Prior to Roll Call, the Vice Chair and Community Development Director explained that the Planning Commission meeting was conducted pursuant to Government Code section 54953(e) of the Ralph M. Brown Act allowing teleconferencing during a proclaimed state of emergency when state or local officials have imposed or recommended measures to promote social distancing. The Planning Commission met all the applicable notice requirements and the public is welcome to participate in this meeting. Additionally, the City Council announced virtual meetings will continue and be decided going forward on a month- to-month basis. PROJECT DESCRIPTION Twelve (12) new capital projects are proposed in the upcoming Fiscal Year 22-23. The proposed projects have been reviewed by the City Council as part of the annual budget process. California Government Code Section 65401 states that the local planning agency should report on the conformity of the CIP with the agency’s General Plan. However, not all projects have a relationship to a policy in the General Plan such as maintenance work and building remodels. For FY 22-23 the proposed projects are generally dedicated to upgrading existing infrastructure (maintenance), ADA upgrades, safety projects, sidewalks, trails, and park improvements. Attached to this memo are project descriptions for each proposed capital project. Staff reviewed the proposed projects and found that, where applicable, they follow the City’s General Plan policies therefore a conformity finding can be supported. Work will commence in FY 23 FY 23 request: $300,000 General CIP Fund Page 6 of 12 13 NOMINATED PROJECT NARRATIVES TRAFFIC SIGNAL CONTROLLER UPGRADES Project Manager Macedonio Nunez Location Citywide Department Public Works Project No. TBD Description & Background There is a total of 15 traffic signalized intersections in Saratoga. During the completed City-Wide Citywide Signal Upgrade Project - Phase II upgraded traffic signal adaptive system for the 6 signalized intersections on Saratoga Avenue, the City’s most traveled street. This completed project upgraded old traffic controllers with the required new controllers and software for coordination between traffic signalized intersections. This new project will upgrade the remaining 9 traffic signal intersection controllers. The City utilizes the Smart City Signals traffic management system to provide citywide traffic signal monitoring capabilities over cellular and cloud-based solutions. The system also serves as the network for traffic signal adaptive operations along the Saratoga Avenue-Fruitvale Avenue corridors. This proposed CIP will allow the City additional traffic surveillance opportunities. The new equipment will be viewable by City and Emergency Operations staff over the Smart City Signals cloud-based platform that in conjunction with recently installed battery-back up systems at traffic signals will allow for remote monitoring during power outages, incidents, and natural disaster events. See Segment 59 and 60 of the Trails and Walkways Master Plan, updated December 2021. Phase I of the project will complete design of the trail and acquisition of a required trail easement necessary to provide a pedestrian connection between two City parks, as requested by Saratoga’s Pedestrian, Equestrian and Bicycle Trails Advisory Committee. Work will commence in FY 23 FY 23 request: $50,000 Park In-Lieu Fund Page 12 of 12 19 REPORT TO THE PLANNING COMMISSION Meeting Date: April 13, 2022 Subject: Planning Commission Work Plan Address/APN: Citywide Owner / Applicant: City of Saratoga From: Debbie Pedro, Community Development Director STAFF RECOMMENDATION: Staff recommends that the Planning Commission discuss its priority work plan items for the coming year, and forward it to the City Council for input and direction at the Joint City Council Planning Commission Work Plan Study Session on May 4, 2022. No formal action is requested or may be made at a study session, but straw polls may be appropriate to indicate priorities. BACKGROUND: Each year, the Planning Commission discusses its potential Work Plan items for the coming year. The Council then reviews the items suggested in a joint session with the Commission or in another format, and provides input and direction regarding where the Commission should focus its efforts. Attachment 1 is a copy of the Commission’s 2021 Work Plan for reference. DISCUSSION: The Commission’s FY 22/23 Work Plan will focus on the following core priorities: Housing Element Update Continue work on the Housing Element Update. Every eight years, California municipalities must update their Housing Element, which is a required component of the General Plan. The Housing Element serves as a long-term blueprint for future housing development. In the Fall and Winter of 2021, the Planning Commission hosted a series of four community meetings to obtain public input on opportunity sites and policies that would further support housing to meet the RHNA targets and presented the recommendations to the City Council on December 14, 2021. In the coming months, staff will be incorporating Council’s direction into a preliminary draft of the Housing Element which is due to HCD in June, before the EIR is completed. The preliminary draft will be presented to both the Planning Commission and City Council before it is submitted to HCD for their initial review this summer.The deadline for jurisdictions to adopt the Housing Element update is January 31, 2023. 20 Report to the Planning Commission Work Plan Study Session April 13, 2022 Page | 2 General Plan Update. Continue work on the General Plan Update. In April 2018, the City began the process to refresh and make minor policy updates to three elements of the City’s General Plan (Land Use, Circulation, and Open Space & Conservation). The original timeline for Commission review of the draft documents was Winter 2020. Due to the substantial increase in the number of housing units that Saratoga will be required to plan for in the 6th cycle RHNA, the schedule of the General Plan 2040 update was revised so that it can be aligned with the Housing Element. In addition, Senate Bill 1035 requires the Safety Element to be reviewed and updated as necessary every eight years, at the same time as the Housing Element. The updated elements of the General Plan will be combined with the newly updated Housing Element and Safety Elment and existing Noise Element to comprise the Saratoga 2040 General Plan. Mixed Use and Multifamily Objective Design Standards Senate Bill 35 created a streamlined and ministerial approval process for qualifying housing projects and requires local jurisdictions to provide objective standards for the expedited review and approval of eligible projects. In addition, the City will be creating Mixed Use zoning districts as part of the Housing Element Update so the Objective Design Standards will provide applicants with a clear set of requirements for mixed-use and multi-family residential project design. SB 9 Ordinance On December 15, 2021, the City Council adopted an urgency ordinance to implement Senate Bill 9, which became effective January 1, 2022. SB 9 allows properties within a single-family residential zone to be developed with two units and be subdivided into two parcels. In addition, eligible SB 9 projects must be reviewed ministerially, without discretionary action or public comment. A comprehensive SB 9 ordinance to ensure that SB 9 projects are as compatible as possible with surrounding properties will be presented to the Planning Commission and City Council in the Spring of 2022. Other Items If the Commission feels that other items deserve its priority attention in this coming year, they should bring those items up for discussion at the Study Session. ATTACHMENT 1. 2021 Work Plan 21 Page 1 of 2 CITY OF SARATOGA Memorandum To: Mayor Zhao & Members of the City Council From: Debbie Pedro, Community Development Director Date: April 21, 2021 Subject: Planning Commission Work Plan – FY21/22 On April 13, 2021, the Planning Commission held a study session to discuss potential Work Plan items and proposes the following for 2021. Housing Element Update. Every eight years, California municipalities must update their Housing Element, which is a required component of the General Plan. Based on growth projections from the State Department of Finance, the Housing and Community Development Department (HCD) determines housing needs within each of the 18 regions in the State. The methodology for distributing the projected housing needs is led by the Association of Bay Area Governments (ABAG). According to ABAG’s draft allocation, Saratoga will need to identify how it will add more than 1,712 new housing units across a wide range of affordability levels that is expected to be built between 2023 and 2031. In the coming months, the Planning Commission will be holding study sessions with the community to develop policies and strategies to recommend to the City Council. The City will have to submit a draft Housing Element to the State for review with a deadline for adoption by January 2023. General Plan Update. Continue work on the General Plan Update. In April 2018, the City began the process to refresh and make minor policy updates to three elements of the City’s General Plan (Land Use, Circulation, and Open Space & Conservation). The original timeline for Commission review of the draft documents was Winter 2020. Due to the substantial increase in the number of housing units that Saratoga will be required to plan for in RHNA 6, the schedule of the General Plan 2040 update was revised so that it can be aligned with the Housing Element. SB35 Objective Standards Code Review. Senate Bill 35 created a streamlined and ministerial approval process for qualifying housing projects and requires local jurisdictions to provide objective standards for the expedited review and approval of eligible projects. The recent Quito Village development project underscores the importance for the City to clearly articulate objective development standards in the City Code. CITY CODE 2‐15.030 POWERS & DUTIES The Planning Commission is hereby designated as the planning agency of the City, as described in Section 65100 of the Government Code, and shall exercise the functions of a planning agency as prescribed in Section 65101 of the Government Code. The Planning Commission shall also exercise the powers and perform the duties conferred upon it by this Code and assigned to it from time to time by the City Council. GOVERNMENT CODE 65100 There is in each city and county a planning agency with the powers necessary to carry out the purposes of this title. The legislative body of each city and county shall by ordinance assign the functions of the planning agency to a planning department, one or more planning commissions, administrative bodies or hearing officers, the legislative body itself, or any combination thereof, as it deems appropriate and necessary. In the absence of an assignment, the legislative body shall carry out all the functions of the planning agency. GOVERNMENT CODE 65101 (a) The legislative body may create one or more planning commissions each of which shall report directly to the legislative body. The legislative body shall specify the membership of the commission or commissions. In any event, each planning commission shall consist of at least five members, all of whom shall act in the public interest. If it creates more than one planning commission, the legislative body shall prescribe the issues, responsibilities, or geographic jurisdiction assigned to each commission. If a development project affects the jurisdiction of more than one planning commission, the legislative body shall designate the commission which shall hear the entire development project. (b) Two or more legislative bodies may: (1) Create a joint area planning agency, planning commission, or advisory agency for all or prescribed portions of their cities or counties which shall exercise those powers and perform those duties under this title that the legislative bodies delegate to it. (2) Authorize their planning agencies, or any components of them, to meet jointly to coordinate their work, conduct studies, develop plans, hold hearings, or jointly exercise any power or perform any duty common to them. 23
