Dear Commissioners and Staff:
This letter is a follow up to the one sent on May 3,1991,
outlining the rationale for our objection to any tail on Kerwin
Ranch.
Since that time, we have closely reviewed the draft of the Master
Trails Plan and noticed erroneous information in regard to our
property. For the record, we are clarifying the description of our
property on Wildcat Creek in Section 3.6,12.
The Segment 40 description states that an unofficial trail exists
along the creekside (Wildcat Creek) and that it is enjoyed by
"residents". In actuality, there is 'no creekside trail, nor any
public trail, official or unofficial, on our property. There is
a transit path across the orchard directly between Ronnie Way and
Fruitvale Ave. That path is not located on or near the creek, nor
is it intended for general public use.
We have given revocable permission under Civil Code 1008 to our
neighbors only in the bordering subdivision, as a courtesy and
convenience, to transit the property. The permission is for the
path only and only when there is no orchard work in progress in the
area. There are signs posted and the neighbors receive reminders
of our trespassing policy. (see Encl 1) This is our way of trying
to maintain an open orchard and still. extend a neighborly courtesy,,
In no way is~our policy intended as a precedent fora public trail.
In the light of the above information, we ask that you correct the
draft of the Master Trails Plan by deleting the erroneous
description and/or forward this request to the group now reviewing
the draft.

Dear Neighbor,
- The Kerwin Ranch consists of the eleven orohard acres located
near you on the east-side of Fruitvale Ave. For'the past three
years we have distributed a memo advising you of our orchard
program. and requesting your cooperation as our neighbors. The
response has been so positive that we have'decid~d tocontinue '
sending a similar memo each year shortly before harvest. '
-First and foremost we would-Tike to -extend our 'thanks for' your
interest and cooperation as we continue to maintain the orchard and
fruit production. In spite of the continuing drought, our 1990
harvest yield was about 10 tons-. While the yield was the same as
1989, direct sales from our fruit stand doubled to 4.2 tons with
over 1,200 customers during"a period of 10 days. Our fruit stand
is enjoying a growing reputation for top quality fruit at
reasonable prices. We are pleased to provide this service to the
community.' The entire proceeds from fruit stand sales are utilized
for orchard maintenance and planting young trees. We now have 406
mature apricot trees fn production. During the past three years
we have planted over 300 young trees, including 158 apricots, 67
prunes, 46 peach, 32 nectarine and i0 cherries. '
- The 1991 crop is slightly less in volume than 89 and 90. Th1s
is primarily due to the March rains which heavily thinned the buds.
We will again be marketing top quality fresh fruit by the basket
and by the lug for canners and jam makers. The stand is located
on Saratoga Ave at Lisa Marie Ct. It will be open 10-14 days from
the first picking to last. Fresh fruit is gold as it is picked.
Orders may be placed by phone at 867-1670.
- This year we have had some problems wfth.trespassing, including
shooting at fruit and birds with rocks and pellet guns, poaching,
picking blossoms and fruitwood. We remind you that we depend on
our neighbors good will and cooperation in order to continue
maintaining on open area. We would appreciate a phone call if you
observe people stealing fruit or vandalizing. In add~i,;,~,e
observe the following policies:

following tentative schedule for the City-wide Master Plan as well
as the working drawings for Beauchamps Park.
July 1st Parks & Recreation regular meeting - final
review of the Parks & Trails Master Plan.
July 7, 8 or 9th Staff meets with Wallace, Roberts & Todd to
determine final schematic design for
Beauchamps Park.
July 17th Council Meeting - Wallace, Roberts & Todd to
present final draft of Parks & Trails Master
Plan.
July 22nd Special public meeting of the Parks &
Recreation Commission to review and approve
the final schematic design for Beauchamps
Park. Notices to neighbors.
August 7th Council Meeting - Wallace, Roberts & Todd
presentation on Beauchamps Parks regarding
schematic design and final cost estimate.
Council will be made aware of the $120K
budgetary figure and new estimated cost of
proposed Park. Several alternatives:
1) phase development
2) use funds heretofore earmarked for
another Park
3) annex neighborhood to landscaping &
lighting assessment district to fund
shortfall
4) Etc.
Sept. 4 or 18th Final design of Beauchamps Park presented
to City Council requesting authorization
to go to bid
