Prior to Roll Call, the Chair and Community Development Director explained that the Planning Commission meeting was conducted pursuant to Government Code section 54953(e) of the Ralph M. Brown Act allowing teleconferencing during a proclaimed state of emergency when state or local officials have imposed or recommended measures to promote social distancing. The Planning Commission met all the applicable notice requirements and the public is welcome to participate in this meeting. Information on how the public can observe the meeting and provide public comment was also shared. Additionally, the Chair explained that votes would be taken through roll call. The building includes three vacant tenant spaces and future proposed tenants are to include the Saratoga Vision Center and Starbucks and both will relocate from the Quito Village Shopping Center which is in the process of being demolished. The residential sales office for Quito Village will temporarily occupy the third tenant space of the building. Saratoga Municipal Code (SMC) section 15-30.160(b) requires a sign program for all advertising signs on lots with five or more uses. The project only has three uses however, any property owner may apply for a sign program to achieve a consistent theme and visual harmony among all signs erected on a single lot. Pursuant to SMC 15-30.160(c), the Planning Commission shall review and approve or deny all Sign Program applications. The site is located within the Quito Sign District. The boundaries of this district include the subject site, the adjacent Quito Village Residential Project, the commercial uses on the opposite side of Cox Avenue, the Saratoga Officer Center, the professional office development on the opposite side of Saratoga Avenue, and the 9.74-acre vacant site on Saratoga Avenue. The development standards that regulate signs within the Quito Sign District are contained within City Code Section 15-30-090. STAFF RECOMMENDATION Adopt Resolution No. 23-001 approving the sign program subject to conditions of approval included in Attachment 1. PROJECT DATA Gross/Net Site Area: 11,756 sq. ft. gross/net (.27 acres) General Plan Designation: Commercial Retail (CR) Zoning: Neighborhood Commercial (CN) SITE CHARACTERISTICS AND PROJECT DESCRIPTION Site Description The site is located at 18800 Cox Avenue in the Neighborhood Commercial (CN) zoning district at the intersection of Cox Avenue and Paseo Presada. Existing structures on site include a recently constructed three-unit vacant commercial building. The site was previously part of the Quito Village Shopping Center which is in the process of being demolished to construct 90 residential units. The subject site was subdivided from the larger residential parcel to create a separate parcel for the construction of the commercial building. Surrounding uses to the north include commercial office space, single family residential development to the east on the opposite site of Paseo Presada, and the Quito Village residential development to the south and west. Quito Sign District 6 Report to the Planning Commission 18800 Cox Avenue Application # PSP22-0001 January 11, 2023 Page | 3 Project Description The intent of a Sign Program is to achieve a consistent theme and visual harmony among all permanent signs erected on a site. A Sign Program is used to create standard sign design guidelines for projects with multiple buildings and/or tenants. Once a Sign Program is approved, future tenants are required to comply with the sign program and receive approval for individual signs at staff level instead of having to apply for Planning Commission Design Review for each instance a new illuminated sign is proposed. The proposed Sign Program features two (2) sign types: wall signs and a freestanding monument sign. The wall signs will be located on the exterior four sides of the building and the freestanding monument sign will be located in a landscaped area at the corner of Cox Avenue and Paseo Presada. A description of the permitted signs in the Sign Program can be found below: Wall Signs (Primary Building Signs) Not to exceed 0.5 square feet per one (1) square foot of building frontage to a maximum of 40 square feet (per tenant) Tenant 1 (north end of building) • 40 square feet maximum allowable sign area / 38 square feet proposed. • North Elevation - Located either above the awning or as an option, a logo mounted to the canopy. • West Elevation – Located above the awning. • 13-3/8” Internally illuminated channel letters with white acrylic faces with solid metal painted returns to match color of awning. • Optional tenant logo to be internally illuminated with white acrylic face with vinyl overlay graphic with solid metal painted returns. Tenant 2 (center of building) • 15 square feet maximum allowable sign area / 13 square feet proposed. • North Elevation – Located above the awning. • 13-3/8” Internally illuminated channel letters with white acrylic faces with solid