RESOLUTION NO. 99
A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO.. SPECIAL ASSESSMENT AND ASSESSMENT
BOND ,ACTS FOR THE CONSTRUCTION OF ,IMPROVEMENTS
WITHOUT P'JiOCEDÎNGS UNDER DIV;ISION 4 OF THE
. STREETS AND HIGHWAYS CODE

RESOLVED, by the City Council of the City of Saratoga,
California~ that
WHEREAS all of the owners of more than 60% in area of the
property subject to asse8sm.ent therefor have signed and filed "lith
the City Clerk of this City a written petition for undertaking
proceedings pursuant to special assessment and assessment bond
acts and to assess the costs thereof upon the properties benefiteé.
by said improvements, and waiving proceedings under Division 4 of
the Streets and Highways Code, for the following acquisitions and
improvements:
a) The improving of Palomino Way by grading and the
construåtion therein of st~ndard street improvements,
33 teet in width, 1nclu~ing standard v-24 concrete
curb an4 gutter, and 2-2-inch plant mix surfacing
on 6-inch untreated base material, and including the
construction of curb at the turnaround at the nor-
therly term1nus thereof on a radius of 32 feet.
b) The acq~isition of easements and the construction
of base pavement and wearing surface on 50-foot
radii at the intersection of Pierce Road and
Palomino Way, and the providing of acceleration
and deceleration lanes on Pierce Road approaching
said intersection.
c) The construction of surface and underground storm
drainage facilities including drainage outfall
faci11-e:i~es to Calabazas Creek, and the acquisition
of sucb¡;il,'easeunts a8 may be necessary therefor.
d} The acquisition ot all easements and the construc-
tion of' all work auxiliary to any of the above
which _y be necessary to complete the same.
WHEREAS, the costs and expenses of said contemplated acquisi-
tions and improvements are to be chargeable upon an assessment
district, the exterior boundaries of which are the coterminous
exterior boundaries of the composite and consolidated area of all
parcels of. property fronting on Palomino Way, more particularly
shown as Parcels A, B, C, D, E and F on the map thereof on file
in the office of the City Clerk;
WHEREAS, the public interest and convenience will be served
by the taking of lIaid proceedings.
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED
that all of the owners of more than 6Q% in area of the property
subject to assessment for said proposed acquisitions and improve-
ments have filed with the City Clerk of this City a written peti-
tion for the construction of improvements pursuant to appropriate
special assessment and assessment bond acts, without further com-
pliance with the provisions of Division 4 of the streets and
Highways Code.
IT IS FURTHER FOUND, DETERMINED and ORDERED that said proceed-
ings for the construction of said improvements shall be had pur-
suant to the Improvement Act of 1911, and the bonds upon the unpaié
assessments thereof shall be issued pursuant to the Improvement
Bond Act of 1915.
IT IS FURTHER FOUND, DETERMINED and ORDERED that the provi-
sions of Division 4 of the Streets and Highways Code be, and they
are hereby, dispensed with.

I hereby certify that the foregoing is a full, true and
. correct copy of a resolution duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting thereof
held on the 5th day of July.. 1961, by the following vote of the
mem.bers thereof:
