The meeting included a site visit to the property. The HPC determined (5 ayes, 1 noes, 1 absent) that the existing residence should NOT be added to the Heritage Resource Inventory due to the significant alterations throughout time and lack of architectural integrity with respect to the original design. Dang, DDS November 16, 2010 Michael Fossati Saratoga Planning Department Saratoga City Hall 13777 Fruitvale Avenue Saratoga,CA 95070 Re: 14545 Fruitvale Avenue, Saratoga(APN# 397-17-070) Dear Mr. Fossati, This letter is sent as follow up to our phone conversation regarding the house at 14545 Fruitvale Avenue. Mr.Teerlink, representing the owner, was told by the City that the house appears to have been constructed in 1916, and that it would need to have an architectural and historical evaluation report prepared and delivered to the City, if remodeling or removal was proposed. Urban Programmers was contacted to prepare the evaluation. Upon visiting the property it was obvious to me that the building had been substantially remodeled and enlarged and was no longer a 1916 cottage. Research at the County Assessor's Office produced the record of assessment increases and a diagram showing the extent of additions. These diagrams do not typically show architectural remodeling unless it results in an increase in their value scale. The Assessor's records show a pool was added in 1950, and an expansion and remodeling occurred in 1965 when the dining room was enlarged, and a stable and garage were added. In 1982 repairs ( not described) were listed. However it appears the substantial additions and remodeling were in 1996-97 under City of Saratoga Building Permit#961374. At that time the expansion was 1,675 additional square feet consisting of two bathrooms,two fireplaces,e nlarged kitchen, laundry room, den and master suite.The addition elongates the front of the house and extends to the rear. This addition more than doubled the size of the former house.The front facade has design elements of a vernacular style of the 1950's era that may have been an-unrecorded remodel. The 1996-97 addition almost doubled the original size of the front facade with a new projecting gable that alters the architecture of the . building as seen from the street. A separate two car garage was also added. After the remodeling and additions, the scale used by the assessor to measure quality was raised from level 5.5 to 7.5 indicating a substantial increase in overall quality of the construction and architecture, and the loss of older materials and design. The building has been altered to such an extent that it no longer represents an early century cottage but is a vernacular Colonial Revival style house composed of substantially contemporary materials and methods of construction. If evaluated for historic and architectural significance it would be classified as having lost the integrity of a 1916 cottage. Please contact me if you wish to discuss this letter. PROJECT DISCUSSION The applicants are requesting Design Review approval to construct a .new 484 square foot detached garage at a height of 15 feet . They have already received an over-the-counter approval to construct an addition to the existing residence which has a 9/12 roof pitch. The applicants are proposing the garage with a 7/12 roof pitch in order to maintain compatibility with the residence . DESIGN REVIEW The structure is designed with materials and details that match the existing residence, , including horizontal wood siding, double hung windows with wood trim, shutters, eave and rake roof details, and shingle roof material . File No. DR-96-066; 14545 Fruitvale Avenue Design Review is necessary for any detached accessory structure which exceeds 12 ft . in height. The Planning Commission can approve an accessory structure up to a maximum height of 18 ft . if the Commission finds that : • The additional height is necessary to achieve architectural compatibility with the main residence, and • All of the Design Review findings can be made pursuant to Article 15-45 of the City Code. Conclusion Staff feels that the additional accessory building height is appropriate in that that it better matches the existing residence architecturally. PROJECT CONSIDERATIONS Impact'on Privacy and Views: No impacts are anticipated on the privacy and views of adjoining properties. Per applicant, the home is to be a one-story structure. The front of the residence does face the rear yards of two homes to the north, but any impacts to these properties are mitigated by the large front setback proposed by the applicant (65 ft.) . A tennis court in the neighbor's rear yard to the west of the site will provide screening in this direction. To the south and east, adequate setbacks are proposed. Landscaping should be provided on site to mitigate further any privacy impacts. Compatibility; The gross floor area of the structure, excluding any attic area, is below the Design._Review Standard for this size lot and is consistent with the existing homes in the surrounding area. The height of the proposed structure, however, does pose a compa- tibility problem. Only one of the residences surrounding the subject parcel would be of comparable height to that which has been