metal painted returns to match color of awning. Tenant 3 (east end of building) • 36.5 square feet maximum allowable sign area / 34.5 square feet proposed. • North Elevation – Located above the awning. • East Elevation – Located on exterior of building and centered above the windows. • 13-3/8” Internally illuminated channel letters with white acrylic faces with solid metal painted returns. Wall Signs (Buildings with more than one entrance) Each of the three tenant spaces has two entrances. The primary entrance faces Cox Avenue, and the secondary entrance is on the south elevation which faces the plaza area between the commercial building and a residential building. Buildings with more than one entrance can have 7 Report to the Planning Commission 18800 Cox Avenue Application # PSP22-0001 January 11, 2023 Page | 4 an additional building sign not to exceed two square feet in excess of the 40 square feet for the primary building sign. These additional wall signs can be signs that are mounted flat against a building as is proposed for Tenant 1 or a projecting sign which is mounted perpendicular to an exterior wall such as what is proposed for Tenants 1 and 2. Tenant 1 • Two square feet maximum allowable sign area / 1.95 square feet proposed • Located above the rear entrance on the upper left side of the exterior wall. • Illuminated aluminum sign cabinet with painted finish on exposed surfaces. White acrylic face with vinyl overlay graphic. Tenants 2 and 3 • Two square feet of maximum allowable sign area / 1.95 square feet proposed • Located on exterior wall to the left side of the entrance door • Illuminated aluminum sign cabinet with painted finish on exposed surfaces. Freestanding Monument Sign One freestanding monument sign is permitted. For a site with three or four uses, the sign shall not exceed 25 square feet in area or 10 square feet in height. The support base is not included in the calculation of sign area but is considered when measuring overall height. • Maximum 25 square feet in area or 10 feet in height / 12.6 square feet proposed with a maximum height of three feet. • Materials include 1/2" thick aluminum panel with painted finish. The words “Quito Village” will include 5 3/8” tall flat cut out aluminum letters. Individual tenant names will include 5” tall screen or direct print graphics attached directly to exterior of sign. • Located in a landscaped area and adjacent to the sidewalk at the corner of Cox Avenue and Paseo Presada. Sign will be externally illumined with in-ground recessed LEDs. Findings The findings required for issuance of a Sign Program approval pursuant to City Code Section 15- 30.160(e) are set forth below and the applicant has met the burden of proof to support making all of those required findings: 1. The total area of all permanent signs governed by the sign program is not greater than the total area of all permanent signs otherwise allowed on the lot by this Article. This finding can be made in the affirmative in that the Sign Program has been conditioned to comply with Article 15-30 and the regulations in the zoning district. In accordance with City Code Section 15-30.090 (Quito Sign District), the total aggregate area of all building signs per tenant shall not exceed one-half square foot of area for each lineal foot of tenant frontage or 40 square feet, whichever is less. Also, in accordance with City Code Section 15-30.40, all sign letters will be no more than 18" in height. Freestanding signs in the Quito Sign District for three or more uses are limited to 25 feet of area or 10 feet in height. The freestanding sign is located at the corner of Paseo Presada 8 Report to the Planning Commission 18800 Cox Avenue Application # PSP22-0001 January 11, 2023 Page | 5 and Cox Avenue and due to its corner location, the maximum height of the sign cannot exceed three feet. The overall area of the freestanding sign including the base and the signage will not exceed three feet in height and 8 feet in width. The total sign area of the freestanding sign will be a total of 12.6 square feet. 2. All signs in the sign program are consistent with the applicable specific plan and/or design guidelines for the subject district. This finding can be made in the affirmative. The signs will be compatible with the visual characteristics of the subject building and the surrounding area. 3. The quantity, size, proportion, height, and spacing of signs minimize the perception of clutter. This finding can be made in the affirmative. The sign program requires that each sign be located above the canopy of the north, south, and west elevations with the exception of the eastern elevation where the sign will be located on the exterior of the building and above the windows. No sign will extend above the ridge line of the building. Building signage will consist of internally illuminated individual channel letters with a white acrylic face and solid metal painted return. The freestanding sign will not exceed a total area of 12.6 square feet. The sign will include 5-3/8” aluminum letters which spell “Quito Village “mounted to an aluminum panel. The freestanding sign will include three spaces for each tenant graphics. The overall size of the of the freestanding sign will not exceed three feet in height and eight feet in width. 4. The signs governed by the sign program are compatible with a) other nearby signs; b) the building and/or site upon which it is located; and c) adjacent structures and the general vicinity. Compatibility shall be determined and limited to the relationships of the elements of form, proportion, scale, color, materials, surface treatment, overall sign size and height, and the size and style of lettering. This finding can be made in the affirmative. The Sign Program regulates the location, size, design, and illumination of the signs such that they will not adversely affect the quality or character of the surrounding area. Neighbor Notification and Correspondence The public hearing notice and description of the project was published in the Saratoga News and notices were mailed to all property owners within 500 feet of the project site. Staff has not received any comments on this Sign Program request. ENVIRONMENTAL DETERMINATION The proposed Sign Program is Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14 of the California Code of Regulations, Chapter 3, Article 19, Section 15311. A Class 11 exemption includes the construction or placement of on premised commercial facility signs. 9 Report to the Planning Commission 18800 Cox Avenue Application # PSP22-0001 January 11, 2023 Page | 6 ATTACHMENTS 1. Proposed Sign Program 10 RESOLUTION NO: 23-001 RESOLUTION OF THE CITY OF SARATOGA PLANNING COMMISSION APPROVING A SIGN PROGRAM APPLICATION: PSP22-0001 18800 COX AVENUE (APN 389-12-021) WHEREAS, on April 6, 2020 an application was submitted by Sand Hills Properties Quito Village LLC requesting approval for a sign program for the retail center located at 18800 Cox Avenue. The site is located within the CN Zoning District (APN 389-12-021). WHEREAS, the Community Development Department completed an environmental assessment for the project in accordance with the California Environmental Quality Act (CEQA) and recommends that the Planning Commission determine this project Categorically Exempt. WHEREAS, on January 11, 2023, Planning Commission held a duly noticed public hearing on the subject application and considered evidence presented by city staff, the applicant, and other interested parties. NOW THEREFORE, the Planning Commission of the City of Saratoga hereby finds, determines, and resolves as follows: Section 1: The recitals set forth above are true and correct and incorporated herein by reference. Section 2: The proposed Sign Program is Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14 of the California Code of Regulations, Chapter 3, Article 19, Section 15311 (“State CEQA Guidelines”). This exemption allows for the construction or placement of on-premises commercial facility signs. Section 3: The project is consistent with the following Saratoga General Plan Policies: Land Use Policy 5.4 which provides that through the development review process, adjoining neighborhoods are protected from noise, light, glare and other impacts resulting from new or expanded non-residential developments and, Conservation Element Policy 6.0 which provides that the City shall protect the existing rural atmosphere of Saratoga by carefully considering the visual impact of new development. Section 4: The project is consistent with the Saratoga City Code in that future signs will be consistent with the Sign Program Findings contained in City Code Section 15-30.160(e): The total area of all permanent signs governed by the sign program is not greater than the total area of all permanent signs otherwise allowed by the development standards; all signs in the sign program are consistent with the applicable specific plan and/or design guidelines for the subject district; the quantity, size, proportion, height, and spacing of signs minimize the perception of clutter; the signs are compatible with: a) other nearby signs, b) the building and/or site upon which it is located, and c) adjacent structures and the general vicinity. Compatibility shall be determined and limited to the relationships of the elements of form, proportion, scale, color, materials, surface treatment, overall sign size and height, and the size 11 and style of lettering. Section 5: The City of Saratoga Planning Commission hereby approves PSP22-0001 located at 18800 Cox Avenue subject to the Findings and Conditions. PASSED AND ADOPTED by the City of Saratoga Planning Commission on this 11th day of January 2023 by the following vote: AYES: ABSENT: ABSTAIN: RECUSED: Herman Zheng Chair, Planning Commission 12 Exhibit 1 CONDITIONS OF APPROVAL APPLICATION NUMBER PSP22-0001 18800 COX AVENUE (APN 389-12-021) CONDITIONS OF APPROVAL A. GENERAL 1. Conditions may be modified only by the Planning Commission unless modification is expressly otherwise allowed by the City Code including but not limited to section 16-05.035, as applicable. 