RESOLUTION NO. 108
A RESOLUTION OF INTENTION TO CONSTRUCT IMPROVR4ENTS
MT. EDEN ESTATES
~ ASSESSMENT DISTRICT NO. 1
RESOLVED, by the City Council of the City of Saratoga,
California, that in its opinion the public interest and convenience
require, and that it is the intention of said Council to order the
following improvements to be made in and for said City, to-wit:
l. a) The improving of Palomino Way by grading and the
construction therein of standard street improvements,
26 feet in width, including standard V-24 concrete
curb and gutter, and 2-½-inch plant mix surfacing on
6-inch untreated base material, and including the
construction of curb at the turnaround at the north-
erly terminus thereof on a radius of 32 feet,
together with a street sign and stop sign.
b) The acquisition of easements and the construction
of base pavement and wearing surface at the inter-
section of Pierce Road and Palomino Way, and the
providing of acceleration and deceleration lanes
on Pierce Road approaching said intersection.
c) The construction of surface and underground storm
drainage facilities and the acquisition of such
easements as may be necessary therefor.
d) The acquisition of all easements and the construc-
tion of all work auxiliary to any of the above
which may be necessary to complete the same.
2. Whenever any public way is herein referred to as running
between two public ways, or from or to any public way, the inter-
sections of the public ways referred to are included to the
extent that work is shown on the plans filed herein. All the
work shall be of the forms, sizes, dlmensions~ depths, in the
locations and to the grades as more particularly shown on the
plans, profiles and specifications therefor approved by the
City Council of said City.
3. There is excepted, however, from the above mentioned work
any and all thereof which has already been done or laid to
official line and grades as heretofore adopted and established
in said plans, profiles and specifications.
4o Reference is hereby made to the plans and specifications
on file in the office of the City Clerk of said City, and the
same are incorporated heroin as if fully set forth herein.
5. Said City Council does hereby adopt and establish as
the official grades for said work the grades and elevations
shown upon said plans, profiles and specifications. All such
grades and elevations are to be in feet and decimals of feet
with reference to the official base and datum of the City of
Saratoga as described in said plans and specifications.
6. Notice is hereby given of the fact that in many cases
said wore and improvement will bring the finished work to a
grade different from that formerly existing, and that to said
extent said grades are hereby changed and that said work will
be done to said changed grades.
7. Said contemplated improvements, in the opinion of the
City Council, are of more than local or ordinary public benefit
and said Council does hereby make the costs and expenses there~
of chargeable upon an assessment dist~ct, the exterior boundary
of which district is the coterminous exterior boundary of the
composite m~d consolidated area of the several lots and parcels
of land abutting on said improvement, more particularly shown
as Parcels A, B~ C, Dr E and F on the map thereof on file in
the office of the City Clerk, to which reference is hereby made
for a more particular description thereof.
8. Said Council further declares that all public streets
and highways within said assessment district in use in the per-
formance of a public function as such, shall be omitted from
the assessment hereafter to be made to cover the costs and
expenses of said improvements.
o. Notice is hereby given that serial bonds to represent
unpaid assessments and bear interest at the rate of four and
one-quarter per cent (~-1/~%) per annum, will be issued here-
under in the manner-provided by Division 10 of one Streets ...and
Highways Code, the I~nprOvement Pond Act of 1915, and the list
in~llmen~ Of such bonds shall mature fourteen (l~i y~ars from
the second day of .July next succeeding ten months fo!lowing
their date.
10. All of said work and. improvements shall be done pursu-
ant to the provisions of the Improvement Act of 1911, as amended.
11. Reference is hereby made to proceedings had under the
Special Assessment Investigation, Limitation and Majority Pro-
test Act of 1931, on file in the office of the City Clerk.
12. The Saratoga News, a newspaper printed and circulated
in said City, is hereby designated as the newspaper in which this
Resolution of IntentsiOn shall be published, and the City Clerk is
hereby directed tO this Resolution of Intention to be pub-
lished by two insertioniS. in the manner and form provided by law.
13. The Superintendent of 8treats shall cause to be con-
spicuously posted along the line of said contemplated work and
improvements, at not mo~e ~han 300 feet in distance apart, and
along all the open streets and avenues within said district, and
in front of all property liable to be assessed, at not more than
300 feet in distance apart, but not less than 3 in all on each
street in said district, notices of the passage of this Resolution
of Intention, in the manner and form required by the Improvement
Act of 1911, and amendments thereto.
14. The estimated cost of the project is ~21,13~.3~.
1~. Notice is hereby given that on X'Jednesday, the l~th day
of l*~ovember, 1961, at the hour of 8:00 O'clock P. A~i., in the
Council Chambers, Fruitvale School, Fruitvale Avenue, Saratoga,
California, any and all persons having any objections to the
proposed work or improvement herein described or to the proposed
grades at which said work and improvements are to be done and
made, or having any objections to the proposed district to be
assessed therefor, or the boundaries or extent thereof,
may appear before said Council and show cause why
said proposed work or improvement should not be carried out
in accordance with this Resolution of Intention.
16. The City Clerk is hereby directed to mail notices of
the adoption of this Resolution of Intention, postage prepaid,
to all persons specified and in the time, form and manner
provided by law.
I hereby certify that the foregoing is a full, true and
correct copy of a resolution duly passed and adopted by the
City Council of the City of Saratoga, California, at a meeting
thereof held on the 18~h day of October, 1961, by the following
