Section Service Unit Fee
A. General Provisions
1. Affordable Housing Fee Waivers
All planning, building, and engineering permit fees and
Actual Costs are waived for the following, unless
otherwise limited:
a. Projects funded by the Santa Clara County Office of
Supportive Housing
b. Application for Merger of Parcel - waive application
costs associated with lot mergers, in an amount not
to exceed $5,000, for projects that provide a
minimum of 20% deed restricted units affordable to
low and very- low income households
c. Accessory Dwelling Units (ADUs) or Junior ADUs
that are deed restricted so it may only be rented to
below market rate households
2. Other Fee Waivers
a. Tree Removal Permit Fee is waived for removal of
qualifying tree species in the Wildland Urban
Interface area.
b. Fallen or dead tree removals upon verification
3. Refunds
If an applicant decides to cancel a project within the
first 30 days, flat fees will be reimbursed at 50% of
the fee - only if a minimal amount of work was
completed prior to the request for cancellation of
application. If an applicant cancels a deposit-funded
application, any remaining uncharged deposit
amount will be refunded. All deposits are non-interest
bearing.
4. Actual Costs
"Actual Costs" include fully-burdened personnel
costs, professional and contract services, outside
agency fees, printing and publication fees, etc.,
directly related to the service. An administrative
overhead rate of 13.81% applies to all actual costs.
5. Deposits
Deposits ensure that a customer pays for direct and
indirect costs incurred to provide a service. The
customer who paid the deposit will receive a refund if
a balance remains after all Actual Costs are
deducted. If the deposit is exhausted before a
service is complete, the customer must replenish the
deposit in an amount determined by the department
director or work will cease. Deposits are not interest
bearing.

Building Permit: Residential Reroofs - This fee is waived for properties in the Wildland
Urban Interface area with untreated wood shake or shingle roofs that will be replaced with
non-wood Class A roofing materials.
3. Refunds
Any fee erroneously paid or collected will be refunded. If an applicant decides to cancel a
project within 180 days of the Building Permit Fee payment, a refund of not more than 80%
of the fee may be authorized provided that no work has been done under the issued
permit. A refund of not more than 80% of the Plan Check Fee may be authorized provided
that no plan check review has been completed. No refund of any fee shall be authorized
without submittal of a written application by the original applicant within 180 days of fee
payment.
4. Actual Costs
"Actual Costs" include fully-burdened personnel costs, professional and contract services,

Actual Costs
As required for reasons of changes,
modifications, additions, errors, omissions, or
discrepancies occasioned by the applicant or

Public Works Director.

A. Facilities
1. Facility Rental Discounts
(one discount allowed per rental)
a. Non-Profit Groups receive 50% discount
b. Residents receive a 10% discount
2. Facility Rental Refund Policy
a. Rental Facility – includes room assigned tables and chairs
b. Security Deposits – paid at time of reservation and are
refunded within one month after event.
» If additional charges are incurred due to damage to the
building or contents, overtime or maintenance costs,
deductions will be made from the deposit and the balance
refunded.
» If deposit does not cover the charges, applicant will be
responsible for additional fees.
» If clean-up is not completed, the entire deposit shall be
forfeited.
c. Rental Fees – must be paid in full at least 30 days prior to
event.
d. Cancellations – If event is cancelled between:
» 6 to 12 months – one-third of the deposit is forfeited,
rental fee is refunded
» 3 to 6 months – two -third of the deposit is forfeited, rental
fee is refunded
» 1 to 3 months – 100% of the deposit is forfeited, rental fee
is refunded
» Less than 30 days – 100% of the deposit and rental fee
are forfeited