2. The Community Development Director shall mail to the Owner/Applicant a notice in writing, on or after the time this Resolution of Approval is duly executed by the City, containing a statement of all amounts due to the City in connection with this application, including all consultant fees (collectively “processing fees”). This approval or permit shall expire sixty (60) days after the date said notice is mailed if all processing fees contained in the notice have not been paid in full. No Zoning Clearance or Demolition, Grading, or Building Permit may be issued until the Community Development Director certifies that all processing fees have been paid in full (and, for deposit accounts, a surplus balance of $500 is maintained). 3. The facilities shall always operate in compliance with all applicable regulations of the State, County, City and/or other governmental agencies having jurisdictional authority over the facility pertaining to, but not limited to, health, sanitation, safety, and water quality issues. The Project shall maintain compliance with all applicable requirements of the State, County, City and other governmental entities having jurisdiction. 4. Agreement to Indemnify, Hold Harmless and Defend City as to Action Challenging Approval of Application and as to Damage from Performance of Work Authorized by Design Review Approval. As a condition of this Approval, Owner and Applicant hereby agree to defend, indemnify, and hold the City and its officers, officials, boards, commissions, employees, agents and volunteers harmless from and against: a. any and all claims, actions or proceedings to attack, set aside, void or annul any action on the subject application, or any of the proceedings, acts or determinations taken, done or made prior to said action; and b. any and all claims, demands, actions, expenses or liabilities arising from or in any manner relating to the performance of such construction, installation, alteration or grading work by the Owner and/or Applicant, their successors, or by any person acting on their behalf. In addition, prior to any Zoning Clearance from the Community Development Director, Owner and Applicant shall execute a separate agreement containing the details of this required 13 Agreement to Indemnify, Hold harmless and Defend, which shall be subject to prior approval as to form and content by the Community Development Director. B. COMMUNITY DEVELOPMENT 5. Compliance with Plans. The Sign Program shall be operated, located, and constructed to include those features, and only those features, as shown on the Approved Plans denominated Exhibit "A" received November 22, 2022 incorporated by this reference. All proposed changes to the Approved Plans must be submitted in writing with plans showing the changes, including a clouded set of plans highlighting the changes. Such changes shall be subject to the requisite prior City approval. 6. Municipal Code. The Sign Program shall comply with the requirements in Article 15-30 of the Saratoga Municipal Code. 7. Building Department. Applicant shall comply with all building standards including any permits necessary to comply with the building code. 8. Illuminated Signage. Any intensification or modification, or request for new illuminated signage shall require approval of an amended sign program by the Planning Commission. 9. Business License Requirement. All businesses of the shopping center that request signage per the Sign Program shall apply for and obtain approval of a Business License from the City of Saratoga prior to issuance of sign permit. 10. Sign Approval. All new signage, including illuminated and non-illuminated signs, requires prior approval from the property owner to ensure that the signs are consistent with the approved sign program before submitting an administrative sign application to the Community Development Department. 14 Exhibit 2 The findings required for issuance of Sign Program Approval pursuant to City Code Section 15- 30.160 (e) are set forth below and the Applicant has met the burden of proof to support making all of those required findings: 1. The total area of all permanent signs governed by the sign program is not greater than the total area of all permanent signs otherwise allowed on the lot by this Article. This finding can be made in the affirmative in that the Sign Program has been conditioned to comply with Article 15-30 and the regulations in the zoning district. The freestanding sign is located at the corner of Paseo Presada and Cox Avenue and due to its location on a corner the maximum height of the sign cannot exceed three feet. The overall area of the freestanding sign including the base and the signage will not exceed three feet in height and 8 feet in width.
