A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA CONSENTING
TO AND CONCURRING IN TH~ PROPOSAL AND PETITION OF THE CITY OF MONTE
8ERENO TO CORRECT AND RELOCATE THEIR COMMON BOUNDARY IN THE VICINITY
OF SAN TOMAS AQUINO CREEK AND AVON LANE.
WHEREAS, the boundary between the City of Saratoga and the
City of Monte Sereno in the vicinity of San TomasAquino Creek and
Avon Lane now conflicts with established property lines; and
WHEREAS, the City Council of the City of Monte Sereno has,
by its Resolution No. 163, petitioned the City of Saratoga for the
correction and relocation of this common boundary line, pursuant
to the provisions of Article 8, Chapter 1, Part 1, Division 1, Title
5 of the Government Code of the State of California, and
WHEREAS, the proposed relocation of said boundary lines con-
fonns as nearly as practical to the former boundaries, and
WHEREAS, the relocation of said boundary lines will be in a
manner that the majority of the area of the parcel of property af-
fected determines the entity within whose boundaries the parcel or
'property is or shall be located, and such relocation does not
relocate within the boundaries of either the City of Saratoga or
the City of Monte Sereno, pro'perry in any parcel in excess of one
acre in area, and
WHEREAS, a map and exact copy of the description of the proposed
relocation of boundary lines as herein described has heretofore
been submitted to and reported upon by the Boundary Commission of
the County of Santa Clara,
NOW, THEREFORE, the City Council of the City of Saratoga here-
by resolves as follows:
Section 1. All of the 'preambles hereinabove set forth are
hereby referred to and incorporated herein by reference as findings
of this City Council.
Section 2. That the parcels of land affected by the proposed
location of the new boundary lines are lands lying and being within
the territories as shown on Final Map of Tract No. 3273 "Stratford
Estates" in the City of Monte Sereno as recorded in Book 163 of
Maps at page 44 and 45, Official Records of Santa Clara County and
as shown on that certain Record of Survey Map of lands in the City
of Maps at page 47, Official
The City Council of the City of Saratoga,
Part 1, Division 5 of the Government Code of the State of
California, does hereby consent to and concur in the aforesaid re-
quest and petition of the City Council of the City of Monte Sereno
for the correction and relocation of their common boundaries in the
vicinity of San Tomas Aquino Creek and Avon Lane, pursuant to
Resolution No. 163, to the end that the westerly boundary of the
City of Monte Sereno and the easterly boundary of the City of Sara-
toga shall follow the realignment of the San Tomas Aquino Creek and
shall be described as follows:
Beginning at the intersection of the center line of Quito
Road, 40 feet in width, with the center line of Avon Lane,
40 feet in width, as said Road and Lane are shown u'pon the
Map of Tract No. 3273, Stratford Estates, a Map of which
is filed for record in Book 163 of Maps, pages 44 and 45,
Santa Clara County Recordsi thence along the said center
line of Avon Lane S 73° 34 10" E, 257.56 feet; thence
leaving said center line of Avon Lane, N 28° 57' E, 29.71 feet
to the intersection thereof with the existing center line of
San Tomas Aquino Creek and the TRUE POINT OF BEGINNING; thence
in a generally southerly direction up-stream along the new
center line of said San Tomas Aquino Creek the following
courses and distances:
S 16° 25' 50"W 126.16 feet; a curve to the right, having
a radius of 750 feet, through a central angle of 4° 26' 24~'',
for an arc distance of 58.12 feet;
S 20° 52' 14" W, 34.93 feet;
S 25° 39 ' 03" W, 56.62 feet;
S 11° 50' 45" W', 30.00 feet;
S 3° 31 ' 55" E, 52.60 feet;
S 16~ 14' 55" E, 64.10 feet;
S 24° 04' 05" E, 142.04 feet;
S 34~ 28' 30" E, 24.37 feet;
S 37° 27' 40" E, 134.86 feet;
S 19~ 05 ' 00" W, 32.50 feet;
S 590 04' 00" W, 20.00 feet; and
S 82° 47' 40" W, 41.00 feet to the intersection thereof with
the existing center line of San Tomas Aquino Creek.
Section 4. A co'py of this Resolution and consent is hereby
ordered filed forthwith with the City Clerk of the City of Monte
Sereno and pursuant to Government Code Sections 50196 and 50198
of the State of California, the City Council and the City Clerk
of the City of Monte Sereno are hereby requested to complete the
correction and relocation of the conmon boundaries of said cities
in accord with the aforesaid 'petition and this consemt.
The above and foregoing resolution was regularly 'passed and
adopted at a regular meeting of the City Council of the City of
Saratoga held on the 21st day of August , 1963, by the follow-
ing vote:
