July 10, 1974 SUBJECT: Trail Easement, Dividend Industries, SD 1110 ------------------------------------------------------------------------------------------------ The Parks and Recreation Commission has determined the trail easement location as stated in Condition "X" of the Staff Report on Dividend Industries SD 1110. Mr. Walter Muir of Dividend Industries met with the Commission at their regular meeting on July 1, 1974. Members of the Commission, Mr. Muir and two representa- tives of MacKay and Somps Engineering Firm toured the site on Saturday, July 6. • The Commission held an adjourned regular meeting on Monday, July 8, 1974 to determine the best trail easement. The recommendation is as follows. That the street Carnelian Glen be relocated ten (10') feet to the north of its present location and that the trail be on the south side of Carnelian Glen. The trail would run from Saratoga-Los. Gatos Road to the cul-de-sac to connect with the Sanitary Sewer Easement which runs from the end of the cul-de-sac almost to the end of the property on the northern boundary line. Instead of staying on the sewer easement as it turns across the property, it is recommended that the trail continue to the edge of the property; then the Commission will work with the owner of the Durham property for an easement to Douglass Lane. The width of the trail shall be ten (10') feet the entire length. The portion from Saratoga-Los Gatos Road to just past the south corner of Lot 11 shall require a full ten (10) foot dedicated easement; from that point to the end of the cul-de-sac only 6.5 feet will need to be dedicated if we are allowed to use the 3.5 foot public right of way portion of the street. The full ten (10') feet will again be necessary from the sewer easement to the edge of the property. It is also recommended that the trail be dedicated as part of the street, and therefore the City will be responsible for :Tevelopment and maintenance of ::he trail. It is further recommended that as a result of this dedication that Park in Lieu fees be waived. The suggested development of the trail would be gravel pathway with header boards and proper drainage. This easement has been recommended for the following reasons: 1. It crosses the least number of private lots, touching on only seven (7); (other easements would have touched on 12-19 private lots). 2. It is easier to develop, maintain and control. ~5 ~ • Planning Commission • July 10, 1974 Page 2 3. The area along the creek would not only be adjacent to 19 private lots, it would require a great deal of clearing and leveling to develop, as well as a much greater problem of maintenance and control. 4. The Parks and Recreation Commission feels that this is the least damaging to the developer and potential residents. If the street cannot be relocated, then the Parks and Recreation Commission recommends that the trail be located on the north side of Carnelian Glen to the cul-de-sac, then onto the sewer easement. The offer of an easement to the City and recording of a parcel map with an • easement depicted would be required at the time of Final Building Site Approval. The specifics of the condition (i.e., easement location) has been left open as to allow Parks and Recreation the opportunity•to designate the most functional align- ment; similarly, this also provides the developer with some flexibility. June 27, 1974 I will have the final cost estimates on Brookglen Park, as prepared for City Council on a schematic drawing which will also be presented at Council meeting. Mr. Walter Muir of Dividend Industries will be attending the meeting to work out the easement for trail purposes that is Condition X of SD 1110 approval. • (Please see memo from Charles Rowe) I have also enclosed for you a copy of the site location of this development and you will note that a tributary of Wildwood Creek runs the length of the development on the Northwest side. This is marked as a master trail site on our present plan. t~ What the Commission must do is to comply with the Planning Commission condition ,and establish by mutual agreement what and where the easement will be. The Capital Improvement Program is set for Public Hearing by the City Council on Wednesday, July 17.
