RESOLUTION OF INTENTION TO ABANDON PORTION OF FIFTH STREET The City Council of the City of Saratoga hereby resolves as follows: Section 1: Pursuant to Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Saratoga hereby declares its intention to order the vacation and abandonment of that portion of Fifth Street that lies between Oak Street and Big Basin Way, more ~particularly described as follows: All that 'portion of that 50 ft. street known as Fifth Street in the City of Saratoga, running between the northerly line of Oak Street and a line ~arallel thereto and distant therefrom north 46 31' West 106.45 feet, as more particularly shown on that certain Record of Survey Map recorded in Book 129 of Maps at Page 1, Santa Clara County Official Records. Section 2: The l~!!!~' day of ~'.l.~ , 1963, at the oh'~ of 8:00' ~""'dl6d~'P.M., at the Fruitvale School Auditorium, Fruitvale Avenue, Saratoga, California, is hereby fixed as the time and-place for hearing all ~persons interested in or objecting to the proposed vacation and abandon- ment above set forth. Section 3: The City Council further declares that it may require, as a condition to ordering abandonment of the above-described public street, that said City either retain, or in the alternative~.secure, a 'public pedestrian easement over a 15 ft. portion of the above-described 50 ft. street, and will hear evidence from all persons concerned as to whether or not there is retention and/or easement upon the abandonment of said street. The above and. foregoing resolution was passed and adopted by the City Council of the City of Saratoga at a regular meeting held on the 17th day of April, 1963, by the following vote: AYES: Glennon, Brazil., Drake, Hartman, Ritchie NOES: None ABSENT: bYone ATTEST:
