AN ORDINANCE AMENDING ARTICLE 9-25 OF THE CITY CODE
REGULATING OVERSIZE VEHICLES ON RESIDENTIAL STREETS
The City Council of the City of Saratoga finds that:
1. On October 19, 2022, the City Council directed staff to prepare an ordinance amending
Article 9-25 of the Saratoga Municipal Code to limit storage and long term parking of
recreational vehicles, trailers and large commercial vehicles on City streets.
The City Council of the City of Saratoga does ordain as follows:
Section l. Adoption.
Section 9-25.030 of the Saratoga Municipal Code is hereby amended as set forth in
Attachment A. Text to be added is indicated in bold double-underlined font (e.g., bold double-
underlined) and text to be deleted is indicated in strikeout font (e.g., s�lfee�). Text in standard
font is readopted by this ordinance.
Section 2. California Environmental Quality Act.
The proposed amendments to the Saratoga Municipal Code are Categorically Exempt
from the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline section
15061(b)(3). CEQA applies only to projects which have the potential of causing a significant
effect on the environment. Where it can be seen with certainty that there is no possibility that
the activity in question may have a significant effect on the environment, the activity is not
subject to CEQA. In this circumstance the amendments merely limit vehicle storage, and it can
be seen with certainty that there is no possibility amendments will have a significant effect on
the environment.
Section 3. Severance Clause.
The City Council declares that each section, sub-section, paragraph, sub-paragraph,
sentence, clause, and phrase of this ordinance is severable and independent of every other
section, sub-section, sentence, clause, and phrase of this ordinance. If any section, sub-section,
paragraph, sub-paragraph, sentence, clause, or phrase is held invalid, the City Council declares
that it would have adopted the remaining provisions of this ordinance irrespective of the portion
held invalid and further declares its express intent that the remaining portions of this ordinance
should remain in effect after the invalid portion has been eliminated.
Section 4. Publication.
A summary of this ordinance shall be published in a newspaper of general circulation of
the City of Saratoga within fifteen days after its adoption.

Following a duly noticed public hearing, the foregoing ordinance was introduced at the regular
meeting ofthe City Council ofthe City of Saratoga held on November 16,2022,and was adopted
by the following vote on December 7, 2022.

9-25.030 - Parking of certain ' oversize vehicles on residential streets.
(a) No person who owns or has possession, custody or control of any commercial vehicle
recreational vehicle, boat or trailer, � � +'�^~ +••���+�� ��* �n '��"+'' ^
���'�* �':�* �� �����+ shall park or leave standing such vehicle upon any street in a

residential district or abutting any property or area within a residential district, '��—��

consecutive hours or more. A vehicle shall be considered to have been parked or
left standing for seventv-two or more consecutive hours if it has remained
inoperable or has not been moved and remained at least one mile from its original
parked location for at least twentv-four (24) hours during the seventv-two-hour
eq riod•
(b) Unattached boats and trailers shall not park or stand unon any public street.
(c) For the purposes of this section:
2. Trailer means a vehicle, other than a motor vehicle, desi�ned for
industrial, professional, or commercial purposes, for carrvin� propertv on
its own structure, and for bein� drawn bv a motor vehicle.
3. Commercial vehicle shall have the meaning set forth in section 9-
10.040;
4. Recreational vehicle means anv vehicle used for recreation and
designed for human habitation for recreational, emergencv, or other
occunancv, and not includin� passenger vehicles.
