REMINDER - BEAUCHAMPS PARK DEDICATION SATURDAY MAY 1, 1993 9:30AM
III. A. DR-88-057.1 12532 Parker Ranch Road
At time of final inspection it was noted the builder had
constructed two large pillars adjacent to the back of the curb
within the trail easement. Additionally, a low retaining wall
which cuts across the easement was constructed. The owners
have decided to appeal the condition which requires the trail
be kept clear of obstacles on the basis the neighbors have
constructed improvements within the easement. Please try to
visit the site so that at the meeting, the commission can
render a decision. Since the location is very close to
Beauchamps Park, a site visit may be done in conjunction with
Beauchamps Park dedication.
Recommendation:
Commissioners should review site and determine if strict
compliance of conditions should be enforced or if the
conditions should be modified or eliminated.

Staff has reviewed the Trails Master Plan and has determined
the subject application requires no trail requirements.
Recommendation:
No conditions required.

SUBJECT: DR-88-057
As requested, I have inspected the subject site and have determined
that conditions 5) and 16) have not been complied with, wherein
that two columhs and a retaining wall have been constructed within
the pedestrian/equestrian easement.
Mr. and Mrs. Lin have decided to appeal those specific conditions,
and request that they be allowed to take occupancy while their
appeal is being heard. To facilitate that request, I have had the
City attorney prepare the attached agreement and Mrs. Lin has
applied for reconsideration of conditions.
Mrs . Rose Lin has signed the agreement and has posted a bond in the
amount of $912 to cover the cost of removing the improvements
within the easement. She will return tomorrow with her husband's
signature and until that time, I am suggesting that occupancy not
be withheld since the City has full assurance that either the
conditions or the obstruction will be removed.

CITY OF SARATOGA PLANNING COMMISSION
STATE OF CALIFORNIA
LIN, 12532 PARKER RANCH ROAD
WHEREAS, the City of Saratoga Planning Commission has
received an application for design review approval of a new 5,599
sq. ft. two-story single family dwelling at 12532 Parker Ranch Road,
and;
WHEREAS, the Planning Commission held a duly noticed public
hearing at which time all interested parties were given a full
opportunity to be heard and to present evidence, and;
WHEREAS, the applicant has met the burden of proof required
to support said application, and the following findings have been
determined:
-The height, elevation and placement of the project on the site
does not unreasonably interfere with views of the surrounding
residences in that the ridge of the roof is lower than Parker
Ranch Road elevation and will not interfere with the view from
the street or the adjacent properties.
-The project does not unreasonably interfere with the privacy of
the surrounding residences in that the side yard setbacks
maintained, are large than the minimum standard, the rear
elevation is facing an open space area, and the number of second
story windows at the side elevations is not excessive.
-The natural landscape is being preserved by minimizing tree
removal, soil removal, and grade changes in that no tree removal
is necessary and the proposed grading of 1,350 cu. yds. is
reasonable for a steep lot of 36$ slope under the building site.
the design of the home along the topographic contour lines
reduces the volume of soil removal for the proposed structure.
-The project will minimize the perception of excessive-bulk in
' relation to the immediate neighborhood in that the home is below
the street level, appears as one story from the street, and is
stepped down the hill. As such, the front and side elevations
does not appear bulky. The revised rear elevation is designed
with horizontal articulations, combination of materials and
colors, and is reduced in length. As such, the elevation will
not appear excessively bulky in spite of its length.
Landscaping is proposed along the rear elevation which will
soften the elevation and reduces its bulk.

-The project is compatible in terms of bulk and height with
those homes within the immediate area and in the same zoning
district in that the home is 5,599 sq. ft. and 26' high. Other
two-story homes similar in size and height exist in the
surrounding neighborhood. The proposed materials and colors are
compatible with the natural environment and the proposed home
will not stand out within its surroundings.
-The project will not interfere with the light, air, and solar
access of adjacent properties in that the proposed home is
located on a large lot and maintains adequate setbacks.
-The plan does incorporate current Saratoga grading and erosion
control standards in that the amount of cut proposed is
reasonable to the steep lot and the 9.5 cut complies with the 10
ft. maximum cut allowed per the Building Code. Erosion control
measures will be incorporated in accordance with the City
Engineer requirements.
NOW, THEREFORE, the Planning Commission of the City of
Saratoga does hereby resolve as follows:
Section 1. After careful consideration of the site plan,
architectural drawings, plans and other exhibits submitted in
connection with this matter, the application of Edward & Rose Lin
for design review approval be and the same is hereby granted subject
to the following conditions:
1. The development shall be located and constructed as shown on
Exhibit "A", incorporated by reference.
2. Prior to submittal for building permit or grading permit, a
zone clearance shall be obtained from the Planning Department.
3. The maximum height of an exposed underfloor area shall not
exceed 5 ft.
4. No retaining wall shall have an exposed height that exceeds 5
ft.
5. No structure shall be permitted in the scenic, Public service
and pedestrian/equestrian easements.
6. No ordinance size tree shall be removed without design review
approval per subdivision condition.
7. No recreational courts are permitted per subdivision
condition.
8. Slopes shall be graded to a maximum 3:1 slope.