proposed, and this residence has two stories. Staff questions the reasonableness of the proposed height of the building. First, ,the added height adds to the overall bulk of the structure and second, it is uncertain from the plans provided by the appiicant what the "attic" area will be used for. If the height of the building and the use of dormer windows is to make the "attic" into a living area, this square footage should be included in gross floor area computations. For these reasons, staff is recommending that the height of the structure be reduced to 22 ft. , and the dormer windows be removed. Design Considerations: The building design incorporates the use of earth-tone stucco with field stone columns and walls. Dormer windows are proposed on a heavy sha!:e roof. FINDINGS 1 . PROJECT CONSIDERATIOPIS Impact on Privacy and Views: The side and front yard of the property to the south will be visible from the side of the proposed residence. Fruit trees on this adjoining pro- perty partially screen the existing house. The garage area of the home north of the site Will be facing the right side yard of the new residence. The neighbor`s existing land- scaping diminishes further any potential privacy impacts. Adequate setbacks to the rear of the parcel will mitigate any privacy impacts in this direction. Compatibili_,y: The height of the structure does create compatibility problems with adjacent homes. Only.one house, visible from the site, would be of comparable height and this structure is two-story. Staff is concerned that the height of the residence Will give the appearance of excessive. bulk. Also of concern, is whether the height of the building and use of dormer windows will lead to the utilization of the "attic" area as living space. If this were to be the case, the attic square footage should be in- cluded in the computation of the total gross floor area of the structure. These concerns have lead to the Staff's recommendation to reduce the height of the structure to 22 ft. and to have the dormer windows removed. Desi n Considerations: The proposed exterior will incorporate the use of egg-shell colored stucco and used brick columns. Roofing materials are to be heavy shakes. FINDINGS i. Discussion-followed on a possible. condition for one- story homes only and the elevation of the pads for Lots #9 and #10. It was the consensus not to condition the Building Site Approval for one-story homes. The public hearing was opened at 10:25 p.m. Levon Gulesserian, 20646 Sevilla Lane, asked about the height of the house on Lot #8. Mr. Pinn, the applicant, discussed the height of it, indicating that the roof line will be 6 feet below Mr. Gulesserian's home. After further discussion it was the consensus that the house on Lot #8 shall be no higher than 19 ft. Lucy Applebaum, Sevilla Lane, indicated that she lives behind Lot #10. She asked about the fill and adressed the drainage problem in that area. Staff commented that, with the installation of the street and storm drain improve- ments, a great quantity of the storm water will be collected and put in an underground system. They noted that they will be reviewing the area to try to minimize the drainage even further. Mrs. Applebaum discussed an overhead utility pole that slid had been told would previously be moved. It was noted that this pole is covered in Condition II-D-3. Marvin Kirkeby, civil engineer, discussed the fill and drainage on Lots #9 and #10. Commissioner Peterson asked about new .fences on Lots #8, #9 and #10. It was noted that there is no condition requiring this. However, Mr. Pinn commented that if the property owners will take out their old fence, he usually puts new ones up. Mr. Kirkeby commented that from a drainage standpoint, the existing wall that is on th.e.Sevilla Lane side of the fence will have to go in order to do improvements. He added that they will make the grading conform and will need the cooperation of the neighbors. Earl Johnson, Verde Vista Lane, asked if a traffic study had been done on Verde Vista. Staff indicated that one had been submitted with the application, which shows that there will be no significant impact. Commissioner Hlava moved to close the public hearing. Commissioner McGoldrick seconded the motion, wliich was carried unanimously. Commissioner Siegfried moved to approve the Negative Declaration for SD-1557. Commissioner I-Ilava seconded the motion, which was carried unanimously 7-0. Commissioner Siegfried moved to approve SD-1S57, per the Staff Report dated January 5, 1984 and Exhibit "B-1", adding to Condition VIII-C that "tile residence on Lot 8 shall be a-.maximum of 19 ft. in height." Commissioner Hlava seconded the motion, which was carried unanimously 7-0. 