HomeMy WebLinkAbout09-09-1974 Parks and Recreation Commission Minutes• • SARATOGA PARKS AND RECREATION COMMISSION MINUTES TIME: MONDAY, SEPTEMBER 9, 1974 - 7:30 P.M, PLACE: CRISP MEMORIAL CONFERENCE ROOM, SARATOGA CITY OFFICES, 13777 FRUITVALE AVENUE, SARATOGA, CALIFORNIA 95070 TYPE: REGULAR MEETING I. ORGANIZATION A. ROLL CALL PRESENT: Commissioners Buchanan, Carlson, Clawson, Gordon, Rose, ' Wilberding and Zambetti. ABSENT: Commissioner Terry. B. MINUTES The minutes of the August 19, 1974 meeting were approved as corrected. II. OLD BUSINESS A. TRAIL EASEMENT, DIVIDEND INDUSTRIES The Secretary reported her findings regarding easements. There is no TRAIL EASEMENT, such thing as a dedicated easement. An easement is land that the City DIVIDEND INDUSTRIES uses. Dedication is when the City owns it. The City Attorney has been asked for a legal opinion as to whether trails comes under the park in-lieu fee. It is not stated in the Subdivision Ordinance and there is a different interpretation among staff as to whether a trail dedication is applicable to be used for park in-lieu fees. At the same time the Planning Director is working to revise the Subdivision Ordinance so that is is alot clearer and more meaningful because of all the legal terminology. Chairman Wilberding questioned the different park fees and park dedi- cation. The Secretary explained that in the Subdivision Ordinance, the gross that they must dedicate for parks is 1.2% of the total land or 1.2% of the value of the land. The Secretary stated that if the Commission constantly allows the dedication of property for trails to be used as park in-lieu fees, then the Commission is going to be losing actual cash, which it needs for park development. Budgeted in this years budget is approximately $15,000 in park in-lieu fees coming from developers, subdividers, builders, etc. If the Commission accepts dedication of land instead of fees the revenue will be reduced accordingly and the Commission should carefully review this action. Commissioner Carlson proposed that the Commission look into the ordinance regarding trails and explore the possibility of trail easements as opposed to trail ownership. • • PARKS AND RECREATION COMMISSION - MINUTES - SEPTEMBER 9, 1974 - continued Chairman Wilberding suggested that the Commission investigate to see what other cities are doing in regards to trails. Commissioner Carlson asked if the City Attorney could attend a Parks and Recreation Commission meeting and explain some items regarding trail dedication and easements, and exactly what the Subdivision Ordinance says. The Secretary will talk with the City Attorney and find out a possible course of action this Commission can take and its options. The Commission decided that their previous recommendation regard- ing the Dividend Industries development would stand. B. FINAL CONTRACT AWARDED FOR DEVELOPMENT OF BROOKGLEN PARK The Secretary reported that the City Council at their meeting on FINAL CONTRACT - August 21 awarded the bid for Alternates ~kl, 2, and 3 and $2,600 DEVELOPMENT OF for the Community Projects at Brookglen Park. BROOKGLEN PARK The contractor has signed the initial contxact and has a bond in and is ready to go to work. C. ESTABLISH TENTATIVE DATES FOR COMMUNITY FENCE BUILDING PROJECT AT BROOKGLEN PARK DATES FOR FENCE BUILDING AT BROOKGLEN PARK September 28 and 29 at 9:00 a.m. were the dates set for the fence building at Brookglen Park. Commissioner Carlson will send out a newsletter to all residents in the area, and a news release will be sent out to the papers by the Secretary. The measuring and marking of the post holes can actually be done beforehand by the Architect and/or Park Foreman. The Secretary will check on renting a cement mixer or if the cement can be mixed by the volunteers. However, the City will rent a post hole digger. The Secretary questioned the idea of the architect or a staff member as head of this committee, instead of having a community volunteer. The Commission agreed that a chairman should be appointed among the community to get a work group together and oversee everything, but that the architect or a staff member should head the committee. Commissioner Carlson will report back to the Commission at their September 23 meeting as to the progress on community help. III, NEW BUSINESS A. PROGRESS REPORT ON DEVELOPMENT OF GARDINER PARK The Secretary reported that an agreement has been reached with the PROGRESS REPORT ON Santa Clara Valley Water District and except for the fourth reseeding DEVELOPMENT OF of the park, Gardiner is ready for acceptance. GARDINER PARK The actual acceptance of completion of work will be the end of September. -2- • • PARKS AND RECREATION COMMISSION - MINUTES - SEPTEMBER 9, 1974 - continued B. ESTABLISH DATE FOR OFFICIAL DEDICATION OF GARDINER PARK Commissioner Zambetti moved that the official dedication of Gardiner DATE FOR Park be set for Sunday, October 20 at 1:00 p.m., or as an alternate DEDICATION OF October 27 at 1:00 p.m.. Commissioner Rose seconded the motion, and GARDINER PARK it was passed unanimously. C. RECOMMENDATIONS TO CITY COUNCIL REGARDING THE SANTA CLARA COUNTY OPEN SPACE ACTION PROGRAM The Secretary explained two recommendationsthat she thought would be RECOMMENDATIONS TO of interest to the Commission: CITY COUNCIL RE: SANTA CLARA COUNTY 1) Action Matrix: Urban Open Space Resources - Page 5 OPEN SPACE ACTION Under Appropriate Cities add Parks and Recreation Commission PROGRAM as (P) PARTICIPANT in the implementation process for recommen- dation ~2. 2) Action Matrix: North Valley - Page 21 Under Appropriate Cities add Parks and Recreation Commission as (P) PARTICIPANT in the implementation process and/or (*) INITIATOR of implementation action for - Streamside Park Chains: Recommendations ~~2 and ~k4. Neighborhood & Community Parks: Recommendations ~~1, ~~2 & ~k3. Trails & Bikeways: Recommendations ~~1, ~~2 & ~~3. The Secretary felt everything has been included otherwise, and alot of research has done into the program. Commissioner Gordon moved that "Parks and Recreation Commission" be included wherever the program reads "Parks and Recreation Department". Also that the "Parks and Recreation Commission" be added to the Action Matrix of Urban Open Space Resources. Commissioner Carlson seconded the motion, and it was passed unanimously. IV. COMMITTEE AND STAFF REPORTS A. COMMITTEE REPORTS 1. RE: HAKONE REVIEW COMMITTEE The Secretary reported that the Hakone Review Committee did not meet as scheduled on August 28, as they did not have a quorum. The next scheduled meeting is set for Tuesday, September 17 and notices will be sent out. 2. RE: TRAILS AND PATHWAYS TASK FORCE The Secretary reported that the Trails and Pathways Task Force did not meet as scheduled on August 29, as they did not have a quorum. The next meeting is scheduled for September 12. B. STAFF REPORTS 1. RE: DOUGLASS LANE PATHWAY The Secretary reported that City Council waived the condition on Douglass Lane, so George Day Construction Company is no longer required to provide the unimproved pathway. Legally, the City did not have much choice as the pathway did not appear on the final approved site map, and it was not included in the information provided to the homeowners. -3- • • PARKS AND RECREATION COMMISSION - MINUTES - SEPTEMBER 9, 1974 - continued C. ITEMS INITIATED BY COMMISSIONER'S Commissioner Rose asked if a report could be sent to the Commission and the Trails and Pathways Task Force, as to where the bike routes are completed now in Saratoga, and the cost. Chairman Wilberding suggested that a bike education program be started in the schools, showing the different bike routes leading to the different schools, and at the same time discuss bike safety. V.
