SARATOGA PARKS AND RECREATION COMMISSION
• STUDY SESSION '
TIME: MONDAY, MAY 19, 1975 - 7:30 P.M.

1. ORGANIZATION
A. ROLL CALL
PRESENT: Commissioner Flora, Gordon, Schaefer and Terry.
ABSENT: Chairman Carlson
OTHERS PRESENT: Roy Swanson, Park Foreman; Don Burt, Assistant 'Planner
'~ The regular meeting of the Parks and Recreation Commission could not be held
for lack of a quorum; the Commission members present continued with a Study
Session.
II. OLD BUSINESS
A. REVIEW OF SUBDIVISION ORDINANCE
Don Burt of the Planning Department attended the Commission meeting to answer
REVIEW OF questions regarding the Subdivision Ordinance. ,
SUBDIVISION Commissioner Terry questioned park land that is on the Master Plan and the owner
ORDINANCE decides to subdivide whether this land must be offered to the City. This was
included in the old ordinance, but could not be found in the new ordinance. Don
Burt stated he would check this, as it should be in the new Subdivision Ordinance.
The Secretary stated that if land is private ownership it is not necessary to
offer to City, havever, if public ownerhip the land has to be offered to a public
agency according to Uvnership Laws. There is no way the City can force an owner
of property to sell to City, except by condemnation.
Commissioner Terry referred to Section 4 of the Map Act that states certain areas
can be reserved by the City by an ordinance that so states if acreage is nn a
master plan for parks and public use. The Secretary stated the City has never
exercised this and possibly this is one of the new additions of the Map Act.
Commissioner Terry also read 66479 and 66480 of the Map Act in regards to re-
nervation, and pointed out that in order to use the Map Act reservation clause
' ~' there has to be a local ordinance which so evokes it. Mr. Burt stated this was
a good point and another section would have to added to clarify this.
The Secretary questioned the wording in this same section of "developer offering":
it should read " avner offering", as the owner is who the City has to buy from.
This .vas agreed.
Commissioner Terry stated that as the Subdivision Ordinance stands now, the only
~vay the City can obtain a trail is if it runs along the side of a street or if
it is on the Master Trail Plan. If on the Master Trail Plan the sale is offered
to the City. Mr. Burt stated this is correct and if the owner does not agree to
the conditions applied, development plans may not be approved. Commissioner
Terry was concerned with this as it is not really stated as such in the Subdivi-
sion Ordinance.
Commissioner Terry pointed out that in Section 13.9-2 =1 of the Subdivision Ordi-
' Hance in regards to hillside development, this is the only place in the entire.
• Ordinance that trails are actually mentioned or defined, where they should be in
the general section of the Ordinance. It was requested that this wording on
trails and definition be modified and included in other sections of the Ordinanc~•.
Also resrrve and use set-up of the reservation section; primarily allc~ty the City
to require that the owner and/or developer offer to the City the items covered
in the Master Plan. Possibly an actual ordinance stating such.

Commissioner Terry stated that the present Subdivision Ordinance is based on
one section of the Map Act in regards to fees and formula, and it says [hat on
• lots of 50 or less a fee is all that is required. He questioned that nothing
is said about requiring trail dedication, except beside streets and the same is
true in regards to land for parks. Mr. Burt stated he was sure it is in the
' Ordinance but should be brought out more and clarified.
Mr. Burt reported that the square footage rate is being raised from an average
of $450 per unit to $806 for recreational facilities.
Commissioner Terry requested staff to do some figuring to give the Commission
an idea a~ to ho+•i much Parker Ranch fee ~•~ould be and possibly one other area of
the City.
The Secretary reported many of the questions of the Commission would be worked
out with the City Attorney and she would report back to the Commission.
B. SDR 1187 - STEKOLL DEVELOPMENT CO., TEN ACRES ROAD
Commissioner Terry reported he went out to the area and measured it and recommend•
SDR 1187 - TEN ed that the Planning Commission provide whatever easement is necessary to ensure
ACRES ROAD 6' wide of level pathway adjacent to the curb of Ten Acres Road.
The Secretary stated staff would take the Commission's suggestion into considera-
tion and write it into the conditions presented by the Land Development Committee
to the Planning Commission. '
C. OFFER TO SELL PROPERTY FROM DR. MICHAEL BLUMN
The Secretary provided the Commission a map of the area with a total of approxi-

