SUBJECT: MEETING OF MONDAY, JULY 6, 1992
II.A. Architect, Jeffrey Heid, will present his final report on
Park improvements and costs for Wildwood Park.
Recommendation:
The Commissioners are being asked to review and approve final
plans for improvements at Wildwood Park as recommended
by staff and to direct staff to forward same to City Council
for their approval.
II.B. Wildwood Park Stage Area Repairs
Recommendation:
The Commissioners are being asked to direct staff to request
a $40,000 budget appropriation from Council for repair to the
stage area at Wildwood Park.
II.C. Abandonment of Chadwick Subdivision Tract 7770 Trail.
Recommendation:
This item was re-agendized from the May meeting so staff
could obtain additional data. Based on the information gained
from trail user, Bill Brooks, representing a large segment of
Saratoga equestrians, staff is recommending approval of the
abandonment of the Tract 7770 Trail. The Commissioners should
direct staff to transmit back to the Planning Department.

III.A. Revision of Rules/Regulations/Fees for E1 Quito Park
Community Gardens.
Recommendation:
Copies of Saratoga' s old rules and two other city' s rules have
been included in packet to assist Commissioners in comparing
our program with others. Commissioners are being asked to
approve new rules and forward same to Council for their
review and approval for the 1993 Gardening Season.
Please let Marlene know if you will be unable to attend this meeting.

SUBJECT: WILDWOOD PARK - STAGE REPAIR COST ESTIMATES

At the June Parks & Recreation Commission meeting, you were
informed of the ongoing maintenance needed for the wooden stage
area at Wildwood Park. The understructure of the stage is decaying
and it is very difficult to do adequate, safe repairs. As stated
to the Commission, repairs will no longer work and that by the end
of this summer, the stage area will have to be closed for public
use.
Asa result of a user's survey conducted by staff, which addressed
the stage size and orientation, all of the users agreed that the
current stage area is adequate.
The Commission decided not to change the overall design and
requested that staff develop a cost estimate for repairs to the
stage area.
Staff has discussed the needed repairs and replacement of the stage
decking with a local contractor. The cost estimate is
approximately $40,000 to repair or replace the under foisting along
with replacement of surface decking and perimeter railing.
This estimate appears to be at the high range due to the fact that
the extent of decay and damage is unknown at this time. The cost
approximation for repair reflects a worst case situation.

SUBJECT: WILDWOOD PARK - REPAIR TO STAGE
The purpose of this memo is to update you on the current condition
of the wooden stage at Wildwood Park. Staff continues to make
temporary repairs to the decking of the stage area. It is becoming
very difficult to do adequate safe repairs. The under-structure
of the stage is decaying to the point of soon having nothing left
to hold the nails. Currently, staff must nail down a small sheet
of plywood over three or four 2X4s to secure the loose boards. We
estimate that soon this method of repair will no longer work and
that by the end of this summer, the stage area will have to be
closed for public use.
A decision should be made very soon on a design change to the stage
area and when staff can schedule. the much needed repairs.

Enclosed-you will find a packet of information for the 1993
gardening season at the El Quito Park Community Garden. It
contains the Rules and Regulations, an Application anal a rough map
of the Garden.
Although this 199.2 growing season is not over, we are distributing
the applications early as there are some additional rules and
regulations as well as increased fees for you to consider. This
will also give you some time to make preparations for. the next
growing season.
We would like to point out that you may return your application
with your check and plot preference at any time between now and the
January 1st deadline. However, assignment of plots will be on a
first-come, first-choice basis as explained in the Rules and
Regulations.

COMMUNITY GARDEN PLOT PROGRM
RULES AND REGULATIONS
The Director of Maintenance or his designated representative will act as the
Community Garden Coordinator, hereafter referred to as "Coordinator".
1) All plots must be maintained in an acceptable manner, kept free of
debris and weeds. The surrounding paths are to be kept free of
weeds and debris.
2) Organic gardening techniques and fertilizers should be used at all
times. Any deviation must be reviewed and approved by the coordinator.
3) Should a plot be deemed neglected or abandoned, the plot holder will be
given 15 days to correct the problem or make other arrangements or their
fees and plot will be forfeited.
4) Plot holders will be asked to donate nine hours of their time per year
for the general upkeep of the Garden.
5} Trellises of any kind must be kept no higher than five feet. Fencing
is not permitted around the plots.
6) Plot holders will supply their own tools and water hose and will remove
them after each use.
7) Water should be used only when needed and not in excess, to prevent
runoff from becoming a problem to other plot holders. Gardeners are
asked to turn off all faucets when plots are unattended. Permanent
hose connectors are not allowed and hoses must be disengaged after each
use. Adherence to ordinances on water rationing hours, when in effect,
is mandatory.
To encourage water conservation, gardeners are required to stay in the
vicinity of their plots while watering.
8) Produce from the gardens is to be used for family consumption and not
as a commercial commodity.
9) Only flowers, fruits, vegetables and herbs may be grown in the plots.
Care should be taken so as to not shade your neighbor's plantings.
Animal husbandry is not allowed.
10) Compost piles may be made only in areas designated by the Coordinator.
No trash is permitted in compost piles.

11) Each plot holder shall be considerate of other plot holders and
should not engage in any activity that is deterimental to others.
12} Each plot holder will be issued a key to the gate which must be
returned at the conclusion of the rental agreement period. Gate
areas must be accessible at all times. Pathways must be maintained
on at least two sides of their plots.
13) No more than one plot per each individual or family shall be allowed
unless there is an excess of plots, and approved by the coordinator.
This excess will be determined each year by January 15th, at which
time additional plots may be assigned.
14) Plots are issued each January on a first-come, first-served basis.
Saratoga residents will have first priority over non-residents.
Every attempt will be made to provide those on waiting lists with
plots the following year.
15) Plot holders agree to abide by the rules and regulations of the
Community Garden Plot Program and will forfeit all fees paid and the
right to continued use of a plot if a violation occurs.
In the event of non-compliance with any of the rules and regulations,
the following procedure will be followed:
a) The plot holder in question will be issued a written warning.
b) At the end of a two week period, if the problem has not been
resolved, the plot will be reassigned to the next person on the
waiting list.
c) Plot holders may appeal any action to the Parks & Recreation
Commission in writing within 30 days of the notice of action.
The Commission will agendize the appeal for the next regularly
scheduled meeting and shall thereafter render a decision.

16) An annual plot fee will be assessed to all plot holders. The gardening
year is from January 1st through December 31st. Plot holders
may not begin gardening until their annual plot fee has been paid
in full. The rental fee is not transferrable. A new application and
fee are due by January 1st.

Non-Resident $35.00
17) All family members using the plot must sign below and must adhere to the
following statement:

and all liability for any injury which might be suffered by the under-
signed or his agent, arising out of or in any way connected with the

WHAT IS A aCN~JNITY GARDIII?
A c~alurnuiity garden is unused public or private land subdivided into plots for
per.~ons to grow their own vegetables, fruits, herbs and flowers. It can
produce as much as $800.00 worth of garden produce. It is recreational
activity in a neighborhood re-creating park setting.
HOW DID THIS IDEA ORIGIl~ATE?
This form of gardening has been popular in europe for aver 100 years and
current estimates show aver 3 million ocslmlunity gardens in use. Not until
Victory Gar3ens emerged in the United States did conurnmity gardening gather
widespread support on this continent. In 1944, 20 million gardens yielded 40
percent of the fresh vegetables consiuned. The envirorm~ental awareness of the
1970's and inflation/unemployment of the 1980's and still the 1990's have
brought a renewed interest in conmauiity gardens. Enthusiasm for ooa~mlunity
gardening lies in the discovery that these gardens can improve the quality of
life in an urban neighborhood "by beautifying neighborhoods, stimulating
social interaction, producing nutritious food, encouraging self reliance,
conserving resources and creating opportunities for recreation and education,
plus became less dependent on soup lines or government harxlouts".
WHO CAN PARTICIPATE?
Registration for garden plot is on a first cceltie, first served basis for San
Jose residents only. Awaiting list is maintained when there is no space
available at a particular garden. Gardens are billed for actual water cysts

number of garden plots available at the 15 garden sites ranges frown 15 to 210
plots. Comirninity gardens are located all around the whole city of San Jose
from Alviso to Coyote and Milpitas to Saratoga.

