At City Council meeting on August 7, Council awarded the contract for develop-
ment of Brookglen Park to Palo Alto Landscaping. The award was for base bid
items ~~1-14 at a cost of $21,929.50. Prior to the actual vote much discussion
was held on the subject of monies for fencing and the alternates, G. Carlson
spoke as did several residents. The final vote for base bid only was 3-2. I
feel that the two negative votes were cast because the two Councilmen wanted
additional monies allocated, not because they were against the project. As a
result, the Mayor directed staff to ask the contractor to hold the bid on the
alternates open until August 21 Council meeting, and referred the Community
Projects (fencing) and alternates back to the Parks and Recreation Commission.
It is now up to the Commission to review your financial priorities of the
funds approved for expenditure this year, and determine if you want to make
a "trade" in order to have Brookglen Park completed with initial development,
I have enclosed a copy of the adopted Parks Capital Improvement Program for
1974-75 for you to study. I have also marked with (C) those funds committed,
which does not leave much of a choice. Also to be considered is the fact that
the alternates are to be done if monies are available, and that it is difficult
to use revenue sharing funds for development because of the laws involved, so
ideally the trade must be made from those listed under Capital Improvement Fund,
which leaves you two choices - Wildwood retaining wall or Hakone Gardens.
City Manager Robert Beyer, will attempt to have for the Commission meeting an
estimate as to total Capital Improvement Fund projects, so he can determine if
money will be available for the alternates, If it is, then you could trade
one or both of the alternates for Brookglen. Keep in mind the total cost of
the fencing and alternates is $8,090.
It is imperative that we make a decision on August 19, for the contractor has
agreed to hold his bid price open only until the August 21 Council meeting.
If the alternates are not awarded as contract at that meeting, the bid cost
is no longer valid.
Because many are on vacation, and the question of having a quorum present at
the meeting must be considered, I will contact each of you to find out if you
are or are not going to be at the meeting. If we do not have a quorum, no
action can be taken.

The rest of the agenda is fairly light. I will attempt to have all the
answers regarding the Dividend Industries trail dedication, but it looks
right now like some will have to be legal interpretations.
Reminder - the joint meeting with City Council and Planning Commission
on the Open Space Action Program is scheduled for Tuesday, August 27,
and the next Hakone Review Committee meeting is set for August 28.

Subject: Douglas Lane Pathway
Dear Mr. Hauer:
Thank you for your letter of August 5 which I received in my Planning Commission
packet on August 12th. I fully appreciate the awkward situation in cahich residents
of Tract 5150 on Douglas Lane find themselves because of the pathway easement re-
quired there.
However, inasmuch as the City is hoping to preserve land for an inter-connecting
pathway system, the Planning Commission could not ignore the need to acquire this
easement before building took place. It is most unfortunate that site plans exhibited
• to you by the builder did not make the existence of this easement clear.
This matter has now passed from the Planning Commission to the City Council who
will be hearing your appeal and receiving input from the Pathc~aay Committee of the
Parks and Recreation Commission. I will pass your comments on to ris. Barbara
Sampson who is the Staff's liaison for the Parks & Recreation Conanission. It is
possible that further study by the Council and Pathway Committee can work out alter-
natives which would preserve a pathway route through this area and meet your needs
as well.
As to the common green area problems you mentioned, the Planning Commission has
finally rung full cooperation from George Day to bring both the planting. and irri-
gation system to a satisfactory situation. It has been an uphill fight, but well
worth it to achieve the effects tae all desire.

Since purchasing lot 10 we have fully complied with
the recorded, stated and implyed goals for Tract 5150.
Our corner lot boarders on two common areas; lot 19
and lot 21. The builder, George Day, has not lived up
to his part of the common area agreement, especially
when it comes to maintance. So, in the mean time, we
have provided portable sprinklers, watered, weeded, -.
killed gophers, etc. Now it appears that the City
• wants to punish those consceintious homeowners that
cooperated with City plans by tearing up their front
yards to put in a dirt horse path. While at the same
time George Day Construction, who is open in defiance
of the City and the Planning Commission, is continually
rewarded with variances, building permits, favorable
inspections, etc.
The proposed horse trail/pathway is wrong. It is
wrong from the legal stand point. It is wrong because
it does not accomplish the goals of a rural pathway.
It is wrong because it is a misallocation of taxpayers
money. And, it is also wrong because it is unfair
to the homeowners on Douglas Lane.
Enclosed is a copy of my letter to City Manager,
Robert Beyer. It details some reasons why the City
should not install a dirt pathway on the north side
of Douglas Lane. One of the key things is the pathway

would be of questionable value to a few at great
inconvience to the homeowners and a large expense
for the taxpayers. Therefore, I ask your help in
stopping this mistake before it happens. If there
is anything I can do please let me know.