15. SDR-1559 - Mrs. K. Pittman, Request for Tentative Map Approval for three (3) lots (two new dwellings) at 14545 Fruitvale Avenue, in _ the R-1-40,000 zoning district Stafff described the project, recommending approval. They noted that the following modifications should be made to the Staff Report: Condition II-E-2 should read R-36 instead of V-24, under Condition II-E-4, add "as required by the Undergrounding Ordinance of the City", and add to Condition III-C-2 that "A berm or other drainage system along the north side of the property shall be required to prevent surface runoff from crossing onto the Frye property. This is to be approved by the Director of Community Development." The public hearing was opened at 10:53 p.m. Bill Heiss, engineer, addressed the conditions of the Staff Report. lie discussed Condition II-E, and noted that there is an existing pole that goes down Fruitvale Avenue which has not been undergrounded by anyone. He stated that it seems inappropriate to require it to be undergrounded in this parti- cular case. He commented that, regarding Condition II-E-1, he reads it as widening Fruitvale Avenue to be 20 ft. beyond existing center line. He explained that presently the existing center line in front of this residence is 20 ft. from the property line. •He :stated that there are three .poles . - s - Planning Commission 1 Page 9 Meeting Minutes 1/11/8 � SDR-1559 (cont.) just behind the existing pavement which would then have to be moved. He questioned if it-'is appropriate to widen this road additionally. Discussion followed on the 'requirement for widening Fruitvale.' Staff noted that there are 60 KV lines running down Fruitvale Avenue. They stated that those are not required to be undergrounded by anyone, even if the pole have to be moved. However, in the past where there is a combination of 60 KV lines which are not distribution lines to the fronting properties, and also 12 KV lines on the same poles, the City has required that those 12 KV lines be undergrounded. After further discussion it was the 'consensus to leave the condition in the Staff Report as written. Mr. Heiss asked for consideration of having to underground the existing overhead utility line that crosses Fruitvale Avenue and serves properties on the eastern 'side of Fruitvale. After further discussion it was the con- sensus of the Planning Commission that the applicant did not need to under- ground that particular overhead line. Commissioner McGoldrick moved to close the public hearing. Commissioner Hlava seconded the motion, which was carried unanimously. Commissioner McGoldrick moved to approve SDR-1559, per the Staff Report dated December 29, 1983 and Exhibit "B-1", with the proposed changes in Conditions II-E-2 and III-C-2. The motion was carried 6-1, with Commis- sioner Schaefer dissenting. She commented that she was in favor of the proposal but is against widening Fruitvale., 16. V-629 - Ralph Renna, Request for Design Review Approval for a second A-920 - story addition to a single family residence and Variance Approval for balconies which do not maintain the required sideyard setback at 15041 Sobey Road in an R-1-40,000 zoning district Staff explained the applications. They indicated that they could not make the findings for the variance and recommends denial. They commented that they can make the ,findings for the Design Review with the elimination of the c balconies. Commissioner McGoldrick referenced the letter from Mr. Hess and asked for clarif.ication. of the role of the inspector. The City Attorney commented that they have addressed this subject in prior correspondence to Mr. Renna's counsel. He stated that, as far as he is concerned, it is not the duty or obligation of the inspector to look for areas in which someone may have modified the approval plans without benefit of obtaining approval by the City for the modifications. He stated that .:.. Rich Harison, the Senior Inspector, has indicated that there may in fact be some question as to whether the inspector was back out there after the initial framing inspection was done. . He added that it has also been dis- covered that there has not been a final signoff on the drywall. If that argument is accepted at face value, the effect would be that an inspector, by not noticing some unauthorized change, in effect amends our Zoning Ordi- nance. Whether the inspector saw it or not seems to be in some dispute; whether he was out there or not is something that has not been determined, but he would take the position even further and say that even if he was, that doesn't legitimate an unauthorized change in the plan. He added that as far as he is concerned, the argument does not excuse the modification of the plan, and his recommendation would be to ignore it and treat the vari- ance on its merits. He commented that he is not saying that the Commission should not grant the variance; he is saying that the variance should not be granted based solely on that argument. He stated that the Commission should handle this like any other variance and an independent decision should be made on it. Rich Harison, Senior Inspector, gave the history of the project and the inspections. He stated that it was the recollection of the inspector, when he did the frame inspection, that the balconies and French doors were not installed at that time. Patric Kelly, attorney for the applicant, discussed the findings in the Staff Report. He reference letters from Mr. and Mrs. Janovich and Mr. and Mrs. Inman, in support of the project. He described the balconies and stated that Mr. Gaub of the .Central Fire District had commented that he was in favor of the balconies being there for the: question of safety and 'getting out of the second story in the event of a fire.