The Recreation, Parks and Ccarnrninity Services Department, Comm~anity Gardening
Coordinator acts as an information and referral service. There are special

1. All plots must be maintained in a manner acceptable to the Cairnnunity
Gardening Coon3inator. This includes normal. weeding, watering and general
care of the assigned plot. The surrounding pathways are to be kept free
of weeds, hoses and debris. Plots are to be planted at all times. Plot
not to be an eye sore. If no winter garden is planted, keep plot free of
weeds and debris and plant groundcover such as mustard, fava beans, etc.
2. New plots are issued on a year-to-year and first-cone-first-serve basis.
Any individual interested in obtaining a plot should contact the Community
Gardening Coordinator. If a plot is not available itt¢nediately, the
individual's name will be added to the waiting list. The waiting list is
to be posted at each garden. Only one plot is allofaed per family unit,
arr3 the family must reside in San Jose (no exceptions).
3. GarYiens will be confined to areas designated by the Community Gardening
Coordinator and must be at least three feet front the fence line. Notify
Comnninity Garden Volunteer Manager if you are giving up your plot, or if
you plan to turn it over to a friend, which is not allowed.
4. You may not begin gardening until your water fee is paid in full at a
suggested rate of eight cents per square foot. Anew application and
water fee is due by December 31 of each year, with c~~eck or money order
(NO CASfi). Annual water fee to be deposited in the Garden's name and
address on a checking account with three names and two required to write a
check. All bank statements to go to treasurer address not the garden's
address. A financial report given every Garden meeting held a minimtmt of
two per year.
5. Plotholder's are responsible for the contribution of twelve hours per year
to garden projects listed on the application and agreement sheet. Plot
holders are also responsible to keep all gates closed and locked at all
times. Garden is open from sun up to sun dawn.
6. Each Canutninity Garden Volunteer Manager is expected to provide the
Comnninity Gardening Coordinator with an up-to-date list of plotholder's
addresses and telephone rnm~bers printed or typed on an 8 1/2 x 11 sheet of
paper and the original applications no later than March 1 of each year.
-List is to be resubmitted any time there are changes.
7. The behavior of family members and friends is the plotholder's
responsibility. No one is permitted to engage in loud, offensive, or
boisterous activity or to be an instigator of such activities. Alcohol
within the Community Garden is a violation. If this occurs, the plot-
holder WILL SE DIST~SSID on the spot. If the offender is not aplot-
holder, he will be turned over the appropriate authorities.

8. Stealing is a violation. In the event of produce, plant or other
stealing, the plotholder WILL BE DISMISSID on the spot. If the offender
is not a plotholder, he or she will be turned over the the appropriate
authorities. (If not a plotholder, individuals should have an official
permission slip.)
9. Urinating in the garden is a violation. If this occurs, the plotholder
WILL BE DISNIISSID on the spot. If the offender is not a plotholder, he or
she will be turned over to the appropriate authorities.
10. Tall plants that produce shade on adjoining plots or protrude into
pathways are not allowed. All plants should be planted at least 12 inches
inside the plot line. Trellises can be installed on 2 sides of plot
only. Trellises or arbors of any kind must be no higher or wider than six
feet and must be at least 12 inches inside the plot line without walls or
floors. Trellises must have plants such as grape vines, chayote, etc.
Trees and fencing are not permitted in plots. Pathways are to be no less
than three feet and no more than six feet wide. Raised beds cannot be
more than 12 inches high. Any improvements are to be approved in advance
by the Caumiunity Gardening Coordinator. Arbors, trellises, raised beds,
etc. are not to be an eye sore.
11. Produce from the garden is to be used for family consumption and not as a
cx~zunercial commodity. Do not let produce go to waste; notify the
Conurnznity Garden Volunteer Manager so it can be given to the Food Bank or
others who can use it. Unharvested plots will be harvested by the Garden
Volunteer Manager with the produce being given to the Food Bank, Missions,
etc. More than two crops must be planted per plot.
12. Use of herbicides (chemicals that kill weeds), insec,~ticides (chemicals for
killing insects) and poison grains (for rodent control) are not allowed.

spraying.
13. Only vegetables, fruits, herbs and flowers may be grown in the plots.
Sugar cane, Dorn taller than six .feet, alfalfa, cactus, rire, fruit trees

14. 'Ib encourage water conservation, gardeners are required to stay in the
vicinity of their plats while watering, naalching and cultivating their
plots. Do not leave your plot unattended. Turn off all faucets. at
unattended plots. All hoses must have ashut-off valve at the end.
Remember that gardeners determine their own water fee oust, (use more -
pay more). Using plyers to open hose bibbs, leaky hoses, flushing of
gophers, watering plot before rntotilling or open hose bibb planting and
plants r~n~iring a lot of water are not permitted. E~tceept when watering
seedlings, Plats are to be watered no more than once per week. Rows
should be not more than six inches wide by four inches deep. Overhead
spraying or drip system is encotaraged. Watering hours are fr~cam 6:00 a.m.
to 10:00 a.m. and 4:00 p.m. to 8:00 p.m.
15. All loose materials (refuse, tools, hoses, etc.) must be cleared frozen the
pathways and must be oornfined to a designated area not all aver the plot.
Sheds of any kind are not pernutted in plots. Arbors aril tool sheds will
be confined to designate areas acxeptable to the Ccazmnzrzity Garclenirig
Coordinator and will be for the use of all plotholders.

16. Contact the Co~nm~nity Garden Volunteer Manager to use City's rollertiller
or to purchase the water keys and keys to the gates. Driving in is
allowed for deliveries acid pick-ups only, unless handicapped. (15-minute
maxitrnnn - no parking - No Exceptions)
17. Gardeners are encouraged to oft their own materials in areas
designated by the Cce~mnuiity Gardening Coordinator for that use and not in
plots. No trash is pern-itted in cogtg~ost piles. No rock or plant material
to be dumped in trash barrels. Ccetq~ost provided by City is for the Garden
use only. Raised beds and top soil is not to be renr~ve at any time.
18. Irr the event of non-ccs~q~liance with one or any of the above rules, .this
procedure will be followed:
A) The C~ununity Garden Volunteer Manager will issue a two week
written notice to the individual responsible for cultivation of
the plot. If you get more than 2 notices and each time work is
only started, but not completed just to meet dead line.

B) If, at the end of a two-week period, the problem has not been
solved, the plot will be reassigned to the next person on the
waiting list. Water fees WILL NOT BE REFTJNDID - no exceptions.
C) If a plotholder is di cm;~~ar9 frcan a Garden, he/she is dismissed
frnan the entire program. Plotholders that violate rules 7, 8, 9,
12, or 14 will be dismissed in¢nediately (no exceptions).
NOTE: Connminity Gardens are under the jurisdiction of the Recreation, Parks
and Co~ununity Services Department's Community Gardening Program
Volunteer Manager. The preceding rules and regulations are designed
to maintain a clean, safe and enjoyable ocernrnuiity gardening
experience. The finest fresh food is your own and city grown.
Individual gardens may develop additional rules and regulations as long as
they do not conflict with the citywide rules. Zhese rules are to be posted
at each garden. .Any exceptions to these rules shall be referred to the
Ccarn:ainity Gardening Coordinator.

CITY OF MILPITAS
COMMUNITY GARDEN RULES AND REGULATIONS
The Director of Parks & Leisure Services or his authorized representative will
act as the Community Garden Coordinator, hereafter referred to as "Coordinator."
2. An annual plot fee will be assessed to all plotholders. The fallowing fee
schedule will apply:
Milpitas Resident (beginning November 1, 1989) 330.00
Milpitas- Resident, Senior Citizen Sfi5.00
(55 years and over)
Non-Resident (beginning March 1, 1990) 345.00
3. Ali plots must be maintained in a manner acceptable to the Coordinator. This
includes normal weeding, watering and general care of the assigned plot. The
surrounding pathways are to be kept free of weeds and debris.
4. Plotholders may not begin gardening until their annual plot fee is paid in
full. Anew application and fee are due by October 15th each year.
5. The behavior of family members and friends is the plothoider's responsibility.
No one is permitted to engage in loud, offensive, or boisterous activity within
the garden enclosure.
b. It is the responsibility of each plotholder to provide the Coordinator with an
up-to-date address and telephone number.
~. 42w plots are issued on a first-come-first-served basis, Milpitas residents
will have first priority over non-residents to garden plats. Any individual
interested in obtaining a .plot should contact the Coordinator or Parks &
Leisure Services Office. If a plot is not available immediately, the
individual's name will be placed on a Waiting L-st. The City reserves the
right to hold up to 10~ of the plots for educational use by local schools
and/or City Programs.
8. Plotholders will be required to lock all gates upon leaving.
9 To encourage water conservation, gardeners are required to stay in the vicinity

10. Produce from the garden is to be used for family consumption and not as a
commercial commodity.
11. All loose materials (refuse, tools, etc.) must be cleared from the area each
day. Sheds of any kind are. not permitted in plots.
'2. Tall plants such as corn, sugar cane and sunflowers must be located such that
they do not produce shade on adjoining plots and do not protrude into
pathways. Trellises of any kind must be kept no higher than five (5) feet.
Trees and fencing are not permitted in plots.
3. Use of herbicides (chemicals that kill weeds) is not permitted. Insecticides
(chemicals for killing insects) is discouraged, and permitted only with the
consent of the Coordinator. Use of poison grains for rodent control is
prohibited_
No person may use a vacant plot without prior written approval from the
Coordinator and payment of the annual fee. Only one plat is allowed per
household. Gardens will be confined to designated areas.
~. Only flowers, fruits, vegetables, and herbs may be grown in the plots. Animal
husbandry is not allowed. No planting of poisonous and/or illegal plants.
16. Compost piles may be made anly in areas designated by the Coordinator for that
use. No trash .is permitted in compost piles.
17. in the event of non-compliance with any of the above rules, this procedure will
be followed:
a. The Coordinator will issue a written warning to the individual plotholder.
b. If at the end of a 30 day period the problem has not been solved, the plot
will be reassigned to the next person on the waiting list. der fees

c. Plotholders may appeal any action to the Community Gardep Advisory
Committee in writing within 30 days of notice of the action. The
Committee will agendize the appeal for the next regularly scheduled
meeting and shall thereafter render a decision. Oetisions of the
Committee may be appealed in writing within 30 days to the Parks,
Recreation and Cultural Arts Commission for final determination.
18. The theft of produce, plants, and/or other property will be cause for immediate
revocation of plotholder privileges and possible criminal prosecution. If the
individual involved is not a plotholder, he/she will be turned over to the
appropriate authorities.
19. Pets other than seeing eye dogs are not permitted in the garden at any time.
20. Personal vehicles are permitted on the garden premises only to load and unload
tools and materials. Upon completion, vehicles will be moved to Dixon Road for
parking. No parking is permitted on the site or surrounding
School/Retch-Hetchy property (see diagram).
21. Garden hours will be from two hours after sunrise until sunset. Power
equipment, i.e., fuel operated soil tillers shall not be used before 9:00 a.m.
and after 8:00 p.m., Monday-Friday, or before 1i:00 a.m. and after 6:00 p.m. on
Saturdays/Sundays and holidays.