9. No pool (excluding spa) shall be permitted per subdivision
conditions, since slope is over 20$ at all areas of the lot.
10. Exterior colors shall be beige for wood siding and dark brown
for brick and roof.
li. Landscaping for screening along rear elevation shall be
installed to soften the rear elevation.
Prior to issuance of building permits, applicant shall
submit landscaping plans for the Planning Director's review
and approval. The applicant shall deposit with the city a
bond of the estimated amount of the landscaping value to
assure performance of the condition upon removal of the
restriction on landscaping when drought conditions no longer
exist.
12. Applicant shall submit a geotechnical investigation and report
by licensed professional to include details on:
a.) Soils
b.) Geology
13. Detailed on-site improvement plans showing the following shall
be submitted to the Building Division prior to issuance of
a zone clearance:
a.) Grading (limits of cuts, fills; slopes, .~cross-
sections, existing and proposed elevations,
earthwork quantities)
b~ Drainage details (conduit type, slope, outfall,
location, etc.)
c.) Retaining structures including design by A.I.A. or
- R.C.E. for walls 3 feet or higher
d.) Erosion control measures
e.) Standard information to include titleblock, plot
plan using record data, location map, north arrow,
sheet no's. owner's name, etc.
14. Property is located in a designated hazardous fire area.
a. Roof covering shall be fire retardant, Uniform Building
Code Class A or B prepared or built-up roofing. Re-
roofing, less than 10$, shall be exempt. (Ref. Uniform
Fire Code Appendix E, City of Saratoga Code 16-20:210).
b. Early Warning Fire Alarm System shall be installed and
maintained in accordance with the provisions of Article
16-60 City of Saratoga.

c. Early Warning Fire Alarm System shall have documentation
relative to the proposed installation and shall be
submitted to the Fire District for approval, prior to
issuance of a building permit (City of Saratoga 16-60).
d. Automatic sprinklers shall be installed in garages and/or
carports with the capacity to accomodate three or more
automobiles (City of Saratoga Code 16-15:110).
15. Driveways: All driveways have a 14 ft. minimum width plus one
ft. shoulders.
a. Slopes from 11$ to 15$ shall be surfaced using 2-1/2" of
A.C. or better on 6" aggregate base from a public street
to proposed dwelling.
16. The equestrian trail shall be graded to comparatively level
path from side to side, and shall be a minimum of 8 ft. wide
with additional land if necessary to go around obstructions.

conditions within 30 days of the passage of this resolution or said
resolution shall be void.
Section 3. Construction must be commenced within 24 months or
approval will expire.
Section 4. All applicable requirements of the State, County,
City and other Governmental entities must be met.
Section 5. The applicant shall affix a copy of this
resolution to each set of construction plans which will be submitted
to the Building Division when applying for a building permit.
Section 6. Unless appealed pursuant to the requirements of
Article 15-90 of the Saratoga City Code, this Resolution shall
become effective ten (l0) days from the date of adoption.

STATE OF CALIFORNIA

WHEREAS, The City of Saratoga Planning Commission has received
an application for variance approval to allow the construction of
the home on a 36$ slope under the building site where 30~ is the
maximum allowed, at 12532 Parker Ranch Road; and
WHEREAS, the Planning Commission has conducted a duly noticed
public hearing at which time all interested parties were given a
full opportunity to be heard and to present evidence; and
WHEREAS, the applicant has met the burden of proof required to
support his said application, and the Planning Commission makes the
following findings:
A strict or literal interpretation of the Zoning Ordinance would
result in practical difficulty or unnecessary physical hardship
inconsistent with the objectives of the Ordinance in that the
restriction on slope under the building site applies mainly for
steep lots with unstable soil conditions. The subject lot was not
identified by the City Geologist as one with potential earth
movements of major concerns. The geological recommendations and
appropriate erosion control measures will be followed so that the
construction will not result in significant envirorunental impacts.
Exceptional or extraordinary physical circumstances exist that are
applicable to the property involved or to the intended use of the
property which do not apply generally to other properties in the
same zoning district in that the average slope on the lot is 34~ and
a very large open space easement covers about 50$ of the lot which
limit the location of the home to 36~ of the building site.
Strict or literal interpretation and enforcement of the specified
regulation of the Zoning Ordinance would deprive the applicant of
privileges enjoyed by owners of other properties classified in the
same zoning district in that no other practical building site of 30~
slope or less exists on the lot. Strict interpretation of the Code
will not allow the owner to develop the property.
Granting of the Variance will not constitute a grant of special
privilege inconsistent with the limitations on other properties in
the same zoning district in that the Planning Commission approved
number of variances for other lots in the same subdivision including
the adjacent lot to the left, to allow construction on building
sites of more than 30$ slope.
Granting the Variance will not be detrimental to the public health,
safety or welfare, or materially injurious to properties or
improvements in the vicinity in that the applicant will prepare and
follow geotechnical investigation and soil report and will
incorporate all the requirement of the City Engineer for erosion

control measures. As such the project will have no adverse impact
on the environment.
NOW, THEREFORE, the Planning Commission of the City of
Saratoga does hereby resolve as follows:

PEDESTRIAN/EQUESTRIAN TRAILS

At the last Commission meeting of December 7, 1992, the
Commissioners generated guidelines for the development of
pedestrian/equestrian trails to impose on future design review,
site and subdivision applications.
Following will serve as guidelines which can be modified as applied
to specific applications.
Standard Pedestrian/Equestrian Guidelines for Conditions of Site
Development•
- Dedicate pedestrian/equestrian easements along (describe
locations).
- Prior to issuance of any certificates of occupancy and subject to
the review and approval of the Parks & Recreation Commission, the
applicant shall improve the pedestrian/equestrian easement(s)
within the development to the "Trail Design Standards and
Details" called out in the Chapter 3.7 of the City's Parks and
Trails Master Plan.
