A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
TERMINATING ITS INTERESTS IN THE CORE NATURAL GAS SALES AND
AGGREGATION AGREEMENT BETWEEN ABAG POWER
WHEREAS, the City Council entered a Core Natural Gas Sales and Aggregation
Agreement (NGSAA) with ABAG POWER in 2004 for supply of natural gas for certain city
operations; and
WHEREAS, in the interest of simplicity and consistency with the balance of its retail gas
service agreements, the City it is prudent to transfer the gas service pursuant to the NGSAA at City
facilities to the incumbent utility (Pacific Gas & Electric Company); and
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saratoga does
hereby:
1. Terminate the NGSAA between ABAG Power and the City effective June 30, 2023; and
2. Direct staff to request a refund of the City's Working Capital Deposit of $2,691.57.
The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga
City Council held on the 21 st day of June 2023 by the following vote:

MAYOR FITZSIMMONS
NOES: NONE
ABSENT: NONE
ABSTAIN: NONE
