAYOR WALIA

ABSTAIN: NONE
