RESOLUTION N0. 100-1
A RESOLUTION AMENDING RESOLUTION NO. !00, ENTITLED "A RES01~TION APPOINTING ENGINEER AND ATTORNEYS"
MT. EDEN ESTATES
ASSESSME DISTRICT NO. 1
RESOLVED, by the City Council of the City of Saratoga,
California, that the Resolution cited in the title, adopted by
this Council on July 5, 1961, is amended to add paragraph 4
thereto, to read as follows:
"4. In the event the proceedings are abandoned or otherwise
terminated by the City prior to the award of contract for the
work~ the combined legal fees and engineering fees payable under
this Resolution shall not exceed the amount of One Thousand
Dollars ($1,000.00), less whatever costs have been incurred by
the City to that date for publication, posting and mailing of
notices of hearing. Said portion of said $1,000.00 shall be
divided between the Engineer and the attorneys in the ratio that
the total fees of each would bear to the total ultimate fees pay-
able to both had the proceedings not been so abandoned or ter-
minated."
I hereby certify that the foregoing is a full, true and
correct copy of a resolution duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting thereof
held on the 19th day of July~ 1961, by the following vote of the
members thereof:
AYES, and in favor thereof, Councilmen: Glennon, Drake,
Langwill, Harkman
NOES, Councilmen: None