PROPERTY FROM Commissioner Terry reported he hiked the property and it is mainly a big heavily
,DR. M. BLUMN brushed canyon. The average slope is 60°. As park land it would be of no
recreational use and felt that this acquisition should not be considered due to
the extreme slope of the area and no reasonable access.
• The Secretary stated that Dr. Blumn has asked the City Manager for an answer
and the item is scheduled 'for City Council meeting Wednesday, May 21, so she
would pass this information on to the City Manager.
III. NEW BUSINESS
A. JOINT MEETING WITH CITY COUNCIL ON TUESDAY, MAY 27 - REVIEW OF PARK BOND
PROPOSAL & HAKONE MASTER PLAN
The Secretary asked the Commission to review the basic reasons and comments

CITY COUNCIL - before the Commission meets with City Council. Two (2) new Commissioners will

~ HAKONE MASTER to be briefed before the joint meeting.
PLAN The Secretary felt the Park Bond election cannot take place in November because
of the time and work involved. A'citizens committee has to be assigned to
review and recommend and priorities established, but City Council has to make
this committment.
Commissioner Schaefer recommended a public hearing•to get the residents response
to a Park Bond election, rather .than a citizens committee.
Commissioner Terry stated there must be a cjtizens committee to gel things to-
gether, to push the issue, and go door-to-door, etc.
The Secretary stated that whatever the citizens committee proposes, it will come
back to the Parks and Recreation Commission for approval before going to City
Council. '
The Secretary stated that something the Commission might consider regarding
_ Hakone and mention at the joint meeting is charging for admission to Hakone
. just to cover maintenance costs.
The Secretary reported she would prepare a packet for the 2 new Commissioner's
' giving them all necessary information for the joint meeting.

iV. COMMITTEE AND STAFF REPORTS

B. STAFF REPORTS
1) RE' STAMPER PROPERTY
The Secretary reported she was informed late Wednesday, May 14 by a real
estate agent that the Stamper property was on multiple listing.
The Secretary explained that the City had been negotiating with Clara
Stamper for purchase of this property when she passed array. The City re-
quested to buy the property before her children divided it among them.
One of the sons, Donald Stamper is the executor, and is the one who has
put it on multiple listing,
This property was planned as an athletic facility at Congress Springs Park,
and is an ideal location within a residential area. it is bounded on one
side by Southern Pacific Railroad and State owned transportation corridor
on the other. Across the street from one end is a PGEE Power Station and
Saratoga Creek is the boundary on the other end.
Mr. Stamper has stated the following offer to the City:
- Full list price of $160,000.
- Maximum payoff period being 5 years.
- Full interest currently being paid on land purchases.
- All carrying costs such as taxes to be paid by City - $2,595.
The Secretary stated she is asking the City 'Manager to negotiate for this
property, even if the City has to go all the way to condemnation.
. The Commission requested staff to take this matter to the City Manager and
negotiate for this property as it is designated for park purposes in the
General Plan and the City has a site plan for development prepared by an
architect.
V. COMMUNtCATtONS
A. REPORT FROM MlDPENiNSULA REGtONAI PARK DISTRICT
The Secretary reported that the Midpeninsula Park District has accepted the
Congress Springs open space reserve from the Saratoga School District, with the
only contingency being that the school may use it as needed for the next 20 years
The Secretary stated that she~has asked the Park District before any land
management policies are put into policy that the Parks and Recreation Commission
review it first.
The Secretary reviewed for the new Commissioner's what Midpeninsula Regional
Park District is and what their objectives are.
Commissioner Fiora requested some written information on the Park District
to review.

There being no further items for discussion, the Commission's study session adjourned
at 9:40 p.m.

SUBJECT: May 19 Agenda
Maps outlining the location of SDR 1187 and the Bluhm property are enclosed
for your review prior to the meeting. I would like to point out that this
property is outside the City limits but within the sphere of influence.
The Commission should take the time at this meeting to completely review the
Park Bond Issue Proposal as presented to City Council; also the recent Hakone
• Status Report and Master Plan. We want to make sure all are headed in the
same general direction before meeting with Council on May 27. There is also
the question to discuss about date of possible bond issue election, if Council
approves. In January we had recommended an issue be prepared for a November
election. We have lost almost 5 months and there may not be sufficient time
to prepare, so the Commission should be ready to recommend an alternate date.
The communications from Midpeninsula Regional Park District are for your
information. The City Council has endorsed the concept of the Midpeninsula
Regional Park District purchasing the Fremont Older Open Space Preserve and
this communication was sent to the Board of Directors in September, 1974.
The Congress Springs open space reserve is a gift from the School District
to the District. I will have some information for you about the relationship
of both areas to Saratoga's sphere of influence. Although action on both
items is scheduled for the Board's May 14 meeting, I personally do not have
any objections to the District assuming the responsibility for this open
space, and feel the Commission should take an active role when use of the
area is to be determined.
