III. NEW BUSINESS
A) Midpeninsula Regional Ooen Space District presentation to
the Parks and Recreation Commission.
In an effort to insure that lines of communication and
information between the District and the City remain
open, the District is requesting to make a short 10-15
minute presentation to the Commission. This is an
opportunity for the Commission to question the District
regarding issues you may have. Scheduled to attend for
the District are Craig Britton, General Manager and
Malcolm Smith, Public Affairs Manager.
IV. WRITTEN COMMUNICATIONS
A) Letter from Save Our Neighborhoods Initiative Committee
Staff has notified Mr. Jim Shaw that the letter has been
agendized and the Commission may move to allow Mr. Shaw
or a Committee Representive to make a brief presentation
to the Commission regarding this issue. No action or
endorsement of the Initiative is necessary regarding this
matter.
B) Letter From Preston Burlingham Regarding Proposed
Composting Station at E1 Quito Park
Secretary Rizzo will discuss with the Commission the
discussion he has had with Barbara Mansfield regarding
the status of her proposed project.
C) Notice of Mini-Conference for Commissioners on Saturday,
October 21, 1995
Staff is requesting that all or some of the Commission
attend this Mini-Conference. Cost for this conference
will be picked up by the City.
D) Memorandum from Irene Jacobs regarding fall/winter editor
of The Saratogan.

Dear Commissioner:
By now, you may be aware of the Neighborhood Preservation
Initiative which was developed by a consortium of homeowners' groups
throughout the City. As signatories to the Initiative, we would like to make a
brief public presentation to your commission during a regularly scheduled
meeting in early September. Our purpose is to fully inform your commission
members and staff of the content and purpose of the Initiative. We expect that
this presentation should take no more than fifteen minutes, and we would be
happy to answer any of your questions about the initiative following the brief
presentation.
We believe that this is. the best way of quickly informing our City's
elected and appointed officials of an important land use proposal by the
residents of our community. We do not seek any endorsement of the Initiative
from your commission, but would welcome such an action if you deem that
appropriate. We hope that this approach will reduce the misunderstandings and
off-the-cuff comments that are already surfacing. Since this Initiative does
affect planning decisions in our City, we believe it is our responsibility to
inform all commissioners of its content and potential impact.
This is to formally request that this item be placed on your agenda at
your earliest convenience in September, 1995. Thank you in advance for your
serious consideration of this request and commitment to our community. For
your information and convenience we enclose a copy of the full text of the
Neighborhood Preservation Initiative and the Notice of Intent to Circulate the
Initiative Petition.

Notice Of Intent To Circulate Petition
Notice is hereby given by the persons whose names appear hereon of their intention to
• circulate the petition within the City of Saratoga for the purpose of preserving the integrity
and character of Saratoga's residential neighborhoods and remaining recreational open
space lands.
A statement of the reasons for the proposed action as contemplated in the petition is as
follows:
• The Saratoga City Council and Planning Commission vote against neighborhood
interests with great regularity.
• Changing low-density residential land to high-density, or changing residential land
to commercial, retail or industrial uses can substantially erode the quality of life in
surrounding neighborhoods.
• When a development proposal threatens the character or integrity of the surrounding
neighborhood because of the incompatibility or intensity of proposed land use, the
rest of the city often does not notice. When the Planning Commission and City
Council vote against the individual neighborhood, there is no practical recourse yet
the damage is permanent.
• The City's General Plan, a document written by the residents and typically updated
every ten years, should be a covenant between the City and the residents,
guaranteeing the stability and future direction of the city's individual
neighborhoods. Instead, our City Council treats the General Plan as if it is of little
consequence.
• This initiative will require a vote of the people in order to redesignate any residential
area to a higher denstty or to change any restdentially designated property to any
commercial use (including industrial, retail and professional uses).
• This initiative will also require a vote of the people in order to convert any property
that is currently designated in the General Plan as "Open Space Outdoor Recreation"
to any residential or commercial designation.
• This initiative will not affect the City's existing regulations concerning second
dwelling units ("granny units").
• There are two exceptions to the voter approval requirements of this initiative. The
City Council may themselves change land use designations for Residential and
Outdoor Recreation lands to more intensive residential uses if the City Council finds
that that change is essential to ensure that the housing element of the General Plan is
in full compliance with State law. The City Council may also change land use
designations to ensure that the General Plan policies do not create an -
unconstitutional taking of a landowner's property rights.
Other cities and counties have used similar initiatives, and a recent California
Supre;mc Court has held that citizens may amend their jurisdictions' General Plans
by initiative.

Mansfield site without having properly gone thru the process, nor the physical
inspection of the property, nor the consideration of other sites, nor the
absolute necessity of alerting those who would be most affected by the
proposal as to what the Commission was hearing last night.
Many of us had been told that we would be notified by mail as to when
this hearing was to be held. Neither of the day schools, none of the Community
Gardeners, none of the people in the HUD housing, and none of the people
owning apartments in the Sara Park cccnplex were notified by mail .Consequently
there were only about 8non-commissioners in the room.
It does not seem right, nor proper, that 1 person can tell the City of
. Saratoga where she intends to site a project without offering alternative
sites. No alternative site was even suggested by Mansfield. Quite the
contrary, any mention of even. looking for alternate sites was shouted down by
Mansfield in a loud, strident voice.
Regarding the school child drawing of the proposed site, the last time I
looked, yesterday afternoon, there were still various physical workout
structures built by the City as part of a fitness course which fall well
within the fence line proposed. Is this. course to be abandoned? Has anybody
been asked how they feel about the disappearance of their workout course?
I am not an authority on Aspergillus, but from what I heard last night,
the Commussion has given little attention to it and its possible effects.In
particular, its affects on the aged and ill. Yet nobody at City hall, nor
anybody in your Commission had the courtesy to notify the HUD occupants of
this hearing, yet they most certainly could be the most affected by this germ
as many are in their 80's, and many are not in the best of health. They would
be the number one candidates to sue the City if infection began. Nobody on
the Commission had given any consideration to City liability at this site.
If there is anything that many of us hate in the running of the City, it
is for a Commission to run off in a badly researched direction before those
that would be most involved even know about it. This is not right and
certainly should not happen in this case. Please explore all aspects of this
proposal before voting on it.
